It is fair. These cases can be expensive and difficult to prove. This way, the penalty is set, a bad actor is removed from the marketplace, and there is no opportunity for appeal. The role of the SEC isn't punishment, it's protecting the market. And the SEC process doesn't preclude criminal liability.

@blambrax, their argument has some really interesting, and scary implications, cause if the court rules such immunity nonsense is legal before the election, what's stopping the Biden administration, other than the ethically obvious, from taking action against a clearly corrupting influence on our society. SEC has to do their own investigation first, and then, if warranted, make a referral to the DOJ. Considering the scope of the violations (even without Trump's involvement) such a referral is guaranteed. SEC will also have made a referral to their own Inspector General.
