Tesla failed to take evasive action regardless.
The white sedan that did a full stop on the freeway is partially at fault but the tesla driver might be more at fault because it rear ended the vehicle in front of it.
It wasn't a brake checker. It was most likely a tourist or someone out of state who didn't understand the toll system. The car stopped under the automated toll system. The police can find the vehicle if they look at the toll videos. Now, these toll systems can take a picture of tags if you don't have a transponder.

A good example of why you shouldn’t drive close to the person in front of you. The white Y was driving too close to the car in the left lane and changed lanes too close behind the truck. They would have had more reaction time if they kept their distance.
It's called following too close and it's literally against the law.

3:07 in most states, an uncontrolled intersection is to be treated as a 4 way yield, with the vehicle approaching from the right having the right of way, opposite of that to a roundabout where the vehicles coming from the left having right of way.

They both failed to stop at an intersection, controlled or not! You need to at least slow down and look both ways.
I believe the driver is supposed to yield to the person who was there first even in an uncontrolled intersection. I could be wrong but I think that is what is supposed to happen.

11:57 Rahul is an idiot. He's driving quickly through that parking lot and could clearly see the Nissan and what it would likely do far before anything happened. Even if the Nissan needed to yield in that scenario (it varies), he then proceeded to tailgate the Nissan out of the parking lot and make a reckless maneuver by pulling alongside the Nissan immediately. Any competent defensive driver would be likely aware that the Nissan is not very aware of their surroundings and would give them plenty of room. I'm sure most people watching knew what was about to happen as he pulled next to her. Yes, it's technically not his fault, but he sure did put himself in a position for that to happen.
that was my first reaction when I saw that clip. Defensive driving would have easily prevented this while not wasting any time. One silly accident saved, and your many few seconds lost in defensive driving are worth it!

I say this again and again. Do not pass on the right at unsafe speed. Pushing your car past another car in less than a second after taking a turn is not good driver's practice.

Your last point is correct. But she was fully in the left lane. He had no way of knowing she would decide to change lanes when if she had wanted to be in the right lane, she should have turned into it. It was perfectly safe (and legal) of him to turn into the proper lane and drive straight.

I don't drive a Tesla, so I use FSA (Full Situational Awareness) to avoid collisions. It's been around since the dawn of time and available to everyone.
Something that Tesla drivers who use FSD seem to lack badly.

It's selection bias and exaggeration from Wham Bam. There are over 40,000 CyberTrucks on the road, including mine, and 99.9% of us owners never deal with the supposed "hate" that this channel keeps suggesting. We've shown our truck to dozens of excited friends and strangers.

1:00 - THIS is why 'brake checking' should be considered felonious aggravated assault with a deadly weapon (said weapons being traffic behind the vehicle forced to stop by the brake check).
How do we know it’s a brake check? For all we know the car could have been disabled or there was an obstruction. Regardless, the Tesla driver had every opportunity to slow down and avoid hitting that other white car. It’s their fault, 100%.

A: the vehicle was not disabled.
B: there was no foreign object or traffic in front of it.
C: they had a stolen tag
Ergo: Brake check, likely attempted insurance fraud (which would've gone badly for them once the cops showed up and checked the tag).
@ They probably didn’t realize they were on a toll road, but it doesn’t matter. The white car that stopped behind it negates the brake check which was why in Carlos’s situation with the Mazda and the Ford van, since he stopped and other traffic stopped too, the brake check was negated in that. Obviously the Tesla driver didn’t see the Buick stopping, there was only contact between them and the Kia, so it’s probably not even worth going after the Buick driver. Go after the Tesla driver and get paid. I’m in California though so laws may be different here, but the Tesla would be found at fault by CHP here since their unsafe speed was independent of everything going on up ahead. Plus, Tesla drivers have to have big insurance policy coverage because it’s expensive to fix a Tesla, so that driver who got hit is better off going after the Tesla driver because it’s a guaranteed bag since they were hit from behind.

@crperformance1 the white sedan in the center lane in the lead braked heavily for seemingly no reason (there might be a reason off camera) but otherwise that braking is likely the cause.
The majority of collisions are caused by idiots driving in close proximity to one another on the highway, slowing and braking for no reason. Not speed (unless you count slow impeding dangerous speed).

Although let me just say that, as a road fanatic myself, one thing that this intersection you crossed when you got hit is missing are stop signs…and I mean there are zero…specifically the ones on the left and right cross traffic directions. I mean, I live in Minnesota but have family in Wisconsin (specifically the Madison area) and I’m not sure if they have intersections of this kind. So, but even on residential streets like this, stop signs or maybe just yield signs like those on highway on-ramps are a MUST. Then that would make people like the minivan driver beyond more likely to be held responsible for crashing into you, but even without them at least thank goodness her fault still remains per evidence of the footage and police report. Recently drove to the US for the first time in my life, I am shocked by the designs of some of your intersections... We have nothing like that in Canada (that ive come across at least). Even construction sites have stop signs.
It's 2025, not 1925. What city in Wisconsin still has uncontrolled intersections?
Right?! There are a few in the L.A. area where I grew up and my parents still live, but those are 'T' intersections where the driver whose road ends is required to give ROW to the driver on the through street. A couple of them actually have STOP signs now, but not sure why since we all know who has ROW. These 4 way uncontrolled intersections are just danger zones waiting for a death or paralyzed accidents victims.

1:00 The Tesla would be at fault in this TBH because they failed to react in time. Regardless of what the Buick did, the Tesla was going at an unsafe speed for conditions.
I mean yeah, but it’s a clear sunny day in Texas. The speed limit is 70 on the turnpike, they were probably doing about 80. Everyone speeds on the George Bush. Nothing excuses the car that was DEAD STOPPED in the middle of the tollway, then speeding off making it essentially a “miss and run”.
@ The speed limit has nothing to do with stopped traffic in front of you. You can still be found going at an unsafe speed for conditions. The fact that the other white car was able to stop negates the “brake check” on which it isn’t a “phantom collision” or a “miss and run”, the Tesla would be the cause of the collision because their speed was unsafe for conditions. The fact everyone speeds on the freeway is not an excuse for you to hit someone in front of you. Actually, it would put more people at fault if more people piled onto the collision.

All those idiots at the ski area without proper snow tires. I swear this world is getting dumber and dumber. My Jeep on Blizzack snow tires feels like it can stop on a dime still in the snow and on ICE it can still stop much quicker than most vehicles it seems. But then again I know not to hit the breaks hard and IF I slide to let off and slowly apply the brakes again.
For the one in Wisconsin he should be glad he’s only 45% responsible. Having grown up with and learned how to drive with many cross streets like that where two side streets cross and there’s no stop sign each driver is responsible for slowing down and looking before you cross the intersection so it should’ve been 50/50.
How would you know the intersection is like that before entering?

-Dakoda was already in the intersection when he got hit, therefore he was at the intersection first.
-If they had approached the intersection at the same time, the van was on his left so they would have needed to stop according to the law.
I agree. Given his car was hit in the rear that means he was in the intersection first and should have the right of way. However, the other car was to the right which is probably the argument the other insurance company is banking on.

5:37 I'm no expert, and am probably wrong here. But wouldn't those scratches to the tesla be circular due to the wheel's rotation?
If they were exactly in the center they would do a straight line. So I wouldn't wonder that they don't do circles when they are slightly away from the center.
In fact they make one turn in the same distance where the whole wheel makes one turn. But with far less diameter. So it's almost a straight line.

Yea I’ve never seen a fully uncontrolled intersection like this in a neighborhood zone like that, but even if the other sides have stops signs I still slow down😂

@@kidamere2408 I think the point being is that a Tesla caused the crash. The person that rear ends the vehicle is at fault for failing to maintain safe distance & stop to avoid the collision. The tesla that managed to pull over & not become a participant in the crash is not that impressive. Multiple human drivers did the same in that incident. So what if it was off in the distance? Good driving habits are to be scanning the road at least 15 secs down the road for developing situations.

When I was in my late teens, my dad, many times, insisted I keep more space with the guy in front. One rainy day, I learned my lesson and hit the car in front. Minor fender bender, but now I keep plenty of space, and avoid trouble.

#12 Uncontrolled intersection 50/50 at fault. While Dakota claims the other driver did not slow or was distracted the same goes for Dakota at the intersection.
Yeah Dakota didn't slow down either. Uncontrolled intersections are supposed to be treated like there are yield signs. That being said, based on the impact, Dakota WAS the first one to enter the intersection. So technically it would be the other driver's fault. Failing to yield right of way.
I take it back after thinking about it a bit more... I guess if the car on the right hit the cammer then the cammer must have failed to yield right of way, and that's close enough to say they're both arriving at the same time. No matter what, you have to yield to the car on the right at an uncontrolled intersection. I suppose the difficulty would be whether or not cammer was on a main through-way, and the minivan was on some tiny side-street.

Can't believe a neighborhood intersection doesn't have stop signs.
It's actually quite common. The main rules to follow are if two cars arrive at the same time, yield to the car on your right, and when turning left, yield to oncoming traffic. Always yield to other traffic already in the intersection when you get there. It's always best to slow down and pay attention.
That car is a 2014 buick regal sedan.

It was obvious for a long time those cars were stopped in the road. Whoever was in the Tesla didn't hit the brakes until the last second when they had tons of time to do it.

The cyber truck was going slow at a steady pace, of course it’s going to maintain control, any vehicle can maintain control at low speeds, teslas aren’t special
The entire parking lot was covered in ice and absolutely 0 portions of it are flat, all portions of Timberline Road are a rather significant slope. Driving slow is what you are SUPPOSED to do in snow/icy conditions but people always seem to forget that facet of driving. I frequently park in that parking lot and people fly down that road (around the blind corner) at like 40 mph, downhill ... on a solid sheet of ice... with people out playing with dogs and kids wandering around...

The comment to video no. 14 was unnecessary, yes it was the driver of the Hummer who was to blame for the accident but to suggest that the person in question is committing "a crime against common sense" just by owning such a car is too stupid to say. It is comments like that that make me completely lose respect and interest in this channel. "Supporters" of petrol and diesel cars are often criticized for making derogatory comments to/about owners of electric cars. This is of course not okay but the same applies the other way around. The choice of car and type of fuel (petrol, diesel, electricity or hydrogen) is and must be a 100% free choice. An electric car can be an excellent choice for some but certainly not for everyone. Just like a diesel car. Everyone should be free to choose the type of car that suits them best. 100% freedom of choice.

Yeah he should be grateful they're only assigning him 45% liability. Uncontrolled intersections mean you follow "right" of way where drivers from your right get priority.

Well they are. The Tesla was driving dangerously close to the Honda first and then changed lanes to go dangerously close behind a pickup truck where bow they couldn't see anything ahead of them. That was aggressive driving imo
In my country if someone slams into your car from the right on an uncontrolled equal intersection, you are in the wrong. No matter where the car hits you.
Having indepent driven wheels by an electric motor is better than having 4WD on a Pickup but have better tires is always gonna make the most difference so just because they are gas vehicles doesnt me they are worse then a tesla with Battery that took shit tons of emissions to make...
