Jack menerima tawaran kereta itu daripada Mimi dan menjual kereta itu kepadanya dengan harga RM85,000 .00. Setelah mengetahui perkara ini, Bad memutuskan untuk mengambil tindakan terhadap Mimi atas alasan dia tidak berhak mendapat kereta itu. Nasihat Mimi. Is it this case fall under implied condition as to title ?
hai sir assalamualaikum, saya nak tanya sir, if kalau contoh mira beli barang dekat kedai furniture untuk office dia which is contoh 20 meja and 20 kerusi la, then dia diberi tempoh selama 30 days. and at first furniture company tu just hantar 20 meja dulu and dia akan hantar lagi 20 kerusi tu pada tarikh yang lain. and then mira tu gagal untuk bayar bila credit period dia dah habis so kedai perabot tu refuse la kan nak hantar barang but mira still nak claim, so kalau situasi macamni boleh ke kita guna remedies of breach which is rights of unpaid seller against the goods under lien ??

Asalkan dia adalah “movable” atau boleh digerakkan, then dia falls under definition of goods dalam sec 2. If dia falls dalam definition goods, then cover. If not, then tak cover :)
I think your question is not accurate my dear. SOGA covers contract of sale where the title passes as soon as the contract of sale is made. In contract of purchasing goods by installment, the title does not pass to the hirer. The hirer only gets possession and the title remains with the owner/financier/bank. The hirer will only get the title once he finish paying the last installment. So that's the different. As for the definition of goods, sec 2 of SOGA defines goods as all moveable properties with some exceptions. So as long as the goods is moveable AND title passes when the contract of sale is made, then SOGA will apply. I hope this helps :)

Wassalam, hai..who said they have to come together? Try to refer back and read your notes on 16(1)(a) and 16(1)(b). They are talking about different thing. In answer, only quote section which is applicable to the question. I hope this clarify. Good luck :)

Wassalam, if barang still ade dekat seller and buyer sepatutnya bayar tapi tak bayar, then seller boleh exercise right of lien

No, if you are aware about the terms of the contract, you cannot later claim that the interest is too high.
