Nicely explained by Adv. Ramesh Prabhu. Some societies do not have anay reserved category member. What happens in such a case. Also if there is any reserved category member but does not want to contest then what happens. it was necessary to mention in the lecture.

21 members ,but no elections held since more than 8 yrs.Chairman not prepared to hold elections nor books kept, even auditors are kept but auditor not shown
New Election Rules are so time-consuming, complicated & expensive. Returning Officers are charging ridiculous amounts beyond the budgets of CHS. How can a Honourable Secretary with a job/business prepare so many lists, paste them on Notice board, hold that many SGMs, pursue Nominations & Registrar & the ill-experienced Returning Officer! Merci!!😬😞😥
Committee members are looting society funds at many societies so such election rules are necessary to remove corrupt committee
What is code of conduct and since when it is to be observed? After election officer is appointed and provisional voters list is displayed on notice board, can society hold an SGM for any reason?

Sir, can a nominee become an associate member in a co-op hsg society. If so, how can he declare that he has no right, title and interest in the property.

Sir our society has 40 members so how we could be go for appointed to the new committee. and there is no one coming ahead to be a part of the committee member in such case only a three-person to take responsibility as a chairman, secretary, and treasurer not more than several people to do as nomination. In this case please guide me.

Election was conducted mutually before 60 days and then Society 's Secretary having 24 members has approached DR for Election and DR has appointed RO then what members can do? In our society after completion of procedure meeting was called for unopposed election on 21/11/21 & list of unopposed committee members was declared. Next day Returning officer submitted his Report in prescribed form to Dy registrar for Constitution of committee but reply is still awaited so Returning officer has not taken any action 15 days passed what is to be done now please clarify
If the body is elected unopposed but without following correct procedure and law is it legally constituted body ?

What is the procedure for adhoc committee formation while hand over process by chief promoter. Does the form E2 is required to be filled
V have 49 members. Since no one was ready to get trained as an election officer v approached one from the approved panel. His charges seemed rather exorbitant n he wanted it in cash. N no receipt wud b issued for the payment. Can v therefore go ahead with election without an election officer since there won't be sufficient candidates to fill up 11 seats of the mg committee. Also no candidates r available for all reserved constituencies. Can v induct members from general category to fill up vacancies in the reserved categories. It's not clear where the amount collected from candidates will finally end up. Will it remain with the returning officer or is he supposed to deposit it with d registrar or any other statutory body. If not will this become an additional income for the returning officer over n above the fee being paid by the socy. Ur early clarification in this regd wud be appreciated. Thanks

Very beautifully explained. I need a clarification, in the Bye laws it is mentioned that a person who is a defaulter cannot contest a Election. Now here default is Monthly Maintenance or that includes penalty and other charges?

What we members do? if this there is not elected committee members are illegally ruling as elected managing committee.and can they pass resolution in annual general meeting for not to held election and existence committee will continue as next period as working committee. Please guide

If nomination is for reserved SC st OBC seat then yes, general seat ...not necessary
