Contra Costa County, California recently paid 8.4 million dollars for the false arrest of a mother and her daughter for a false arrest. Arresting a truck driver for refusing to assist with a DOT inspection is a false arrest. This DOT officer was acting like a jerk, and I suspect that is the reason why this truck driver refused to help him.
Now that Chevron law has been overturned, companies should sue FMCSA for not being able to challenge points on their CSA score due to receiving a warning. Since points affect both the company and the driver, they should have the right to dispute them.
You do have the right to challenge anything that goes against your CSA score. There is a proper way to do everything. Will you win and get them off?? Depends on the situation.
Let me clarify: since it is a warning, the company or driver cannot challenge it in court and let the judge make decisions. Therefore, the company and driver should not receive CSA points. Yes, you can challenge any CSA point, but it will be reviewed and decided by the FMCSA, not by the courts.

No you don't, I have refused 3 time's. By law you have to hand over paperwork, log book, and driver license. You don't have to help do inspection.
Same, Give all the paper work and observe. It is your duty to watch what they are doing to the equipment and load, you are responsible for. Many times they have tampered with things to create violations or cause issues with a load.
@@amunderdog i was getting a level 3 in north carolina one time and the dot cop said your chains are loose. i was flatbedding with a wide load on permit. i told him, do you have a stain gauge? he said din't need one. i informed him that the load was loaded and tied down by the shipper useing stain gauge. he didn't know what it even was. his head guy called the shipper they informed him that the load was properly tied down. and if the dot messed with it then there would be problem's for the dot. in the end they said , ok , its fine.

It's called the 5th amendment. You do not have to say or do anything that can be used against you in a court of law. The officer is violating the drivers rights. Law suit.

True. However, Dot has the legal authority to shut you and whatever vehicle you're operating down until it's proven safe to operate on roads. And I don't think fmcsa specifies a time frame. So if it takes 6 months to investigate, then that's 6 months you and that vehicle is shutdown.
FMCSA says you must allow the vehicle to be inspected. No where does it state a driver must assist in the inspection. Citing a citation that is false is also illegal. The failure is on the officer to properly inspect the vehicle which can be seen as fraudulent in a court of law.
So if they need help to find the problem how in the hell they expect a driver on his own to find the problem.. i will never help them because i dont see them .. F them ..

The officer said "i you refuse the inspection....". This is different than not helping.
The driver can just quit the job and become a "civilian" who doesn't have anything with commercial inspections
You have always been a civilian unless you have served and even then you come home to be a civilian once again just supposedly with benefits. Secondly he said he will not help with the inspection not refuse the inspection. People in this country seem to hate when people exercise freedoms fought for by the many service men and woman active or veteran. The right to remain silent or anything you say or do can be used against you keeps you from incriminating yourself. The only thing the driver now has to do is wait out how long the officer decides to take because he is now pissed off.

I never been Out Of Service, when I'm Driving long haul DOT are sleeping, When you are Driving I'm sleeping (drive in the night ) like a Gost . no heat, trucks run better , no traffic than sleep in the day.. 18yrs driving here no Violations or tickets.

I had a dot officer in Georgia do a level one inspection asked me to help I refused in the scale house put the keys on the counter and do it yourself he did but when he was in my truck he was told before hand that he was not allowed to search my truck and that if he did he would be removed and put on the ground till the us Marshalls arrived he took this as a challenge I recorded and watched everything on my dash camera and personal cameras from about 40 feet away he got done with the inspection cab and then attempted to enter my sleeper berth I ran up on him and said absolutely not you will not violate my rights he said step back or I would be arrested and continued to get out of the seat and try to enter the back I climbed up and grabbed him by his belt disarmed him and threw him on the pavement I sat on him while I called the Marshalls office they showed up and told me to get of the officer I did he was arrested I was set free this was two years ago and whenever I’m in Georgia now they just bypass me I have been driving for 22 years and only have 3 points in the last five years thanks to the ELD mandate lesson is here to record record record and have it saved off site so they can’t destroy evidence

They can threaten to shut you down for 10hrs and blah blah. By law the DOT can't take your keys and do it themselves. The can see what is in eye view in your cab. They can't open nothing inside your truck that is a federal crime.

I sued the DOT for the exact same thing. They settle for 500k. Look at it this way if the DOT needs 2 people to do an inspection but the driver only needs one person. Let that sink in.

I got a level one this morning in Kentucky and the officer did ask me to get out and unhook the airlines . I did and didn't even think twice about it . I choose my battles wisely because I am an adult. I also passed successfully.

In 29 years of my freighthauling I have never had an inspection.. they’ve looked at my paperwork,, that’s it.
A friend of mine tells them to “Have at it” and gets out of his unit.. walks off to the outside of the scale house and waits.

No they can't even make you do it if you're a company driver with the company's I've worked for before becoming an O/O. It used to be a fun way to get under their skin and take a break. I've done it quite a bit coming east at Gallup port of entry on I-40.

I’m in Knoxville and have been here 25 years. The DOT is out of control here. Been stopped 3 time this year. Never been stoped in 25 years. Each time I got a clean level 1 and a warning for some fake thing. Tn has hired hundreds of new officers. We are no longer the volunteer state. We are the better bend over state.

In all of my 4 months of truck driving, I have never EVER heard of a DOT inspector officer asking you to do stuff for them while they are conducting an inspection.

You can make them incriminate themselves by asking them when you no longer have the 5th amendment rights. Whatever awnser they give is the basis for a federal civil rights lawsuit. Alot of these states no longer have Qualified immunity to protect the cops so when you get a judgement you can take their assets.
Under the 4th and 5th Amendments of the US Constitution you do not have to bear witness against yourself. And, the DOT Officer needs to have probable cause that there is something wrong with the vehicle; otherwise, he is going on a fishing expedition (legal term, anything he finds is known as “Fruits of the poisonous tree” and therefore can and the evidence found will be tossed out of court as illegally obtained evidence. I have been a truck driver for 12 years. A law enforcement officer for 10 years and have both a BS in Criminal Justice and a paralegal certification.
I had a DOT officer from the Fairfield, Ca scales tell me that I have to take my truck back to the same scales for reinspection for a fix it ticket. (Tented windows)
You can be put in jail. Not because it's right or just, there's a truck driver who tried this in Kentucky, he got out when requested, but locked his door so they couldn't go in his truck while the wasn't around and they arrested him right then on a technicality, and the D.A. over the case said he might've had a case but when he locked the door it constituted obstruction of justice, so in order to railroad this guy they doubled down just to make sure he was scared. He took a deal to avoid criminal charges instead of fighting it. So unless you're willing to fight this out in court and you have a good lawyer advising you in your strategy with this if you make the wrong move they can chew you up and spit you out.

i have found that tenn, has some of the dumbest dot cops. at one level 3 inspection, i was outside the truck, the dot cop was showing a rookie how to inspect the truck. i looked and they were both in my cab, in the back, opening up my cabinets. i informed him that if he did not have a warrant to search, then both need to get out! they looked at each other and got out. end of inspection.
Like I told a dot inspector in salinas(I think), ca., he said I can't do this by myself, I said that sounded like a staffing problem....I was released and the station closed!

What is a non-American? A citizen or a legal resident who speaks with an accent? An illegal immigrant without proper credentials and licensing to operate a CMV on US jurisdictions? This tendency to profile individuals based on accent and physical appearance is at least dangerous and utmost being hateful and bigoted. You have no obligation to help the officer do the inspection. Self incrimination is what happens when you help and then you have a violation.
There is something about not obeying a police officer’s command. In this case I don’t think the officer has a right to jail the driver for refusing his orders. But has a right to question why the driver is refusing to help and therefore could detain the driver’s departure costing the driver time and money. Oh and if the officer wants to he can take the truck apart and claim to be looking for drugs and illegal fire arms. It doesn’t matter what the driver says at that point they can do it under right to search and reasonable suspicion.
He might not be able to arrest him, but he most certainly can put him out of service until the inspection is completed.
Send this video to the state of TN and get some answers about this officers statement. Honestly just another under trained under educated officer touting falsehoods and being a bully. Call them out Alex.
Now I personally think you should assist in anyway you can. I fact unless you own the truck most carriers require you to cooperate with law enforcement.
Had same issue right after picking my truck up out of shop getting service. They rubbed inside of steer and drives on pit rail ten minutes later dot nearly turns his suv over locking brakes sliding crossing median speeds like hell pulls me over for inspection. When he sees the rub mark on tire immediately has me turning steering hard tells me I must jerk on it. I already told him just picked my truck up getting serviced. He jumps up starts yanking on my steering wheel. I took photo of his badge and name plate told him inspection was done get off my truck he is pissed goes to his suv going to put me out of service called his boss told him what was going on gave him officers information after about five minutes of getting his butt chewed out he brings my license registration and all back. Head down like a whooped pup says there. His boss called me back ask if he apologized said nope just said there when returning my stuff. He said don’t leave yet. He got more ass chewing then came said I am very sorry for detains you for two hours and the inconvenience. I stepped down looked down at him reached out shook his hand with at little extra squeeze said be a man not a know it all prick life will go a lot better. Moral of story is his boss knows me personally and knows my 99 W900 is in top shape and I am very maticulous about it. The whole front end is new it is heavy duty and $1,100.00 steering wheel.

In Georgia in owner operator sued the DOT and one a few years back for the same thing after they arrested him.
DOT does not have the authority to arrest you without criminal statutory cause meaning you have to break the law like being drunk or have controlled substances in your truck.
It was ruled that if they wish to perform a level one you can step out of the vehicle and they will have to perform it without your help

The USA 🇺🇸 constitution says you don’t have to self incriminate. By participating in a DOT inspection is self incriminating if something is found.
Safety violations are not criminal
Nobody is obligated to help cops in their investigation. Just because we’re truckers doesn’t mean we don’t have constitutional rights like the Fifth amendment which protect against self-incrimination
If you hold a CDL, you have extra duties and responsibilities that a regular layperson does not.

Driver did post trip and pre trip. Its on his ELD, so in reality he already helped him, so he should be in his truck as DOT walks around, there is nothing that states to help the DOT....they have taken a few to jail for this i heard. Im hoping this happens to me, my attorney will have a field day with this....again its not the drivers job, i found nothing in writing that states I or ANY OTHER DRIVER is required to help....im not a dick, so i will turn lights and turn signals on but thats it ...

I saw this on tik tok. The driver said that he eventually helped with the inspection after the video. He also said they only found a violation for a nail in one of the tires.

Now that the chevron deference has been overturned, I believe this trucker played the 1000iq play here. Before this overturn a couple of days ago he was a DAMN FOOL! 40 years, of being fucked in the ass today is the day we can finally fight back. So, good on him for standing up.
All that being said, this driver could of handled it better. He was seeking a fight, and like any man would who was being poked they'd fight back. I don't care how zen you are, things are still going to trigger you.
The driver should have politely asked for the officers name and identification/badge number. The driver should have complied with blinkers, lights, etc. Main thing is politely record the inspection and identify all public servants present. A LOT of pressure can be put on an unreasonable public servant after the incident IF a full video of the encounter is available.
If you give up your rights, you have none. As for being put out of service or arrested….for what?? No law states you have to help them also WHAT are you being put out of service for?? They can’t just make something up, has to be legit or it’s illegal. The Chevron ruling must find its way into ALOT of the DOT regulations. This has to change.
The cop can charge the driver with obstruction, and arrest him. That means the driver is going to jail, and his rig will be towed and impounded. The driver will have to make bail to be released. Will it stand up in court? Maybe. Its a whole lot less trouble to just help the cop out.
He is not obstructing anything unless he been suspected of a crime. Now if he had illegal people hiding in his truck and refused the inspection then he has a problem. A dot inspection given by the power of the fmcsa is definitely not a crime. It’s literally not found in any law book state nor federal. Random drug tests different story.

5th amendment doesn't apply in this situation. No one has been accused of committing a crime.
I honestly think by not cooperating with the DOT officer during the inspection (ie push brakes, activate lights, etc) can in fact result in violations just like you said. If they don’t see it work then it’s inoperable and can result in OOS. But putting someone in jail is questionable but they could use the charge of not following a legal order given by an officer.
This Driver is very ignorant.
He should be thankful for having the opportunity to live in this country.

I don't necessarily like cops all the time, but getting an inspection is part of the job. He just ask him to turn the steering wheel and will ask him to turn the blinkers on/off and the lights. No big deal. If I was the DOT officer and he refused to turn the steering wheel, I would have shut him down there. Told him to park and put him out of service, he failed the inspection because the steering didn't work.
If you don't use a turn signal and turn you can be pulled over and ticketed. He's telling you you didn't obey after the fact. So, obey when he tells you to put on.

No one assists on my pretrip. Any driver rap on your door at 2am for a pretrip inspection assistance? No! You tell them to go pound sand.
Do you rap any other drivers door for assistance on a pretrip? No! You do it by yourself.
I can write two warnings on every truck on the highway in an inspection and so can you. A truck on the showroom floor can get a violation or at least a warning.

Every time I was asked in a level 1 and 2 inspectiin I have helped, and actually passed mine as I always pretrial and when I see a problem with my rig I get it taken care of immediately. Also, it is actually better to assist with the inspection as you can see everything the officer is doing and that actually benefits you as let's say you remain in truck and he comes back and says a line is chafed, with you right with him you can see what he sees.. so it is better to help and will get you out of there a lot faster.
I asked a trooper about this he said if I didn't help he would call a wreckerd out and have the driver who has a cdl work the lights then it would be up to me to pay for the wreckerd

Why make your day harder? I have had several DOT inspections, and I noticed that the officer goes off my energy in the initial meeting. I treat it as a learning experience.
Get go pro and record them. Sue them.
If your truck is not a piece of junk & have all paperwork in order then you have nothing to worry about.If you go the route of not helping the inspector he will make it hard on you&keep you for hours.Professionalism&courtesy goes a long way.

Since the Supreme Court has passed the Chevron Court case that regulators can not be force so Epa Ochoa the Sec and other government agencies who make regulations and NOT LAWS cannot be enforced per the Supreme Court so since all the Fmcsa are Regulations the court system should get real busy imo
Why do you not want to help DOT with inspection just comply with the law officers make yours and the officers life easy you are just making it harder for EVERYONE ELSE
That’s my exact thinking as well…. If you can’t demonstrate the vehicle is up to snuff then the DOT cop could just tag each item as a fail. Many of those items cannot be rectified without a certified mechanic to sign off on them even if they were in working order. Honestly, just help the cop do his BS so you can get back on the road. I think most people playing games probably weren’t going to pass inspection anyway. And if you piss the DOT cop off he will find stuff wrong on your truck that you never thought to look for yourself. Like the airlines that traverse the entire length of your trailer….. any rub spots? And the wires? The cops all tell each other where those rub spots happen on each brand of trailer and they do not share that with truckers or companies. Don’t screw with the guy who has complete power to screw you!
