How much is a personal injury case worth?

    Hey everyone, Barry with the LawFull channel. I’m a long time personal injury lawyer here in Chicago. I also do marketing for other lawyers. On this channel you’ll find short videos on the legal topics that affect our lives. If you haven’t already, please subscribe to my channel and if you have any questions please put them in the comments section.
    So how do you figure out how much your personal injury case is worth? Well first I want to tell you how not to value your case. You read a lot on the internet that you’re supposed to take your medical bills and multiply them times 2 or 3 three and that’s how much you can expect to get.
    That’s a really old formula and not really applicable any more. But if you’re representing yourself and you’re trying to figure out how much to ask for you can start there.
    But don’t expect the insurance company to look at that as a viable way of making you an offer.
    So, if you can’t use that old formula, what do you do? Well, you look at a wide variety of factors, the first thing you need to know is there are two main types of damages - special and general damages.
    Special damages are your economic damages like lost wages, medical bills and out of pocket expenses while general damages are your pain and suffering, anxiety and emotional distress.
    For your special damages, it’s easy, you ask for your costs basically, if you had 5,000 in medical bills or $2500 in lost wages, you submit all your meds and if they’re verifiable, you should recover that much depending on what state you are in.
    Most people don’t ask me much about their specials. The question I usually get is how much is my pain and suffering worth? This is what personal injury cases are mostly known for.
    First, like I said above, there is no formula. One thing I can guarantee, your idea about how much its worth is going to be very different than the insurance company’s idea that’s for sure. And the tough part is how do you measure the value of your pain?
    Well how much you can recover is based on a few factors:
    First, not sure if you thought about this but the first factor is the severity of your injury - if you suffered a back sprain, your recovery is going to be significantly different than if you suffered a herniated disc. It’s a sliding scale with sprains and strains on the left and well death on the other side and everything in between.
    Second it’s going to depend on the extent of your medical treatment. If you got in an accident and saw your internist once and got a massage, your recovery will be very different than someone who underwent surgery.
    The third question you should ask is if you suffered any permanent damages. Will you walk with a limp the rest of your life, do you have a scar on your face from a dog bite that is never going away. Permanency is a big factor in your recovery.
    Another factor that you might not have considered is - how much insurance is there? Most people do not have a lot of insurance. If you’ve got a $100k case but there’s only $25k in insurance, your maximum recovery in most cases is going to be $25k. It’s not fair but that’s the way it is.
    The last factor, listen, there are many other factors, but I just want to point out that chances are, if you are represented by an attorney, you’re going to recover more than if you represent yourself. A large number of my past clients started out trying to represent themselves against Allstate or State Farm, got low balled and then realized they needed to hire an attorney.

    I’m at the stage right now settling. They have just without question paid all my medical bills and paid for the $2000 surgery my dog had to have without asking me to pay anything. Now I’m to the pain and suffering stage. This video is very helpful of mine was a Dog Bite and I had broken bones on my right hand. I also permanent loss of movement in my pinky. I have no idea and was using that one to five times formula until I saw this video. I’m trying to settle this on my own

      Hi, if you've got a permanent injury, I would strongly recommend you hire an attorney to represent you. I know - I'm biased. But seriously, that could be a serious life-long injury and you should be compensated appropriately for it....

    Can you clarify the medical bills portion of economic damages and what specifically should be included. What info on a spreadsheet is needed, should EOBs or just bills included ect. I’d also love your thoughts on policy limits and how that should be approached when there is a state minimium in play. Should a person or lawyer automatically request the limit, more than the limit if their personal insurance may provide coverage or what. Love your feedback on a starting point for meaningful dialog with the at fault insurance co.

      Hi, you need itemized bills to submit to an insurance company generally speaking. As far as policy limits, it depends. Gut call whether you demand the policy limits or not. If the injuries are worth the policy limits or more, than of course demand them.

    Drunk driver rear ended me and my girl with my two month old baby in the car. We were both driving separate cars and both vehicles were totaled.
    My girl and I have been going to physical therapy, chiropractor due to back pains, bad headaches and not being able to work or anything.
    Our baby has had her bump on her head for over a month now and I’m worried.
    Doctors say she’ll be okay but she was two months when the accident happened.

    For me, I was hit by a semi truck. Driver admitted ALL fault and received 3 citations from the police. As a result, I had surgery that ended with 2 mobi c implants C6 and C7. I still have numbness in my left hand 2 fingers, achey neck and headaches. All which are contents. Some days worse than others. My case hasn’t settled or gone to trial but I have wondered if this would and monetary value.

    wanted to ask, I was involved in a hit and run last week, car was totaled. Did have a strained neck and lower back. Spoken to legal assistant to a lawyer today. I live in Indiana. But it was explained to me, that the insurance of the guy that hit me will have to pay for what my car was worth, along with my medical bills and my rental car. So, this is what it looks like. I still own 5000. on my car, it's worth 8000. Medical, lets say runs 5000. and the rental is 600. Insurance will cover, medical and rental. It will also pay off my loan, leaving me with 3000. I stated, I had a car, and I won't be able to replace my car for 3000. I had asked, I need more money to be able to buy a car in the same condition and mileage to the one I losted. So, I guess even though I lost my car, I was told I can't get more money. On top of all this, I will owe the lawyer, 33 percent. Do I have to sue, in order to get what I think I need to get back my life, I just lost. Any guidance will be appreciated. Thanks

      Good morning, I don't know IN law to be honest. But generally speaking re: the car, they are only required to pay you the actual cash value of the vehicle not what you owe or what you think it's worth etc. It's a lousy situation but it happens all the time. I always recommend people use a lawyer if they can. Yes you have to pay them a third but there is so much aggravation associated with bringing a claim and dealing with an insurance company, just let the lawyer deal with it. You'll be happy you did. But that's just a personal opinion. Do what you think is best. Best of luck to you.

    I was involved in a not at fault reasons accident I hired an Attorney we parted ways for just cause after the 1st deposition .just attended a deposition with a doctor chosen by the insurance company the policy limit is a million .I have injuries that I'm still receiving treatment still had a neck surgery MRI's a tare in left shoulder just received another MRI on my right foot .have nerve damage in my back that's affecting my left hip and radiating down my left leg.I didn't have these injuries before the accident I've been off work two years and counting I've applied for temporary disability my medical bills are about 150.000 and still going up due to medical treatments what should I be doing have been trying to find anther attorney that's a trial lawyer and not scared to go to trial .any help in this matter would be greatly appreciated

      Ray E it feel like A Cesar or some type of sharp pain that’s going straight up the back of my neck to up to my head,No on the prime is it on the lease operator by 18 wheeler and Vanesse hit me I don’t like it they got a lot of money ,So I end up paying for a special Insurance to my lease agreement with this company I’m with and they wanted me to and I’ll go to therapy and so I was thinking since they’re gonna be paying for my time off and should I assume the other insurance company also

    Just curious, do you have a "serious injury threshold" like New York law does? Under New York Insurance law, the plaintiff has to show a serious injury like a fracture or permanent loss of a body part or function. There is a catchall for soft tissue injuries (an inability to perform most or all of your daily activities for 90 out of the first 180 days of the accident).

    The person who injured me had mediocre insurance so I will have to file an underinsured claim with my insurance company. Are there any pitfalls in filing with their company that would prevent me filing afterward with mine?

      Once the defendant offers you the full amount of the policy you may be required to get the consent of your insurance company before you accept it

    Man I've been looking for a channel like this don't know if it's going to help don't know if it's going to go anywhere but I guess I will start. So some months back I was returning a washer and dryer set to a company called Rent-A-Center I asked them to come pick up their appliances from my house because I have purchased a new set for a cheaper price. Once they arrived at my location I noticed it was only one worker a middle-aged woman who I knew would not be capable of removing the washer and dryers. I allowed to enter my residence as she came into the residence I went out and said in my vehicle because I was interested to see how she moved this washer and dryer by itself I begin to notice her stumbling backwards in my living room while I'm sitting outside in the car as I go into the house the worker from Rent-A-Center has fell trying to move the washer and dryer. I then asked her do you need any help she replied yes I then explain to her I will help you get these out of my house so that you don't hurt yourself but I don't want to be responsible for the washer or dryer should something happen to him. She assured me that she would take full responsibility for whatever happens during the process of me helping her do her job. During the process of helping her remove the washer and dryer out of my house I suffered a back injury which I have been back and forth to the doctor emergency room since I am unable to sit for a long time and when I do and try to stand my back stays in a bent position till I'm able to straighten it out the insurance adjuster just wants to pay hospital bill and $1,000 for payment suffering I was diagnosed by the emergency room as having a strain lower lumbar. That I find to be very amusing because although I have strained muscles before I have never felt pain like this and it's ongoing pain to the point where my legs get numb now if I sit too long so I know there's certainly something else going on. I have reached out to lawyers no one wants to take the case I then decided to start doing research on how is it that I can negotiate a deal with the insurance adjuster who is clearly trying to lowball me so here I am in this all alone trying to see what it is that I can do I'm just looking for someone with the know-how or the knowledge doesn't even have to be a lawyer just someone with the knowledge on what it is that I should be doing what paperwork I should be filling out and how to get the maximum return.

      Hi, sorry you've gone through all this. I would research how to file a lawsuit at your local county courthouse website. It is a lousy option to have to do it yourself, but if you can't find a lawyer to represent you it may be your only choice. So that's where I would start. . . Sorry I don't have better news for you on this one.

      @@LawFull LOL it's okay coming from my background and the things I had to deal with in life the judicial system and laws are never on my side so I'm used to hearing and this is nothing against you but I've been hearing this from every attorney I talk to sorry I can't do nothing for you. But I appreciate your channel as I learned a lot from it and I appreciate you even responding to my message I have started a demand letter I've sent it over to the adjuster I am still getting all my paperwork together as far as hospital bills and things of that nature the adjuster is completely trying to lowball me I guess I'll just have to stay with it and be persistent as I am throughout my life and hopefully something good come out of it thank you.

      Morning. If all these injuries are truly because of the accident, I would say a good amount. But I would strongly recommend you talk to your attorney about case value.     There is scam , my mother had a minor crash with a lady only bumper to bumper , no ambulance , no emergency was involve one year later she sue for an exagerated amount , this is an scam , this is sad how come the lawyer help to do this kind of matters, what happened when this people are prove for false injuries they claim, what happen if all the records they have are not true.

      Hi, sorry to hear you're having to go through this. This is common however. After paying the meds and attorneys' fees often victims receive little in the end. Whehter you can fire an attorney is tricky - I don't know the rules in Texas but for some reason I recall that they are very specific about how and when you can fire an attorney. YOu need to consult with someone in Texas for more specific info. Sorry but its very state specific. Wish I could be more help on this one. Best of luck to you.

    I’ve got two MRIs 2 x-rays I went to physical therapy for a long time I went to the chiropractor 42 times and still my back is the same feel like it’s getting worse but I’m still not sure how much am I supposed to get for all of that and pain in suffering and lost wages

    About 3 months ago I was hit by a truck and fractured my skull, and have a giant scar on my face, broke my thumb, and snapped my tibia in three places and now have a rod in my leg and will most likely limp for the rest of my life. How long do you think my case will take and how much do you think it might be worth? ( I also have no insurance so the lawyer is going for his)

      Hey Wallace - no fault changes everything. It changes depending on the state you're in. But it modifies who pays the medical bills and there also is likely a threshold you have to meet to be able to go after the third party for damages. I am in IL and we are not a no fault state. So I cannot comment anything more substantively on it. But if you suffered injuries and you want a referral to a pi lawyer near you, chances are I probably know someone I can refer you to. Sorry I cannot be more help on this one.

    hey Me and my two daughters were T-boned out of nowhere it was absolutely not our fault My new paid for sUV was totaled & my nose broken completely and there is a huge lacerations/ scar on my eyebrow not to mention other injuries like back/neck those are just the ones on my face I live in Tennessee & Im new to all this!     Hi. I was in a moped accident and the guy failed to yield. This was in August of last year I have a cracked bone in hand fractured elbow and possibly Permanente nerve damage. My elbow is still numb. What do you think my estimate amount is? I obviously didn't settle. I go to the verve doctor tomorrow

      Morning. Really impossible for me to know based on that. I would think quite a bit but specifics I couldn't know. I would consult with a local attorney on this matter. Case value is very much a local thing. It's based on similar cases in your jurisdiction along with of course, amount of medical bills, severity of injuries, permanency etc etc. If you want a referral to a local attorney, I might be able to help with that though.       Hi, I'm sorry I'm not sure I entirely understand - are you asking how much you should demand in a proposal? That's a tough thing for me to know. Depends on a very wide variety of factors. But that's a serious injury and if you can absolutely connect it to the accident, it should be fairly sizable.
