    The problem is not the wetland. It is all the government control restricting building, roads, ponds, etc.

      You are speaking about protected wetlands and wetland mitigation banks. We are simply talking about the presence of a wetland on a property in general.
      Of course, you can't build residential homes in Nature Preserves, Protected Federal Wetland areas or mitigation banks anyway...so it really is a moot point.

    I bought land in southwest Florida and didn't know it was possible wetlands and a civil engineer told me to sell it because it can get expensive to get the funding and per.its to even legally touch the land
    This has messed up my house building dreams

      I’m looking at buying a property next to wetlands. Their has been a few people bail on sale and I’m trying to find out why. They all had plans to build according to the seller.

      @@bmanscire i have plans to build also but the wetlands issue is really a big issue, as i was told even if I get permission on my land I can only usecabout 60 percent because wetlands need a buffer which takes away from the house

      Hopefully, the video provided some food for thought as this is a complex subject. Folks hear "wetland" or "floodplain" and don't understand how these were ascertained to fully understand the impact or lack thereof to their land-buying goals. Check out the "Wetland Mapper" online. The U.S. Army Corp of Engineers does a lot of limnology work as well worth looking at. Good luck!

    I have a lot that is 10% grade slope with water seepage some 4 feet under ground from the road can one build on this using a curtain or footing drain to divert the water around the house.

      As usual, I have to respond generally because of the local regulations and zoning laws that may be at play. Generally speaking, if the lot is buildable by the described setbacks, side boundaries, etc... from the county and an approved dwelling type....you may be able to build so long as you follow any special requirements. Typically, they will require the building to be so many feet above mean floodplain. If you have no special conditions resulting from the proximity of any local floodplain or protected wetlands, it's as simple as meeting the other building criteria, dwelling type, etc.... Best place to start is phone call to the building/zoning department to verify lot is buildable/permittable and if it is close to floodplain/wetland delineation and then they should transfer you to the flood management water division to have a detailed conversation as to building requirements if this is a condition of the lot.
      Once all of the above is verified so you know you won't have issues with county...then you can put your engineering hat on and think about bringing in fill aggregate and running french drains, etc.... to manage groundwater on site.
      Be sure to speak to the county before starting any excavation/installation of drains as they will typically have inspections and permitting required to ensure it meets the overall flood/water management for the area.

      Mean flood plain is how the county determines the elevation certificate requirement (how high your home must be built above ground/stilts). No, the French drains would merely be one component of a comprehensive on site water management plan to elevate the ground while displacing water to acceptable paths away from the dwelling and the lot in general (this is why the Flood Management division would be involved in your build/excavation etc..... when lot is within delineated flood plain. Fill aggregate is just rock you can pick up from your local quarry but you could also use old broken concrete if you can find it, anything that would build up a base but allow the water to drain out into lower sedimentary layers within whatever system you have created to manage water on site. This is a bit of an engineering feat but not impossible for resourceful, DIY folks. :)

    Hi, I have 0.5 acre of land considered wetland in Toms River NJ.
    What can I do with this land? Its valued at 250k but not sure what to do with this land if I cant develop it? Its zoned commercial

      Hi Ellie, NJ has some of the strictest real estate laws and regulation. The value is driven by attributes and legally allowable usage/access etc.... you will first need to establish if it is buildable, if so, what are the hoops you will need to jump through to set the proper documentation in place to do so. Then, you can handle the wetland mitigation bank/construction challenges involved with saturated soils with a high water table. I would call the county seat and pose your question to what is allowed on the property, what is needed and drill down from that call with the appropriate departments. You may find it is not buildable or usable land. However, the adjacent property owners might be interested in it as at a reduced cost to expand their current holding and prevent future crowding of their lot. This is the best I can do as you are going to encounter alot of specific nuance. However, start with the county seat and they can get you the proper contacts to have the conversations to determine exactly what you have and what can be done to maximize it's value. Once you know where you stand, you can then find the right property for possible sale. Worst case scenario, it's useless, stop paying the property taxes and let it go to tax sale. Hope that gets you started at least.

      Are you talking about a lot with partial wetland area within the parcel or a protected wetland/conservation area? Those are two different scenarios. It would be virtually impossible to drag a structure on wheels through wetland/deep mud.

      If it is a Federally protected wetland, no, nothing and nobody can own it to build (sometimes there are public watersheds where they allow general public to buy land near lakes/rivers that are part of managed watershed and build homes, but they own the land and have the right to use your lot in any manner to manage overall water/flood management in a crisis). If you were to come across land near federal or state land that is a normal residential lot with minor wetlands on it....you could definitely find the highest/dryest point on the lot to drop the tiny home (as long as it meets county frontage, setbacks, residential build regulations, etc...). The beauty of a Tiny home is that you would require less build site space in proportion to the lot. The key would be to identify exactly where you have low areas that pool basin water and or are wetland year round. Dig that out as a drainage pond and have all other areas of the lot displace water to the naturally occurring basin. I would also build up the dry/build site areas even higher so that I minimize ground water and the possibility of a heavy rain, flooding damaging my entire property and structures. Note: Be sure that "Tiny Homes" with wheels are allowed within the Residential zoning, as many counties will allow a site built home less than 1000sf but it CANNOT be on wheels (they often describe this as a mobile home/trailer and if not allowed, would not meet the properties' residential zoning designation for that county/area. Hope this helps!

    Absolutely DO NOT buy near wetlands. ANY work you want to do in the future, including fences, tree cutting (even dead trees) or any expansion of the house- you will have to ask the conservation committee who will most likely say “no”! It’s like buying land that you cannot control AT ALL.

      You are incorrect. It sounds like you have a personal situation where you purchased land near protected wetlands. This is much different than purchasing land that merely has some delineated wetlands on portions of it (This was addressed in the video). We buy and sell land with wetlands on them and people build on them without issue.
      You do NOT have to ask any committee about fences, tree cutting or home expansion as this will go through normal permitting through the county. If you are in a flood zone, you will be required to obtain an elevation certificate so that your build plans are slightly elevated above the county determined flood level. An additional cost of $300-500. A minor financial inconvenience compared to the financial setback of the dwelling itself....

      @@joshmiller4152 is this in FL?? Because in MA that is how it works. I cannot do ANYTHiNG within 100ft of wetlands and here all wetland IS protected.
      From people being yelled at for fixing a fence without asking permission from the conservation committee telling them to tear the fixed fence off because they didn’t ask for permission prior its a fckng nightmare. I cannot even cut dead trees. I literally got asked “why would i want to make a patio” in my last call with the committee.

      There are other factors at play that are the exception, not the rule. It sounds like you purchased land on or near prior protected wetlands which would have been determined prior to close with standard due diligence. If you want to liquidate the property, I might suggest contacting them to ask for a purchase price to move on from it. If it such a precious portion of the wetland ecosystem, they should jump at the chance to add to their current land holdings in the Protected Wetland area. Hope that helps. I just don't have all the details to give you more pointed direction.

    Of all the water problems Florida has, there's still people that wanna drain, manipulate, changed the hydrograph of what's left of Florida's wetlands, Really? Then, don't cry or wonder why you flood, your water is filled with Red Tide, you have fish kills, your storm intensity has heightened, and so on. The same can be said for most of the midwest, where we've drained 90% of the wetlands, paved them, farmed them, filled-them.

      Agreed- it is always optimal to develop land in a manner that does not dislocate local flora & fauna including wetlands that filter water sources. However, you are commenting on a land channel where most folks want to build a home. There are wetland mitigation banks that require replacement of damaged wetlands by home builders to neutralize the affects to the overall wetland system in any given area.

    I bought a 7 acre parcel of wetland. 100% wetland, for $ 11,000. I'm actually buying it on owner finance, i went this route because this was all i could afford, and i figured, where there is a will, there is a way.
    I bought this land to build on.
    it has road access. It is flat.
    There are basically no trees, other than some 3-5 year old evergreen trees and one teenage leaf tree.
    I've walked the land, it's swamp, you don't sink, i planted a tree, there is water when you dig one shovel deep. Sometimes the road floods I'm told. It's next to a lake.
    I want to build, but I'm so horrible with Paperwork
    I don't even want to waste my time with "deliniation" i know this is ALL wetland.
    How can i come up with a plan to put on paper for their bs permits?
    I want to just build and say fuck all the paperwork. Metal pipe helical pile to start.
    I don't have money to waste, i would like your opinion, i live in Alaska, i have no idea how much "permits" cost, and in the end, will the answer just be no, if it's 100% wetland? I can't recreate/ replace wetland if my land is already 100% wetland.
    I see prior to obtaining a permit, you have to have a septic plan?
    I was thinking a holding tank, but would they even approve a traditional septic? That would mean i have to add fill to be above the water table, which means more permits, paper work, people in my hair, $, all together bs.
    I know how i would do this ideally, if i could do what i wanted on my land without any other outside governing agencies.
    I have solar/ battery banks for power
    Holding tank for septic
    Hand drive a well, since the ground is soft enough
    Helical pile foundation
    And i would fill a driveway with dirt.
    What CAN i do without a permit?
    And if i DO build without a permit, what's the worst outcome?
    I've heard from others in similar situations. They would rather take a $10,000 fine and just do what they want, rather than a $50,000 permit..
    I have no where near either of those kinds of money.
    It's a very long process, and confusing, i would rather just do what i wish until someone shows up to stop me, and take it from there.. because everything just seems like bs to me. I'm not harming the land, i want to farm it and live in my slice of land, in a house i built / secluded/ Self sustained and not be told what i can and can't do.. does anyone else feel this way?

      Unfortunately, there is no way to avoid governance over land as they have plat maps and delineated zoning, etc... to oversee land purchases and use.
      However, some plots are far more off the beaten path than others and the county typically does not have a team of folks roaming the county seeking out violations. One might be able to get away with whatever they like but if someone at the county were to hear about it, then it might become a problem. The county also wants to know where homes are located for emergency services access. If you needed to be life-flighted out, they would need access to come get you. They need to know you reside there first. However, I understand not wanting to have an identity footprint.
      As for the permitting, that is very specific to your county and local legislature, so unfortunately, I have to refer you to them as it can get detailed as the answers to all of your questions are nuanced.
      As for building/engineering regardless of county oversight/administration, I would first build a base if you know it's wetland. Get the largest aggregate/timbers (will rot so be careful) to create a base at the highest elevation on your lot. You may want to consider an elevated structure. You also may want to find out prior history on flooding as your homestead might be washed away every 3 years and that is no good. You would be rebuilding the home, secondary structures, resupplying after major floods/spring run off.
      I would be more inclined to see what nature can and will throw at me first as the area might be difficult to keep a homestead on without any governmental interference.
      Sorry I can't be much more help but your specific questions really are in the documents held at your county and the zoning/land use/permitting regulations.

      You probably can't put anything on it but mobile things. Shed with wheels or mobile home probably can't dig any septic.
