Point 7 is really, really important, in this state. Colorado has no water that flows into it from any other state. All the water in Colorado starts here, as rain or snow. Moreover, water rights get sold based on the maximum amount of water that has ever been available on, or beneath, that property. Additionally, water rights that are senior in time *must* be fulfilled, first, before "younger" water rights can be exercised. So, if someone "downstream" from your property has senior rights to water that flows through your property to his or hers, then *you may not use* the water until that downstream person gets all the water to which he or she is entitled, even though a stream flows through your property, first. Moreover, if it's a dry year and not enough would be left over after the senior right is fulfilled, then the junior right may not be exercised, at all. In other words, just because the property has a stream that flows through it doesn't mean you necessarily have the right to use that water. You have to ask about the seniority of the water rights that come with the purchase. Senior water rights are a big deal, in rural Colorado. In a lot of ways, they are *the* big deal. Another quirk to this system is that, because all the water is claimed by someone, a property owner may not restrict access to the use of that water. That means a landowner's property rights go across a river or stream along the *bed* of the stream -- and not the *surface* of the stream. As such, a landowner may *not* prevent watercraft from using a stream that flows through his or her property. As long as the boater adheres to local restrictions (for instance, no motorized watercraft on streams and waterways designated for non-motorized craft, only...), then he or she gets to freely travel up or down a stream that crosses private property. Except for the boating bit, the same rules apply to underground aquifers. The water cannot be taken out of the aquifer via a well unless the property has enough senior rights to permit the withdrawal.
@@CompassLandUSA You're welcome, FWIW, and I hope it doesn't make your job harder. I spent most of the 1990s as an investigative reporter who covered the Legislature and Colorado economics, so I learned more than I ever wanted to know about Colorado water law. I also remember the con jobs in the late 1990s, when developers in the exurbs outside Denver (and other communities) would sell housing lots for which they had no water to provide. These rural lots don't have that issue, really, because the water status must be disclosed up front, by law, these days, due to those same scandals. However, for people out of state who might be considering such purchases, it's really, *really* important to understand why water law in the Rocky Mountain West, in general, and Colorado, in particular, differs so profoundly from what they may experience in other parts of the country. Those interested in rural property purchases, in Colorado, must *always* ask about the water.

@@GHE2005 The rights remain senior. The water is not tied to land ownership. That's the central thing to understand that makes it weird. The owner of the water rights may be different from the owner of the land. For instance, a lot of the Front Range cities have purchased senior water rights to the streams that flows through those built-up areas, from farmers who live downstream whose families have been there for generations. The farmers still own the land, but they can't irrigate it, any longer, because the city bought the water rights from them and divert it into water treatment plants for urban uses. So, a lot of farmers who want to retire -- and whose children have no interest in farming, themselves -- sell off the senior rights used for irrigation to the cities for a nice amount. The former farmers, themselves, probably have connections to county services for their own houses, plus a septic tank or pit system for sanitation. So, they have a bunch of land where the fields revert to semi-arid prairie or foothills, but the area around the farmhouse is still nice because the county provides water services, and the family has six (or even seven) figures in an interest-bearing investment account. Then, they subdivide the land and sell it as "hunting property" or whatever. It's hard to sell property as residential, these days (or even horse property), because it has no water other than the rain and snow. Make sure you have your realtor check on the status of the water rights, though. It's an important service an experienced rural real estate professional can provide, here.

You also want to verify with county if the land will require an engineered septic vs conventional because the cost difference is extreme. Many Colorado counties require engineered systems.

Also check what's required like a septic if your planning on being there any length of time. Also check on permits before you do anything. Some counties charge double if you build a building before getting permits.

Hi Jake! We don't typically invest in commercial properties. For residential/recreational lots, we've found property taxes to be pretty cheap in rural parts of CO, NM, and AZ. Hope that helps! :blush:
I am surprised you did not mention conservation easements . I have seen land that is seeking for top market price but most of the property is under conservation easement with small building sight allotment(s) . Land like this should be selling at a reduced price , but there are owners selling for top market price for the property .

Some counties actually have a booklet put out by planning and zoning outlining all the restrictions and codes. You can get it from the realtors in the area that are listing the land. Best to go look at land yourself because sometimes pictures don't always accurately depict it.

so I purchase land with my hard earned already taxed money and I have restrictions on how to use MY property, have to pay more taxes on it aaanndd fees for associations who tell me what I can and cant do on my own piece of earth. A few years we looked at land in SE Colorado and when we would find what we wanted, the restrictions were either way too harsh for what we were wanting or the property was totally surrounded by either public or other private land and would have been a fortune to try to gain vehicle access too. And every point you bring up. I'd feel a whole lot better buying from you! Since you seem legit. So the question is can I get a "owner financing buy" with you guys? Or us bank loan? Sweden won't give bank loans for land in another country.. and cashing $20-100000 seems kinda extreme. Best regards

This would be why you use a title company that carries insurance for such issues , they guarantee clean title via records search, if they jack it up, that's on them and they foot the bill.

Her step #3 will be one that you will want to greatly research then. If you plan on building anything on your land, some county laws will require a well and septic tank system. Many counties in CO make it very expensive to build on. And never buy rual land that is not directly connected to a county maintained road.

I don't think you understand contract Law very well. Nobody is obligating to contract, just because you are threatened or have a gun held to your head. Nothing (no corporate has any standing when it comes to the Obligation of a Private Contract between 2 private parties.) can infringe upon the Obligation of a Contract. #1. Yes, it is important to find the so-called landowner to determine if they have the right to Sell the land to you, but this is what people do not understand, A U.S. Citizen CAN NOT contract under the Maritime Legal system. The U.S. citizen is owned, therefore can only accept Benefits and privileges for the use of said property, be it land, Motor vehicle etc.... also no land can be bought or sold, land can only be transferred between the Patent Holder and the New to be patent holder. So-called Legal title is the CONTRACT between two private parities. #2. Back Taxes, if the Buyer is not listed as the debtor for any So-called corporate debt owned, then the buyer is not responsible for the Obligation to pay any debts NOT in his or her name. #3. Land uses, again there is NO obligation to contract with every tom, dick and harry corporation, aka The STATE is a Private for profit corporation, The CITY is a Private for profit corporation, H.O.A - P.O.A .... and so on. When somebody lays CLAIM to a Property, it needs to be done correctly, meaning the buyer can not use Commercial instruments to make the purchase, the buy to remain Private should only use Lawful money or lawful exchange. The Dollar aka Debt currency is nothing more than DEBT, you can never pay off a debt with another debt, because you will always have the original Debt. Instead to remain Private, the buyer must use Gold or silver to purchase Property, under correct contract terminology. Registration means in Legal/Maritime terminology means : To sell an Assest. This means when someone Registers anything with a Private for profit Corporation aka The STATE or CITY or any other Private corporation, you are Selling an asset to said corporation, that someone has just made an Offer to sell and transfer liability to a private For profit corporation. A buyer has NO rights to anything that is not in buyers Correct name as a Claim of absolute ownership. Make an offer to buy or sell, that offer is then accepted and all liability is then transferred over to new owner. Register a child for Corporate public school, the parent just made an offer to sell said child to a corporation, in turn making the child an asset for the Private corporation. register a car, register a Partnership aka marriage any that is registered IS selling and handing over/transferring Liability in said asset. A perfect example of this would be Someone's Vehicle registration , it CLEARLY states on car registration - This registration is a Transfer of Liability, anyone can verify this for them selves just look at your car registration documents, YOU NO LONGER OWN what you register, because you Sold said asset to a Private corporation, now that corporation can tell you what to do because you would not be the Legal or lawful owner of said asset. #4. Legal access to property, If done correctly with correct Claim to said property/land, There must be an easement that grants access to Land, for the purpose of Emergency situations and general access to said property. If there is no Lawful access that means you would be trespassing on Foreign Vessels, to which it is a tort against another. Enough of an access for a Large truck to come and go is enough space. So-called Land locked property is corporate fiction and is Unconstitutional and Unlawful. #5. Utilities, there is wind, solar, generator, geothermal etc... plenty of ways to produce enough power to meet one's needs, again no need to register with every tom, dick and harry corporation to live FREELY. skip #6.H.O.A etc. #7. Water and mineral rights. NOBODY owns the water that falls from the skies or rest within the ground, so therefore when done correctly, The Claim of said property INCLUDES all rights to said water and minerals that are situated on said parcel of land, When done correctly in a Private manner, The Claim of Property is for all that comes with the Claim/land/property, lawful you can not make a partial claim, a claim is for ALL or Nothing, but within the Legal maritime CORPROATE FICITON, the rules and regulations are set up in favor of the OWNER/CLAIMANT. If their is a desert river wash, an seasonal or permanent body of water aka river or stream that runs through your Claim, YOU OWN the lawful access and usage of said water. Finally it does not matter if you say you have a business that deals with buying Land or property, if you are Ignorant to the Rules and regulations of Maritime Jurisdictions aka The Commercial application of Contract not the Private Obligation of Contract, these 2 things (Public and Private) are completely different. The saying ; being Ignorant to the law is no excuse to not know the Law. This simply means, if someone fails to READ the terms and conditions it is nobodies fault but the Someone signing the contract, You agreed to said contract terms and know you are Bound to those terms and conditions, whether you agree or not agree. When reading a contract, the purchaser can Delete the things from said contract that you do not agree with, Every contract is negotiable. When a contract is done correctly in a Private manner , The Private holds superior standing, because the other party has to then Correct anything that they do not agree with, failure to correct, means they agree to said terms and conditions of the contract signed. So in closing the information in this video, is strongly limited, due to one simply FACT, Every soul here on earth is the Beneficiary of it's experience, and is NOT obligated to comply with another's word, without a Consensual CONTRACT between 2 PRIVATE entities. Listen closely people, MARITIME is Corporate Fiction, Fiction does not exist unless YOU agree that it does exist. Point 7 is really, really important, in this state.
Colorado has no water that flows into it from any other state.
All the water in Colorado starts here, as rain or snow.
Moreover, water rights get sold based on the maximum amount of water that has ever been available on, or beneath, that property.
Additionally, water rights that are senior in time *must* be fulfilled, first, before "younger" water rights can be exercised.
So, if someone "downstream" from your property has senior rights to water that flows through your property to his or hers, then *you may not use* the water until that downstream person gets all the water to which he or she is entitled, even though a stream flows through your property, first.
Moreover, if it's a dry year and not enough would be left over after the senior right is fulfilled, then the junior right may not be exercised, at all.
In other words, just because the property has a stream that flows through it doesn't mean you necessarily have the right to use that water.
You have to ask about the seniority of the water rights that come with the purchase.
Senior water rights are a big deal, in rural Colorado. In a lot of ways, they are *the* big deal.
Another quirk to this system is that, because all the water is claimed by someone, a property owner may not restrict access to the use of that water.
That means a landowner's property rights go across a river or stream along the *bed* of the stream -- and not the *surface* of the stream.
As such, a landowner may *not* prevent watercraft from using a stream that flows through his or her property.
As long as the boater adheres to local restrictions (for instance, no motorized watercraft on streams and waterways designated for non-motorized craft, only...), then he or she gets to freely travel up or down a stream that crosses private property.
Except for the boating bit, the same rules apply to underground aquifers.
The water cannot be taken out of the aquifer via a well unless the property has enough senior rights to permit the withdrawal.

I spent most of the 1990s as an investigative reporter who covered the Legislature and Colorado economics, so I learned more than I ever wanted to know about Colorado water law.
I also remember the con jobs in the late 1990s, when developers in the exurbs outside Denver (and other communities) would sell housing lots for which they had no water to provide.
These rural lots don't have that issue, really, because the water status must be disclosed up front, by law, these days, due to those same scandals.
However, for people out of state who might be considering such purchases, it's really, *really* important to understand why water law in the Rocky Mountain West, in general, and Colorado, in particular, differs so profoundly from what they may experience in other parts of the country.
Those interested in rural property purchases, in Colorado, must *always* ask about the water.
That is some law about water, a new one for me. Thank u 4 that info.
If I bought that land from the senior person, does that water right still apply or will I become a junior at time of sale?
@@GHE2005 The rights remain senior. The water is not tied to land ownership.
That's the central thing to understand that makes it weird. The owner of the water rights may be different from the owner of the land.
For instance, a lot of the Front Range cities have purchased senior water rights to the streams that flows through those built-up areas, from farmers who live downstream whose families have been there for generations.
The farmers still own the land, but they can't irrigate it, any longer, because the city bought the water rights from them and divert it into water treatment plants for urban uses.
So, a lot of farmers who want to retire -- and whose children have no interest in farming, themselves -- sell off the senior rights used for irrigation to the cities for a nice amount.
The former farmers, themselves, probably have connections to county services for their own houses, plus a septic tank or pit system for sanitation.
So, they have a bunch of land where the fields revert to semi-arid prairie or foothills, but the area around the farmhouse is still nice because the county provides water services, and the family has six (or even seven) figures in an interest-bearing investment account.
Then, they subdivide the land and sell it as "hunting property" or whatever. It's hard to sell property as residential, these days (or even horse property), because it has no water other than the rain and snow.
Make sure you have your realtor check on the status of the water rights, though. It's an important service an experienced rural real estate professional can provide, here.

Also check what's required like a septic if your planning on being there any length of time. Also check on permits before you do anything. Some counties charge double if you build a building before getting permits.

Do you have any counties you recommend where you can buy residential and commercial without insane property taxes?
Hi Jake! We don't typically invest in commercial properties. For residential/recreational lots, we've found property taxes to be pretty cheap in rural parts of CO, NM, and AZ. Hope that helps! :blush:
I am surprised you did not mention conservation easements . I have seen land that is seeking for top market price but most of the property is under conservation easement with small building sight allotment(s) . Land like this should be selling at a reduced price , but there are owners selling for top market price for the property .

Some counties actually have a booklet put out by planning and zoning outlining all the restrictions and codes. You can get it from the realtors in the area that are listing the land. Best to go look at land yourself because sometimes pictures don't always accurately depict it.

so I purchase land with my hard earned already taxed money and I have restrictions on how to use MY property, have to pay more taxes on it aaanndd fees for associations who tell me what I can and cant do on my own piece of earth. Its crazy how we have to pay to live in a planet that we were all born in and is free. Money sure is the root of evil

A few years we looked at land in SE Colorado and when we would find what we wanted, the restrictions were either way too harsh for what we were wanting or the property was totally surrounded by either public or other private land and would have been a fortune to try to gain vehicle access too.
Now we are starting our search once again and hopeful something will eventually reveal itself. 🤞
Maybe try around nearby towns. Usually the land for sale is along well maintained dirt roads.
How do I get the APN or parcel # is that usually listed on Zillow?

Hello. Me and my wifes dream is to buy land in Colorado- montana and build a log house for vacation. We are from Sweden and are both middle class. My concern is scam people/companies. And every point you bring up. I'd feel a whole lot better buying from you! Since you seem legit. So the question is can I get a "owner financing buy" with you guys? Or us bank loan? Sweden won't give bank loans for land in another country.. and cashing $20-100000 seems kinda extreme. Best regards

This would be why you use a title company that carries insurance for such issues , they guarantee clean title via records search, if they jack it up, that's on them and they foot the bill.

Her step #3 will be one that you will want to greatly research then. If you plan on building anything on your land, some county laws will require a well and septic tank system. Many counties in CO make it very expensive to build on. And never buy rual land that is not directly connected to a county maintained road.

Yeah Colorado has squatters rights also..its impossible to get someone out of your house or off the property! I hate this about Colorado.

Residential Rainwater Collection: Since 2016, Colorado residents have been allowed to collect rainwater from their roofs. The law permits homeowners to use up to two rain barrels with a combined capacity of 110 gallons, specifically for outdoor purposes like gardening.
Larger Systems: More extensive systems for rainwater collection are allowed, but they typically require special permits, especially for agricultural or commercial uses.
So, while it was once largely illegal, it is now permitted under specific conditions. The blanket statement that it's illegal to catch rainwater in Colorado is no longer accurate.

I don't think you understand contract Law very well. Nobody is obligating to contract, just because you are threatened or have a gun held to your head. Nothing (no corporate has any standing when it comes to the Obligation of a Private Contract between 2 private parties.) can infringe upon the Obligation of a Contract. #1. Yes, it is important to find the so-called landowner to determine if they have the right to Sell the land to you, but this is what people do not understand, A U.S. Citizen CAN NOT contract under the Maritime Legal system. The U.S. citizen is owned, therefore can only accept Benefits and privileges for the use of said property, be it land, Motor vehicle etc.... also no land can be bought or sold, land can only be transferred between the Patent Holder and the New to be patent holder. So-called Legal title is the CONTRACT between two private parities. #2. Back Taxes, if the Buyer is not listed as the debtor for any So-called corporate debt owned, then the buyer is not responsible for the Obligation to pay any debts NOT in his or her name. #3. Land uses, again there is NO obligation to contract with every tom, dick and harry corporation, aka The STATE is a Private for profit corporation, The CITY is a Private for profit corporation, H.O.A - P.O.A .... and so on. When somebody lays CLAIM to a Property, it needs to be done correctly, meaning the buyer can not use Commercial instruments to make the purchase, the buy to remain Private should only use Lawful money or lawful exchange. The Dollar aka Debt currency is nothing more than DEBT, you can never pay off a debt with another debt, because you will always have the original Debt. Instead to remain Private, the buyer must use Gold or silver to purchase Property, under correct contract terminology. Registration means in Legal/Maritime terminology means : To sell an Assest. This means when someone Registers anything with a Private for profit Corporation aka The STATE or CITY or any other Private corporation, you are Selling an asset to said corporation, that someone has just made an Offer to sell and transfer liability to a private For profit corporation. A buyer has NO rights to anything that is not in buyers Correct name as a Claim of absolute ownership. Make an offer to buy or sell, that offer is then accepted and all liability is then transferred over to new owner. Register a child for Corporate public school, the parent just made an offer to sell said child to a corporation, in turn making the child an asset for the Private corporation. register a car, register a Partnership aka marriage any that is registered IS selling and handing over/transferring Liability in said asset. A perfect example of this would be Someone's Vehicle registration , it CLEARLY states on car registration - This registration is a Transfer of Liability, anyone can verify this for them selves just look at your car registration documents, YOU NO LONGER OWN what you register, because you Sold said asset to a Private corporation, now that corporation can tell you what to do because you would not be the Legal or lawful owner of said asset. #4. Legal access to property, If done correctly with correct Claim to said property/land, There must be an easement that grants access to Land, for the purpose of Emergency situations and general access to said property. If there is no Lawful access that means you would be trespassing on Foreign Vessels, to which it is a tort against another. Enough of an access for a Large truck to come and go is enough space. So-called Land locked property is corporate fiction and is Unconstitutional and Unlawful. #5. Utilities, there is wind, solar, generator, geothermal etc... plenty of ways to produce enough power to meet one's needs, again no need to register with every tom, dick and harry corporation to live FREELY. skip #6.H.O.A etc. #7. Water and mineral rights. NOBODY owns the water that falls from the skies or rest within the ground, so therefore when done correctly, The Claim of said property INCLUDES all rights to said water and minerals that are situated on said parcel of land, When done correctly in a Private manner, The Claim of Property is for all that comes with the Claim/land/property, lawful you can not make a partial claim, a claim is for ALL or Nothing, but within the Legal maritime CORPROATE FICITON, the rules and regulations are set up in favor of the OWNER/CLAIMANT. If their is a desert river wash, an seasonal or permanent body of water aka river or stream that runs through your Claim, YOU OWN the lawful access and usage of said water. Finally it does not matter if you say you have a business that deals with buying Land or property, if you are Ignorant to the Rules and regulations of Maritime Jurisdictions aka The Commercial application of Contract not the Private Obligation of Contract, these 2 things (Public and Private) are completely different. The saying ; being Ignorant to the law is no excuse to not know the Law. This simply means, if someone fails to READ the terms and conditions it is nobodies fault but the Someone signing the contract, You agreed to said contract terms and know you are Bound to those terms and conditions, whether you agree or not agree. When reading a contract, the purchaser can Delete the things from said contract that you do not agree with, Every contract is negotiable. When a contract is done correctly in a Private manner , The Private holds superior standing, because the other party has to then Correct anything that they do not agree with, failure to correct, means they agree to said terms and conditions of the contract signed. So in closing the information in this video, is strongly limited, due to one simply FACT, Every soul here on earth is the Beneficiary of it's experience, and is NOT obligated to comply with another's word, without a Consensual CONTRACT between 2 PRIVATE entities. Listen closely people, MARITIME is Corporate Fiction, Fiction does not exist unless YOU agree that it does exist.
