Whitehouse details the findings of his latest law review article, entitled “Knights-Errant: The Roberts Court and Erroneous Fact-Finding.” Whitehouse’s article sheds light on the Court’s propensity for relying on extra-record - and often false - facts that lend advantage to Republican or corporate special interests. The article details bogus and uncorrected facts in Supreme Court decisions, explains their consequences in disrupting settled precedents, and explores actions the judicial and legislative branches could take to ensure the Court cleans up factual errors and kicks its fact-finding habit.

When I was in HS and college I was taught that the Supreme Court was impartial and not politically partisan. It seems the GOP has been destroying that concept for decades.

I don't think it ever was not politically partisan - political appointed justices are never really going to be - it's just not sensible. Or believable. But nowadays, the GOP contingent don't even try to appear non-partisan, they have so much brass neck, and such an overwhelming majority; so they now don't care; they think they are safe for the next 20 years at least.
Look at Roberts, throwing out voter rights legislation because it is no longer needed!! and deciding that the SCOTUS doesn't need any ethics rules, because they are all so f*cking ethical!!

How dare they reverse Roe v Wade; how dare they help trump giving him the ability to delay his criminal cases; how dare they consider over turning The DC Court of Appeals in their solid and outstanding decision that no president has complete immunity and is above the law all the while leaving a stay in place and keeping Judge Chutkan from moving that trial forward!!!
Furthermore, three Justices should recuse themselves from hearing ANY trump case because of the following:
1.). Thomas has been paid off, and his wife participated in the insurrection.
2.). Gorsuch wrote a paper ten years ago supporting and defending the 14th amendment section 3.
3.) Kavannaugh published a paper in the Georgetown Law Journal in July 1998 clearly stating that no president has complete immunity and they can be prosecuted for their crimes the day after they leave office.
Another corrupt Judge is federal judge Aileen Cannon. She was appointed by trump, and that was enough reason she should have recused herself. Now, she's had two reversal judgements by that Appellate Court in Florida, (I think it was the 11th circuit,) and she's doesn't know or understand protection for the jurors, witnessess, etc.
Cannon won't set a trial date even though Jack Smith and trump lawyers both offered up potential dates; Smith proposed July and trump lawyers proposed August 12th...and Cannon couldn't take one???
A speedy trial is guaranteed, but it's not just for the defendants; it's also for the victims and in this case We the American people are the victims...and we demand justice!
Please keep doing the work you do because dark money and criminals like trump and his maga lunatics in the House have destroyed our courts, our lawmakers, and next our country.
Be prepared for trouble when trump loses again in November. I am 64 years old, and I cried as I watched the insurrection unfold on J6. Please make sure we protect our Capitol and our lawmakers when trump loses. Holding the Senate will be dang hard. The numbers, map, and reality are not on the Dem's side in 2024. In 2026 and 2028 maybe, but probably not this year. We could get lucky, but probably not. As bad as Joe Manchin was as a corporate Dem, the fact he'll be replaced by the Republican West Virginia Governor is not good for our republic. Another wildcard. There are rumblings that Georgia Governor, Brian Kemp, the vote suppressor, will run for the Senate in 2029 when Warnock / Ossoff terms end. Given the racist and rural nature of the state's population he could take one of those seats. Even a lousy candidate like Herschel Walker almost became one of our Senators.

It requires a change to federal law to change the size of the SCOTUS, so it would need support from a majority in the House and a _supermajority_ in the Senate.

There is nothing Biden can do until the 2024 election returns a democratic majority or better, a supermajority. Then laws can be passed for a constitutional amendment to place real rules and penalties on Supreme Court justices, and pro-tem the immediate fix is to increase the size of the court and pack with a more balanced quorum.

Now we just need to get enough Democrats in the Congress & Senate so legislation that the court can’t overturn can be passed. I have so appreciated these speeches on the Senate floor by Senator White House. It's true sometimes they make me lose sleep. But clearly it seems this is not only an important one but maybe the most important one.
