  • In a matter of hours last September, three women - Anastasia Kuzyk, Nathalie Warmerdam and Carol Culleton - were killed near the small town of Wilno, Ontario. The man arrested and accused of their murders, Basil Borutski had a long criminal history, including charges involving two of the three women. How did the system that’s supposed to protect women go so disastrously wrong? Gillian Findlay investigates, with revealing interviews with family members, friends of victims and witnesses.

    When I was between 3 and 5 years old my mother was seeing a guy who beat her often. He once kidnapped her beat her to pulp. When we had to be around him we where always afraid. One evening he called our apartment and I can here my mom pleading to him not to come over. Seconds later she hussled my brother, sister along with two cousins who where visiting and ran around the corner to my aunts house. No sooner than we arrived he was knocking at the door demanding that my mother come outside, while wearing only a pair of shorts with a gun stuffed inside. My uncle demanded that he leave and said they called the police, so he left. The entire night we slepted under the beds. The following day, front page news, he had kidnapped his other girlfriend and had taken her to a parking lot where he shot her in the back paralizing from the waist down, then he turned the gun on himself by blowing his brains out. This will always be with me and my family, though I wish it wasn't. Men, and some women, that show violate tendencies should be taken seriously and avoided at all cost. My mother's experience happened in the 70's so it's shocking that not much has changed for the better.

    He refused to sign a Protection Order upon only serving 5 months of a possible 17 months???!! WHY WAS HE RELEASED? You forfeit your right to an early release!! You don't get to walk free after not agreeing to the clause that put you in jail. The law failed all these women.

      The judge did everything by the book and in as accordance with the true spirit of the law. Criminals have rights too, and we need to treat them well.

    UPDATE:
    Borutski was sentenced to life w/o parole for 70 years. May his 3 victims rest in peace, and may their families have peace now.

    Here in the US, domestic abuse wasn't even acknowledged until the latter part of the 70's. I should know, I watched my mom get abused day in and day out by my "sperm donor." Every single time that they were called, they did absolutely nothing towards him except to ask my mom what did she do to upset him. The last and final time that he extremely harmed my mom was on 7-4-77 when he had set her on fire in front of my sister and me and that's when WE ran to the chief of police, who lived down the block, and told him what had happened and that's when they went after him. Soon after, my mom left him for good. IF she stayed with him, he would've eventually killed her and that I'm sure of.
    RIP To ALL those whom lost their lives to domestic abuse/violence. May ALL of you receive the justice you so longed for. I pray for their families in hopes that God gives each of them the strength to stand up to the abuser and to keep their loved one's memory alive!!!?

    When he refused to sign the restraining order he should have been held for psychiatric evaluation or back to jail. These women weren't killed by a mentally deranged individual. They were killed by judges and parole officers, none of whom were interviewed by CBC, for this program. We don't need to rewrite the law but we do need to enforce it rigorously.

      +ironpirites I agree. I'm in shock that you can actually refuse to sign a parole form and still get paroled. This was obviously not an oversight because they specifically wrote in "refused to sign" where his signature was to go. This almost implies it's nothing unusual, business as usual.
      I also find it odd that his record, or the ostensible lack thereof, is relevant when he should have been charged and tried for attempted murder after the beating of Anastasia. I just don't get it.

      ironpirites Since when is a court order optional? I must have missed that memo. There were many failures along the way, even that counselor who had his file and said this was more than situational domestic violence, even he was kind of nonchalant, he just sent an email and that's it? He should have been blowing the horn loud, maybe even emailed the judge since he of all people should have appreciated the gravity of the situation. Just mind blowing.

      zwergie256 Law enforcement related to domestic strife is difficult and when you throw in issues of mental illness it is even harder, but when you add failure of officials to prosecute parole violations and failure to enforce court orders, law enforcement becomes impossible.

      Not signing the order does not invalidate it. Just like a traffic ticket, you don't have to sign however you're still liable for it. There were so many signs of impending peril with this monster that it should have been taken more seriously. He wears his psychosis on his sleeve. Such sad loss of life

    Something similar happened to my first cousin. She started staying with us when she was around 9 or 10,I was a year younger than her. When she turned 20 she moved to North Carolina and ended up in an abusive marriage. She had her husband arrested for domestic violence. He was released from jail and she wasn't notified. Within an hour of his release my cousin was murdered. He went to her place of work, which was a hair salon. Her husband walked into the salon and shot her in the back of the head while fixing a customers hair. My cousin never knew what hit her
    The police said she passed before hitting the ground. Then her husband shot and killed himself. Crystal was 26 when she was killed and could possibly be alive right now of she would've been told about his release. I miss her dearly!!

It seems like this happens so often now. Perhaps, that's not true. Perhaps, we just hear about these sort of events now because of social media. It is really very sad.

    Having been the victim of Domestic Violence myself, I can personally attest to the lack of police police protection I received.
    I am currently confined to a wheelchair. Several weeks ago, my husband ran at me & was attempting to drive me at our refrigerator door. Fortunately I was able to protect my knees and swing my chair & avoid God knows what! I called the police & they were quick to identify my circumstances as “merely Domestic” & after questioning us separately stated that was all the proof they needed, leaving me with my husband. Fortunately my son heard my screaming & rushed into the kitchen to put a stop to this. I called his Doctor & requested a Section 12. Soon the police were back removing him from my home involuntarily to a Psychiatric facility. The happiest days of my life are just ahead! My daughter’s fiancé lives in Australia & has invited me to live with them where I will NEVER have to see him again!!

    I blame the judge. If he had beaten a stranger on the street in such a way he would be in jail for a least 3 years. But since it was a woman, someone he lived with, there was no justice, and then 3 murders. Judges should be held accountable for their decisions like anyone else...Sad story.

    After he beat Anastasia that charge alone should have earned him YEARS in prison. This was a prolonged attack that occurred over many hours! It was NOT a one-time incident, but something he was known for within the community. I hate knowing that this man basically terrorized women his entire adult life..

    The problem is not that he should not have the presumption of innocence, he should. There is a problem with a system where you can refuse to sign a parole form and still get paroled, where you can ignore court orders without being sent back to prison. There is something wrong with a system where he is repeatedly charged and the charges are not litigated but rather repeatedly dropped. Even if he had no record whatsoever, for the battery of Anastasia he should have gotten a hefty sentence as he should have been charged and prosecuted for attempted murder. Had he been prosecuted along the line he would have been sitting in prison instead of shooting up the town.

      Ontario's court system far too often hasn't held Mr Borutski accountable for his refusal to follow court orders. Until such time that more courts are prepared to go tough on defendants who refuse to follow lawful orders, I'm afraid there will be more people inclined to act the way Mr Borutski did. At least now he has been caught, and although Canada doesn't have life without parole written in its Criminal Code, a law that came into effect in December 2011 gives judges the power to sentence defendants convicted of, or who admit to, multiple murders, to sentence such murderers to consecutive life sentences e.g. Borutski, if convicted of all 3 murder counts (whether 1st- or 2nd-degree), could be ordered to serve 75 years, of his life sentence, from his September 2015 arrest. At the time of that same arrest, he had been 57 or 58 years old, which could mean that any life sentence he is given (if convicted) he dies behind bars before he gets to apply for day parole. In theory, he could be convicted of 3 counts of 2nd-degree murder, and thus be eligible for the statutory minimum of 10 years, although he will be lucky, in that case, if he manages to get a parole ineligibility period of

      I think there may have been a remedy even before these changes. Paul Bernardo was convicted of murder and though he will be technically eligible for parole he won't get it because he was designated a dangerous offender. The problem is not whether someone gets one life sentence or three consecutive sentences, even after fifteen years in prison a person would become less dangerous, the problem in this case was the system's unwillingness to enforce the law from the beginning, before the escalation of the violence, which was utterly predictable.

    This was so heartbreaking to watch. I escaped a real violent relationship in the past.. to this day Im so glad I was able to survive. The only way I could do it was by disappearing for years, I had no choice but to change my entire life.. Work, home, phone everything. To the women out there going through something like this. GET OUT. BE SMART about it, you will know when the moment is right. Have a plan in your head, when the moment is right. RUN!!

      Agree liberalism needs curbing, not sure about conservatism as it is different here (I am in UK btw). Unfortunately many people who claim to be championing minorities are hateful against those who criticise them; there was a nineteen year old university student (George Lawlor) who recently objected to being expected to go to a 'consent class' (exercised his freedom of choice and speech) and was then vilified by online bullies (who became hateful for a 'good cause', so to speak, and were not censured).       Something being a Federal Offense vs State or Local Offense only changes the parties responsible for investigation, it doesn't change anything about the punishment. If you want to wait around for the FBI to uncorrupt themselves so they can investigate a matter, then you may be waiting a while.

A capital/federal crime DOES carry harsher sentences, for the most part, as it should. Crimes are categorized by severity and therefore, so are the punishments.

      A8HBU There was no proof that the rumors of his previous attacks were real when he met each new woman so they gave him the benefit of the doubt. Have you ever been the victim of a false rumor? Maybe not because you’re a male but as women, we tend to encounter MANY false rumors about us so given that these poor women knew how it felt to be lied about, they likely felt sorry for him until it was too late to realize that he was indeed horrible and dangerous.
      He also seems to be a master manipulator. Don’t blame the women for trying to be good people.

    Natalie was my nurse when I was sick and at home.. she was a beautiful soul and the last time I saw her was at the Eganville Library Christmas 🎄 Party. She was with a man similar to this guy’s description.. it was the next year I found out she was murdered!! I’m still in shock.. My heart goes out to all of the families who were involved.

      Great Frost Hawk I usually understand the importance of knowing what circumstances created a person, because that cannot be ignored. However, upon ending 3 peoples’ lives, it’s kinda pointless for people to know why you became what you are, because you’ve done somethong so grave that doesnt excuse you.

    Okay now I am even more scared to date or make friends. My anxiety is on high now due to these stories. You cannot cure someone of their violent tendencies you can not stop them. You need to lock them up away from innocent people. The judges are at fault for all of these women’s deaths.

      I lived about 1hr from where this happened and I remember it like the back of my hand. My stomach dropped when I heard my kids school was on lock down and then when I heard of what happened I was brought back to my childhood and living my own nightmare. The news needs to make these stories more known. People don't realize how often this happens.

    There is a book called The Gift of Fear by Gavin De Becker, that EVERY female person MUST read. The judicial system and the police are profoundly ineffectual and negligent in dealing with women's safety, so WE have to take care of ourselves. The book helps clarify certain behaviors that women can be on the look out for, and how to work around them. The book also emphasizes how very important it is for women to LISTEN TO THEIR INTUITION!!! Women are given the gift of an early warning system that is supposed to trigger extra awareness of their situations. They are also routinely told not to pay attention to these alarm bells, because these warnings often have no actual evidence to back them up. Just, you know... a gut feeling.
    There is also a problem regarding follow up. No one in the legal system wanted to take the initiative or time to make sure this monster was meeting his parole requirements, that he was attending counselling sessions or living where he was supposed to be living. And the two women responsible for putting Borutski in jail were not warned about his release. If they knew he was out, they could have had taken steps to protect themselves a little better.
    There is also the underlying current in the police and justice system that constantly puts women as second class citizens. Violence against women is not as serious a crime as violence towards men or property. Women just don't rate.
    Women are still considered to be chattel, the father's or husband's property. You can do what you like with your own property.
    They are also considered to be responsible for the violence that is turned on them. They "ask for it".
    Does anyone think these three women wanted the violence that was used against them?

      I have read that book and it is a WAKE UP CALL for women in today's society. The odds of you being helped out of a life threatening situation with another human is slim - you must learn to help yourself. It is VITAL.

      Only recently our new president of Mexico with our new Congress signed a new law indicating that "Feminicidio" ( murdering a women) is a felony leading to life imprisonment without parole, sadly men would be released before after murdering a women, simply because a female is considered nothing to society.
      In that same law, women can call authorities to automatically jail the abusive husband or boyfriend for a minimum of 5 years in prison.
      This law was passed a few days ago. Hopefully Canada can do the same

    Where is victims support in Canada? I took my ex to court ,I was in a private room not in court ,the judge called him dispicable. I felt stronger with victims support by me it helped not to be in court alone.

      I agree to an extent. I'm a woman who watched as I was growing up, and learned better than to blame just the man.
      Yes, he is awful, but when you allow that first hit and don't leave..you are giving them permission to keep on.
      Most times these victims have been abused mentally or physically in little ways until the attacker realizes they're going to stay (or come back).
      These women had friends and family already realize that he was a problem, which means that he had been building up to the worse attacks.
      These women left, but how many times did they stay before it went too far? If you don't leave at the first time you are their property, according to them.
      I'm not excusing that these abusers should be allowed to do this, but we women have seen this thing so often...When do we say no?

It is how ever women who have suffered the longest and still tend to have DV discounted as being a crime and seen as a private issue or women deserved it. It's been that way for centuries.

    I knew a monster just like Basil. He used everyone and anyone he could for a place to live and rule. He abused and drank and smoked...but didn't work or earn money. His 'hard luck' was everyone else's fault. In and out of jail his whole life. Moved from state to state where new women didn't know him, so he could continue the same lifestyle. Soulless bastard.

Ahh, just for the record Canadian authorities, he was probably a very good prisoner....there were no females in the prison. Note to all females: When everyone, friends, family, and strangers tell you the guy is bad.....the guy is bad!!! When everyone tells you he hurt his last wife and girl friend and the guy's excuse: He was/is the victim, ahh,take notice.... the guy is bad! Second guessing yourself might be one of the worse ways to ward off unnecessary stress and abuse; go with your gut! Wait, OPP once again, Didn't I see this police force in the Russell Williams episode? Aren't they the same force that failed to inform people about the violations happening in their region, the eighty plus incidents committed by Col. Russell Williams??? Ladies, beware of thatOPP police force....this aspect of the community is obviously does not qualify as members of society that they will "protect and serve!"

    Until fairly recently, UK police officers responding to a domestic violence call (referring to it as "just a domestic") usually treated the victim in quite a dismissive, even resentful way, with a sense that it's going to be a waste of their time, & an expectation that they would not press charges. The historical view taken by law enforcement has always been one of minimising this particular kind of violence. Acts of abuse committed within a supposedly safe, loving relationship are especially despicable. An immediate, joined-up plan that swings into action the first, & EVERY time this type of violent assault occurs, is needed. ANY act of domestic violence should be documented, & a plan of legal punishment &/or practical intervention against the perpetrator is required, with support & protection of the victim(s).

    The min he refused to sign and certainly not showing up for probation should have been instant recall back to prison! Probation need the sack and someone needs to take responsibility!!!
