  • Today we’re in Judge Gauthier’s courtroom for a sentencing hearing. The defendant has multiple open cases and convictions and has finally run out of chances. The court has extended the defendant repeated opportunities for treatment and recovery, but rather than follow through with those, he continues to pick up new cases, violating his probation on multiple occasions. Judge Gauthier is at his wits’ end with this defendant, and today is his day of reckoning. Watch to the very end to see the Public Defender’s arguments, and the logic behind Judge Gauthier’s final ruling!

My maternal Uncle spent 42 years in prison. He tried to reconnect to with the family. Its been a fiasco the past 5 years or so.
He lives by himself, 650 miles from family and very few of us choose to associate by phone or text.
When I lived about an hour from Hin we got together for A 4th of July and one BBQ. Then shit went sideways.
His prison thinking kicked back in and he tried to be all tough guy with me and my wife and stepkids. Showing up unannounced, banging on the door.
      I almost shot him.
He made the choice to be an 'Outlaw'. The consequences are more than I care to dig into.
      It's tragic and infuriating.

After half of my friends went to prison for decades, I cleaned up my act. I'm lucky to have not been there when the shit went down, as I was on my way but got stopped for running a red light, and that escalated because my passenger had a small amount of weed on him. We were on our way to what would become the scene of a much larger crime, that made the news. It was one of the biggest busts in the area in the 90s.

With all do respect, I'm a recovering coke addict. 3 years sober. Addicts aren't clowns. I do understand being fed up with this behavior. I get it's repetitive and he earned a lawful punishment. No doubt. But addicts aren't clown. Something happened in life to each addict that triggered the start of drug use. And I know what you're gonna say, "I've struggled without falling to addiction". Good for you, if that's the case. Not everyone is built that way. We don't need to make addicts feel worse. It'll take what hope they have left to come out on the otherside sober and they'll turn right back to drugs when they feel all they are is a joke. BUT it's completely valid to be done with the behavior and deal the lawful punishment earned. It's okay to be irritated and pissed off. But we should all try hard to say kinder things in most stern ways when necessary. That's all 😊

I disagree. Being addicted to drugs is like a dog in heat, often there’s very little someone can do to stop themselves. It doesn’t mean somebody doesn’t need a certain amount of punishment, sometimes you can still gotta be punished for it. But act like it’s the same as eating too many sweets throughout the day is only something someone would argue that doesn’t understand it.
So I kind of wonder if the addiction facility should be locked instead of completely open. There’s reasons to have either, but they have a locked ward that’s at least somewhat difficult to get out might help people be able to control themselves a little bit more and stay to learn techniques. And not only learn techniques but have a chance to get time to get off the drugs fully before they are expected to have some superman willpower. Sometimes these people spend a few days in jail and then I released, then after they were released they enter a plea agreement to go to rehab, then they go to rehab even though they were just using drugs days before, and we expect them to have the willpower to stay in? There’s a reason rehabs don’t work, and that’s because often than not set up to work well enough.b

So 33 years of probation. That's too make sure if he gets out and still wants to commit crimes he'll have that 33 years hanging on top of his head along with any new charges. The judge is insuring if he doesn't change he will be gone forever. He is being pretty lenient.

You're not a victim of anything except bad character. You chose to start a drug abuse hobby, so the only victims are the people you harmed because you wanted to use drugs.

I dunno. I have a hard time believing that the defendant deserves 40 years. Drugs or not, it just does not feel right to me.

The result? He will be back on the street in 18 months and the fines will never be paid. Oh and the taxpayers will support his children!

I wanted to know about consecutive or concurrent also. The look on his face said it all. If the courts would have given him a prison sentence originally, he would have gotten the point a long time ago

The body language of the judge said it all.

The defense attorney is really doing his best for the guy! You cannot help some people - hopefully he finds AA in prison

He was sentenced to 10 years, not 40.

So all together, that's a minimum of about 27 years, could have just gone to treatment.

Completely emotionless reaction. The judge chose righteously.

7-40 years seems like a very wide range.

Here's the thing, I'm guessing he's in his twenties, so he's like 'I'm gonna be 60+ when I get out, well f that' so, likelihood is he Will reoffend cos he don't give a s*** even if he gets out in twenty for Good behaviour!

Being a victim of addiction doesn’t explain or forgive breaking the law or hurting people to get high. I struggled for 20 years, but I damn sure never got arrested or hurt anyone…..other than myself and my family,

This guy thought he was going to continue on his merry way with no severe consequences, boy, the judge dispelled those fantasies quickly! His lawyer needs a tailor too, suit looks like it is cut for a hippo!

Take a good look at him, then think about my age. I am 71, he will be older than me when he gets out ! WOW !
