Even if Charlie gets a new trial with Donna as his co-defendant at trial that’s not necessarily a good thing at all. Of course he’s got a life sentence so maybe he could make a better bargain if he gets a new trial? Donna get new counsel but may not want to be on joint trial with her son!
couldn’t agree more, the only consolation is that at least they are incarcerated. Donna is in a county jail until her trial which is way worse than prison. At best, all Charlie can get is a new trial, he’ll get convicted again.

Yeah, Carl’s been all over this clear and imminent danger since Donna was arrested . and meanwhile there’s the Tallahassee Atty, who has covered his case for a very long time and has been defending Dan rashbaum up and down… He keeps claiming none of this was a big deal … how the hell can somebody say this was not a big deal???

Exactly right. Evidence won't change for him and they came out with the ridiculous extortion defense because they had very little to work with so he gets new trial, what do they do? same ridiculous defense or he's cuts deal to testify against Wendy. What is better option? I bet she is hoping more than anyone he doesn't get a 2nd go maybe prosecution doesn't even contest it because really what do they lose other than a little more time which they've been very patient from get go some murders never get solved and some after years, decades etc so they are still on good time. I know alot aren't patient and want her arrested yesterday but this might be best case scenario for that.

@@terripetre8159 - it’s so easy to say after the fact what another lawyer should or shouldn’t do! Hindsight is 20/20! Facts are hearings on these conflicts did take place. Judge said Ok to go ahead. Now there’s problems and everyone seems to blame Dan lot Judge? Truthfully I think they all did what they thought was best. No one was acting in bad faith or unethical or acting illegal. It’s not a perfect legal system! HINDSIGHT is 20-20 and Dan and the Judge would probably do somethings differently. Maybe the prosecutor too!

I enjoy listening to Tim, he explains everything so well without being condescending. As far as not bashing Raushbaum on a live, I appreciate that also. He’s a gentleman and doesn’t feel the need to do that to someone in his profession. What he personally thinks of fellow attorneys is his business.
I absolutely love your channel and Tim Jansen is the Best Guest. I'm a Canadian and wish our justice system allowed cameras in the courtroom to afford us the actuality that we see in US courts. I did watch the Charlie Adelson trial, all of your videos on this matter and your interview with Dan Rashbaum and working with lawyers for over 30 years in Ontario and British Columbia, I can't imagine that Rashbaum's partners/law firm didn't intravene with this conflict through conflict checks because they/it would be brought up before the Provinces' Benchers' Committee and this case, I can't imagine, would be at this point where it is an absolute mess. Joel, you and the COE and your guests, especially Tim Jansen, explain the cases in such great detail and, again, I wish we had the same protocol in Canada.
Tim is saying everyone missed that Dan Rashbaum lied about having waivers. EVERYONE knew and said Dan had a conflict is what the judge asked in open court about the conflict that dan stated he had waivers. Carl is NOT anything special.

Donna isn’t in Charlie’s ear every day anymore telling him not to flip on Wendi. Actually, this is probably the first time he’s ever been free to think for himself in his entire life.
Exactly and what does do if gets new trial, evidence is same reason they had to come up with the extortion nonsense little to work with. So use similar same defense or testify and get deal. Especially how she cut him off after trial not in the years before she loved him so much her favorite brother who always protected her lol i bet she hoped more than anyone he doesn't get new trial.
He had waivers and the Florida Supreme Court has said multiple representation is ok with a potential conflict as long as there is a valid waiver by the clients. That’s what many lawyers do in these types of situations. It happens all the time in private practice. Problems still happen like here because Clint’s change their minds but that doesn’t make it unethical per the SCt!

OMG, I cannot imagine what Dan Markel's family, especially his parents are going through and their thoughts about this. This has to be devastating to them. ROSH needs to be disbarred. This whole case within cases is a circus. Disgusting!
With all the lawyers, DA's, judges and law professors involved in this case or commenting about it online, why did no one see this coming and make a bigger deal of it before it actually happened???
I think no one expected Charlie to refuse to testify for his mom is all it is. They were so close and so tight. The fact that he essentially put a stop to her trial and is making her wait another whole year to have it happen -- I just don't think that was something people saw coming. I understand he's a POS, but when it comes to your mom........I could never do it to mine and I'm surprised Charlie did it to his.
No a clear conflict because of the waivers described in court and not opposed by the prosecutors or judge. Clients were questioned about the conflict and waived it!

@@Ladyshore - Defense lawyers do represent codefendants and it is allowed as here when the courts find there has been a knowing intelligently and voluntarily made waiver of independent individual counsel. Obviously it’s a bad idea as illustrated in this mess! The better course is get your OWN CONFLICT FREE LAWYER! However you are guaranteed counsel of your choice if you can afford one. Donna Adelson and Charlie had the money and both desired Rashbaum’s assistance even though there was a POTENTIAL CONFLICT. Rashbaum felt it was ok since he had the required waivers. I hear some legal “experts” say that this was unwaivable conflict and unethical so he should be disbarred or punished for unethical practice! Hogwash! He was following the law but he was on thin ice as it turned out. Hindsight is 20/20 and I’m sure he’ll be more cautious in the future.
Charlie will get convicted again in a re-trial. I think he knows that, and understands the only way he gets a reduced sentence is if he implicates Wendi. I don't think there is much love loss between them now.

When Dan Rashbaum an attorney an officer of the court stated in open court he had waivers a judge accepts that as truthful. Dan lied and now he will be held accountable by the Florida Bar.

I would LOVE LOVE LOVE to know how the Local Tallahassee attorney following this case for years is consistently and wholeheartedly proclaiming that none of this is a big deal and none of the scrutiny is warranted. It makes no damn sense. He went and played tennis with Rashbaum one time and now he’s running defense for him after he’s made horrific decisions with catastrophic consequences for his unethical actions.
If this causes Charlie to fess up about Wendi’s involvement, I think it would be worth it to them . She was his wife at one time , the mother of his children , She had an obligation and moral compass of parental responsibility that she failed at badly . This officially and from the beginning is all about her . Wendi is a fraud , a chameleon, and I doubt she even knows whom she really is . But yet she’s out there living her best life.

It was clear Dan Rashbaum had a conflict with representing Charlie. He was his parents lawyer and potential co-conspirators. I‘m not a lawyer but it never seemed to be right. Now they have the disaster
The answer to this will still be the same. The ONLY person that can corroborate his story is the person who is currently sitting in jail right now without a lawyer. She kept a list of people who "wronged her" in her mind. She will simply add Dr. Adelson to the list. AAAAAAAAAND lets not forget that even though he gets a new trial, will the evidence stand against the extortion story?! I believe so! Just because he is granted a new trial through a technicality, doesn't necessarily mean he will have a different result.
I think Wendi is panicking. If Charlie gets a fresh new chance at a new start from scratch trial. The state can use this as bargaining power to cut a deal if Charlie gives up Wendi’s involvement. Charlie has had a taste of what a life sentence feels like . I’m sure he’d rather have a chance at freedom someday, and he has had a good while to think this scenario through , without momma Donna there to influence his thoughts and decisions.
What I remember is that at the time of Rashbaum making the move to defend Charlie, Donna and Harvey had not been charged for anything and Rashbaum was not representing them for anything. Yes, Donna and Harvey hired Rashbaum in 2016 when the case was unfolding and arrests had started. But he never represented them in anything? Did he? Rashbaum removed Donna and Harvey from the witness list for Charlie's trial to prevent Georgia from crossing them. Rashbaum did not want Georgia to find out about the double extortion defense so it was important for him to make sure that the prosecution did not talk to Donna before the trial started. I don't think it was because of conflict. As far as this double extortion defense goes, hasn't that been debunked by Donna/Charlie conversation stating that Dan Markel may have been murdered by drug dealers because he didn't pay them? It's because of this statement that Georgia had Charlie on her witness list for Donna's trial. I don't think that extortion plot defense can be used by anybody again.
Tim is right. The waivers of conflict are simply inadequate since they can change their mind like here! This was potentially very dangerous and now the conviction is in jeopardy. It’s a “disaster” as Tim says.
The Adelsons chose the weasel/clown to represent them. Charlie is a big boy with a big mouth. If he wanted mommy and daddy to testify he would have insisted. Hope our broken law system doesn’t grant him a new trial.
I know this seems awful however, I feel this was necessary in order for Charlie to flip on Wendi. Charlie needed to be convicted and he needed to receive life in prison in order to turn on Wendi. I think Charlie is going to turn. I'm looking forward to it.
The only way they will get the murder conviction overturned is if they had a better defendant. They still have Charlie and his very outrageous double extortion theory.

I did watch the Charlie Adelson trial, all of your videos on this matter and your interview with Dan Rashbaum and working with lawyers for over 30 years in Ontario and British Columbia, I can't imagine that Rashbaum's partners/law firm didn't intravene with this conflict through conflict checks because they/it would be brought up before the Provinces' Benchers' Committee and this case, I can't imagine, would be at this point where it is an absolute mess. Joel, you and the COE and your guests, especially Tim Jansen, explain the cases in such great detail and, again, I wish we had the same protocol in Canada.

He had waivers and the Florida Supreme Court has said multiple representation is ok with a potential conflict as long as there is a valid waiver by the clients. That’s what many lawyers do in these types of situations. It happens all the time in private practice. Problems still happen like here because Clint’s change their minds but that doesn’t make it unethical per the SCt!

I think no one expected Charlie to refuse to testify for his mom is all it is. They were so close and so tight. The fact that he essentially put a stop to her trial and is making her wait another whole year to have it happen -- I just don't think that was something people saw coming. @@Ladyshore - Defense lawyers do represent codefendants and it is allowed as here when the courts find there has been a knowing intelligently and voluntarily made waiver of independent individual counsel. Obviously it’s a bad idea as illustrated in this mess! The better course is get your OWN CONFLICT FREE LAWYER! However you are guaranteed counsel of your choice if you can afford one. Donna Adelson and Charlie had the money and both desired Rashbaum’s assistance even though there was a POTENTIAL CONFLICT. Rashbaum felt it was ok since he had the required waivers. I hear some legal “experts” say that this was unwaivable conflict and unethical so he should be disbarred or punished for unethical practice! Hogwash! He was following the law but he was on thin ice as it turned out. Hindsight is 20/20 and I’m sure he’ll be more cautious in the future.
Charlie will get convicted again in a re-trial. I think he knows that, and understands the only way he gets a reduced sentence is if he implicates Wendi. I don't think there is much love loss between them now.

Sigfredo and Katie were tried together and they were co-conspirators, so why can’t Charlie and Donna be tried together?

The answer to this will still be the same. The ONLY person that can corroborate his story is the person who is currently sitting in jail right now without a lawyer. She kept a list of people who "wronged her" in her mind. She will simply add Dr. Adelson to the list. AAAAAAAAAND lets not forget that even though he gets a new trial, will the evidence stand against the extortion story?! I believe so! Just because he is granted a new trial through a technicality, doesn't necessarily mean he will have a different result.

I think Wendi is panicking. If Charlie gets a fresh new chance at a new start from scratch trial. The state can use this as bargaining power to cut a deal if Charlie gives up Wendi’s involvement. Charlie has had a taste of what a life sentence feels like . I’m sure he’d rather have a chance at freedom someday, and he has had a good while to think this scenario through , without momma Donna there to influence his thoughts and decisions.
What I remember is that at the time of Rashbaum making the move to defend Charlie, Donna and Harvey had not been charged for anything and Rashbaum was not representing them for anything. Yes, Donna and Harvey hired Rashbaum in 2016 when the case was unfolding and arrests had started. But he never represented them in anything? Did he?
Rashbaum removed Donna and Harvey from the witness list for Charlie's trial to prevent Georgia from crossing them. Rashbaum did not want Georgia to find out about the double extortion defense so it was important for him to make sure that the prosecution did not talk to Donna before the trial started. I don't think it was because of conflict.
As far as this double extortion defense goes, hasn't that been debunked by Donna/Charlie conversation stating that Dan Markel may have been murdered by drug dealers because he didn't pay them? It's because of this statement that Georgia had Charlie on her witness list for Donna's trial. I don't think that extortion plot defense can be used by anybody again.
