I also take a dive into the difference between flat out copying someone else's pattern and drawing inspiration from another designer's pattern (two very different things).

    I know exactly what you mean by copying designs? I'm the same way. I have a similar story to your blanket one! Years ago a friend sent me a picture of a musical crochet blanket and asked me to write the pattern as she couldn't find it. Looked everywhere but I couldn't find it or designer name so went ahead and wrote the pattern and did a cross stitch diagram for the music notes. But just to make sure I wrote in the pattern that this was not my design before sharing with her. A few months later I received an email from the designer thanking me for writing the pattern and all. She said she never wrote a pattern and had no idea how to do it. Now she designs and I make her patterns. Lol

    Just a reminder to everyone, there are currently no machines that can replicate handmade crochet. In other words, all crochet items that have any sort of unique design will likely be handmade.

    Technically it is only illegal to copy and sell someone’s pattern. It isn’t illegal to make what is on the pattern and sell it so long as you state that you did not design the pattern.

      So if someone posts their pattern and tells you that they'll take legal action if you start selling them, they donvt have a leg to stand on?
      Like 'Here's a pattern for free but if you sell anything you make from this pattern I will take legal action.'
      Is that just hot air?

      @@RT-py7ju They do have a leg to stand on if they specify that you can’t sell items made from their patterns. Especially if they sell items made from those patterns. That’s more like a product patent than making derivative artwork.

      Is it OK to charge for other people's patterns if I slightly change it to make it my own? Also, is it OK to just take donations and not attach a specific price to the item if it's someone else's pattern?

      @@krisscoss8907 A crochet pattern can’t be patented it can only be protected under copy right. Once copyrighted, you can not copy, share, download or publicly display the pattern without permission. You have paid for the pattern, the materials, and the labor. It is your right to do as you please with the finished project. The pattern’s text, pictures, and instructions are protected under the United States copyright laws. Your completed project does not fall under this protection even if there is a “do not sell any item created from this pattern” disclaimer. But if you were to resell the written pattern, you are able to be sued by the designer.

    I love this video! If you have time, please consider making one on creating crochet applique patterns specifically. I love to draw cute little flat objects and would enjoy to make them into appliques, but I'm a novice, so I often get confused, which combination of stitches to use to create a specific shape. So most of the time I spent just redoing previous attempts(.

    This is great!! And I think the blanket story is really telling! :) I think it's okay to "recreate" things as long as you don't intend on making money from it and/or claim it as your own. I saw a super cute teddy online once and sort of worked the pattern out (I couldn't find the pattern or I would've used it lmao). I only really made it for myself, and eventually ended up making one for my mother.

      Depends on the seller. Some dont mind as long as you accredit them as the pattern designer.

    Thank you for your very informative video. I completely agree with you regarding the choice of yarn. I have just considered volunteering to test a pattern but all the recommended yarn listed were costing between 6 and 18£ per 100g. As a fat person I would need 7 to 8 skeins to complete it and I just gave up.

    You are absolutely right, it's fun to learn techniques out of imitations or step by step tutorials, but in order to claim myself a designer I would like to express then my own ideas through that learned techniques. What can be arguable is the attitude towards well established classic fashion shapes which were one day invented by someone but later became a wide used pattern by all designers, like Channel models, the same thing about widely used classic crochet patterns, sometimes you can have a nice idea of applying such a pattern to your project. Another touchy subject is a way of expressing hommage in art and fashion, like Desigual's serie dedicated to Cirque du Soleil, sometimes that happens in poetry, cult art pieces become an heritage everybody can refer to, it doesn't belong to any specific person.

    This is a very informative video. I’ve been crocheting on and off since I was a teen, but lately I’m more into it and I’ve been thinking in creating my own pattern but wasn’t sure of how to do it and also; can I use any stitch that there is out there or do I have to come up with my own stitch to be able to sell my pattern? Thanks

      Thanks so much for watching 😊 No, you don’t need to come up with your own stitch! It’s more about coming up with a stitch pattern. So using different stitches together to create your pattern! 😊

    Awesome job explaining, Kate!👏 I totally agree with all you've said.👍 The only difference for me in my design process is that I can't draw more than stick figures!!😂 When I create something it tends to happen as I crochet & I write it down as I go.📝 Though I often create something & forget to write it down & wonder later what on earth I did!!!😜 My challenge is having the energy to write it up, photograph the steps, then get testers to test it etc etc etc!😏 Crocheting the design initially is the easy part for me!🧶 Blessings from Adelaide💕🐨

    So often I see a pattern I want to make but I hate the stitch pattern and want to do one of my favorites instead. I think about trying to figure it out but haven’t taken the next step. Also I would love to figure out how to change sizes. There is a pattern I found recently for adults and I want to make it for a child but don’t know how to do it!!

    I have question 🙋‍♀️. I have a design for this top that I wanna make but the stitch patterns are not mine. Like I pieced different patterns from different crocheters into something of my own in a way I want it. Is that wrong?

    I just want to mention... even if it isn't a crochet garment crochet and designed by someone you still need to be careful because some pieces are designed by a fashion designer and they might not like that you copy their work. We should respect everyone's work not just crochet design work.

      Of course Lesona! It would be impossible to create an exact replica of a machine made item using crochet stitches anyway, but I think drawing inspiration from different garments it’s perfectly acceptable ❤️

    If you see a persons crochet pattern that inspires you t ok make something of your own, how much of it has to be changed to call the new design your own? For instance if I just change the stitch of a cardigan and make the same shape and features it that my design? Or inspired by ABC Crochet designs?? Or just changing the kind of yarn? Say from a fingerings weight to chunky? I am wanting to become a designer but am not very good at designing. If you make something that you have never seen before and assume that it would be an original but come to find out someone has already made it.... is it still your design?

      Hey Kerie!
      If you’re writing the pattern from your own mind but drawing inspiration from the shape/ stitches etc.. from another designers pattern that is totally fine! It is very unlikely that your pattern will be the same as another designers if you are writing the pattern from your own mind.
      If you went ahead and purchased another designers pattern and copied it word for word but changed the hook size/ yarn that is outright copying and is a huge no no!
      At the end of the day if it feels wrong it probably is.. your conscience will guide you 💕

      @@Katieree Thank you Kate. I am wanting to do some crochet designs. There is a stitch I saw that I want to use and the style of a pattern I've seen and add a hood to it I just wanted to know how much is stealing and what I can take credit for.

      Using the same stitch and shape is absolutely fine! But like I said you can’t copy their pattern word for word.. you need to write it from your own head 😊

    Ok big question here, if there is a free pattern for something online then I make it using the FREE pattern can I then sell my finished product? Of course giving credits to the pattern creator

      If the designer is ok with you selling finish pieces made from their pattern yes! I would just ask them to be safe if it’s not stated on the pattern

    Sorry, I'm still a bit confused. So you can sell a crocheted item with someone else's pattern but credit them? And what's illegal is claiming the pattern as your own? Thank you in advance!!

      If the designer states finished products can be sold than yes you can sell finished products made from a designers pattern. You cannot however sell their written pattern. I hope this helps! 💛

    What do you think about you
    creating your own crochet pattern of big corporations characters (disney, pixar etc)? (Not copy another crochet designer and create your own pattern)

      This is actually illegal due to copyright laws around these characters. You could probably make them for your own personal use, but you definitely cannot sell patterns based on Disney characters 💛

    So informative! Thank you! I wanted to know your thoughts on copyright infrigements of making crocheted versions of originally fabric garments? I'm specifically trying to create 100% crocheted cosplay costumes and was wondering if there would be any legal worries of doing so (I wouldn't be including a logo, the costumes that come to mind are actually very basic / standard pieces of clothing). I understand you would need to specifically say "inspired by *insert anime here*" but am still worried about legal ramifications of selling the finished item or even a pattern to crochet it.

      If you’re only making them for personal use there’s no issue. Copyright really only comes into effect if you’re wanting to profit off something you don’t own (such as a brand/ design/ logo, etc).
      Having said that, if you’re crocheting something that doesn’t include a logo and isn’t advertised as a *insert character name here* costume, I don’t think it would be an issue. I should also mention I’m not a lawyer so if you’re really concerned always double check with a professional 💛

      @@Katieree this is great advice! For example you could make a tinkerbell outfit but just call it "green fairy" or a Hermione costume would be "school age witch" etc. Just be mindful of logos and names, as mentioned. For example with the Hermione one you wouldn't want anything to say Hogwarts or have a house crest on it, although using their colors should be fine. Hope that makes sense!

    I am curious about when I crochet a blanket for example using a basic pattern that assists me in the concept and then add my own thing to it or compile several different rows from three different blanket pattens for example - is that considered ALTERING someone’s pattern ? Not sure about that - also for example using a base tutorial for a yoke of a baby cardigan then doing my own style - is a variation ok ?

      Hi Vivian,
      Referring to another pattern for inspiration is totally fine! But you must write your pattern in your own words and it cannot look exactly like the pattern you’re drawing inspiration from. If you were to lay the two side by side would a consumer be able to tell that they’re a different pattern?
      At the end of the day your gut will guide you. If it feels wrong it probably is ❤️

      Hi Bisade,
      In most cases you can sell finished items made from another designers pattern. The pattern will usually state whether or not finished items can be sold, and if you are selling finished items you should always credit the designer.
      You absolutely cannot sell another designers written pattern and claim it as your own.

    I have a question. I really like the axolotl crochet plushies. If I look at other peoples work but make my own pattern is that considered coping? I would like to do that with other crochet plushies but don’t know if that is coping some else’s thing. Also your video is very helpful.
