  • The plaintiff says he was at the dog park with his husky when the defendant’s three pit bulls started a fight and severely injured his dog. The plaintiff is suing the defendant for all the surgeries his dog underwent as a result. The defendant insists the plaintiff’s dog was the aggressor, and the plaintiff wasn’t even paying attention.

    Rules at most dog parks are no food or drinks because the dogs get aggressive over food.

      If she hadn't brought treats, it could've been avoided. I had a dog was really sweet and nice, but also highly food aggressive.

      @@benjie128 I've walked my dogs in dog parks , I've never heard or seen any signs telling me no food or drinks...what The heck? My buddies staff was a good dog with all other dogs,. I had two, one Hines 57 and a Siberian husky...they were all girls, buddies staff/pitbull always found it hard to be nice to my husky, over a toy or a stick water dish it just didn't matter. But she got along like buddies with my Hines 57. In fact when the Staffordshire got into a tiff with the husky,my 57 would join in on the action. Had to take husky for stitches twice.

      I’m working through some aggression with my dog. It’s food and fear based. He got attacked and now his personality has changed a lot. It’s heartbreaking because I want him to be able to go to the park and have fun like he used to but I also know that it’s not worth the risk. I really feel for the girl here when she said she hasn’t been back to the park. I’m hoping with more training I’ll be able to go back eventually but I’m scared I don’t want my dog to hurt anyone or their dog and I don’t want him to be afraid and reactive I just want him to be happy and feel safe.

    I don’t know about other dog parks, but dog parks in my area clearly state no treats allowed in the park, for this very reason.

    Dogs do not growl as a form of play. That said, 1 person, 3 pitbulls :/
    Bless that stranger who threw themselves over the dog to protect her ❤ edit: true, yes, they will, but usually between animals they know, not strangers. Very rarely will they growl at strangers in a 'friendly way.' Watching body language for play signs is very important.

      Actually, dogs do growl while playing. Like different barks, growls can mean different things depending on the the situation.

    As someone who’s worked in the dog industry for over 10 years, let me tell you how dangerous it is to have an “aggressive” breed littermates. That applies to pitbulls, huskies, German shepherds and so forth. Good shelters won’t let people adopt out young siblings. They don’t develop their own independent personalities and become neurotic. The fact that these three 11 month olds were all littermates….. good luck lady. If one attacks, they all attack.

      I do not believe you. And as for rescue shelters, they adopt very well the puppies, that is before any behavior changes occur. Pitt bulls have the aggressive tendencies bred into and it is up the owner to train this behavior controlled through training. And many owners of this breed, tend to not train these dogs. And the lady is learning a very hard lesson with her untrained pitties.

      @@trekgirl65 I’m not saying they don’t allow puppy adoptions, of course they do. But a lot of the shelters who actually know about dog behaviors don’t allow one single person/family to get littermate puppies. They want them to be separate. There’s also some shelter policies that don’t allow a person/family to adopt a husky if they have a boxer or vice versa. Those two breeds are known to not get along. And what is this case about? A husky and a boxer/pit mix. 😂

    This is why I don’t let my dog always play with other dogs. Sometimes dogs do like to play rough but I would hate something like this happening

    Do not get littermate dogs. Only get ONE dog per litter.
    Dogs from the same litter tend to be more protective of eachother than cross generational dogs.
    Also NEVER go to a dog park. It's not worth the risk

      You can easily have success with littermates IF you are willing to put in extra work with them. Littermate Syndrome is a real thing but it can be avoided if knowledgeable. I’ve run a rescue for 10 years and dealt with it quite a bit. Edit: but I would NEVER be ok with keeping three from the same litter. That’s pretty much unmanageable

That's why pit bulls have such a bad name. Idiot owners who don't realize they are playing Russian roulette every single hour, of every single day.

      You bring treats when you are training a dog to recall even in the presence of other dogs. Her mistake was she recalled 4 dogs and the one she didn't plan for was really excited about the treats. When she saw that level of excitement she should have closed up the treats and put them away to deescalate the situation. The two humans both had opportunities to deescalate (he could have called his dog away). Neither did. Two failures in training. Who always suffers? Our dogs. Be better people.

      Like an idiot, I once brought my lunch (sandwich) into a dog park, trying to multitask during lunch break. I quickly saw that it was a dumb idea and immediately put the sandwich back in the bag and left with my dog. There were no signs saying No Food Allowed but common sense prevailed. A lesson I’ve never forgotten

      "When they attack" is the issue. If they are trained to be docile (Which they CAN be) you won't have that issue.
      Yeah, there might be situations where they have to defend themselves. But then the breed argument gets thrown out. Any 3 large dog breeds in protection/defensive mindset, they will be near impossible for anyone to control.
      My argument is based off the first comment. "There's no way one person can control two pitbulls." Which is false.

      I say this as a trainer of humans in charge of critters... of any kind.

    I don't care what pit bull owners say, that breed has the propensity to be violent. It was bred into them. You can raise them to be sweet, wonderful dogs, but the potential is always there. They, like Rottweilers and similar breeds, have a great biting force and do considerable damage. A dog is a dog, and all of the loving spirit of those dogs goes out the window when instinct kicks in. This is the reason these dogs are often banned in communities and homeowner's insurance companies will not give you a policy if they know that you own one.

      i disagree. i honestly think the most aggressive breed is a chihuahua but no one has died for a chihuahua bite so it's not talked about. they're more dangerous because of they're strength and size.

      I watched a documentary about pit bulls and pit bull numerous headline attacks since the 1980s showing X-rays of a pit bull's large powerful jaws. It is unlike any other breed of dog. Comparing them to chihuahuas & poodles is ridiculous. Results of past attacks on children that was shown is too ghastly to even describe here and I stopped short of watching the rest of the program.

    The Plaintiff should have taken a picture of the rules for the dog park because I'd have been surprised if it didn't say something like no treats allowed in the dog park. Bringing treats is a recipe for disaster.

    Some cities have banned pit-bulls completely. And some apartment communities have done the same. Just too aggressive/dangerous.

    This is why I never take my dogs to a dog park. You can't trust people to have well behaved dogs. And some pit bulls can be unpredictable. Sometimes it's the owner's fault, but sometimes it has to do with breeding. A lot of these dogs are just being bred in someone's backyard with no care for the dogs personality or prey drive. This is how we get some pit bulls that are sweet and great with children, and others that are aggressive. Sadly as this breed is still being used as fighting dogs, and the prey drive has not been bred out of them. This is how we end up with dogs randomly attacking, and the owners saying "the dog was so sweet, I don't know what happened." Another problem is people getting these dogs and not knowing how to raise this breed properly. You need a firm hand, a lot of training, and even more socialization. Growing up I had all kinds of dogs, pit bulls included. I even did rescue for a while. I had a pit bull that I got as a puppy it grew up in my home with lots of other animals and other dogs. One day totally out of the blue it tore into my rabbit cages and killed all 10 baby bunnies and their mother. It was horrible. It chewed the wire until his mouth bled to get to them. He never displayed any type of aggression before that. I never owned a pit bull again after this incident, too risky if you ask me. It's a roll of the dice when it comes to their personality.

    I understand taking treats to a dog park. Many trainers do so, and many do to temp/control their animals. It was up to him to have control over his animal. His animal was all up in her space.

      Thank you! She was on the other side of the park with her dogs. He was on the phone on the other side🤷🏾‍♀️. If was him, I would have kept a better eye on my dog. We have a dog park in my complex where I live and if I take my dog there and someone is already there with their dog, I don’t go in. My dogs goes to a camp with other dogs with people who are trained on how to watch the dogs. And in order for him to be there, the first time I brought my dog (Rawlin), I had to wait 30 minutes while they socialized him slowly to see how he and the others acted with each. He gets to go at least 3 times a months since he was 1 and he loves it. People just need to pay attention and never assume that nothing can’t or won’t happen. Like the judge said, they are animals!

    If you're ever a witness too a case like this you can call your local vets in the area too see if a dog was brought in as a result of a dog fight. Ive done it before and had to write a witness statement later on.

    You are responsible for your own pets no matter what, Why would anybody take three dogs to a dog park alone, They are your dogs, you Need to pay the Bill. All dogs are capable of this not just Pimples She can't control them she shouldn't be taking them by herself Don't take treats or food to a dog park !! You definitely have to pay attention to your dogs at all times especially around other dogs and people, So don't be on your phone and don't feed dogs at a dog park with other dogs.     Shocked by this case, animals are like kids. If the kids do something the parents are responsible, even if animals, even if he was on the phone, 3 vs 1 , he couldn’t have even done anything if he was on his phone or not

      It’s not true that parents are responsible if a kid “does something.” For civil matters (like minor injury or property damage) it varies from state to state and often depends on whether the child’s actions were willful or negligent. There’s also a cap on the amount that the parent is responsible for. In this instance, they’re dogs, not children. When you go to a dog park, you assume there will be unleashed dogs acting like dogs. When dogs feel threatened, they have great potential to act aggressively. You take the risk of exposing your own animal to that when you choose to take your dog to the dog park. Unless the owner of the offending dog is deemed negligent, the owner isn’t responsible.

      @@mikesteele05 wrong, if there is an unleashed, uncontrolled dog, the pet parent is responsible for any injuries cause by the aggressive dogs. You need to talk to the police department and get educated on the law of responsible dog ownership laws.

    Dog parks are a nice idea, but they are terrible in practice. Every trainer I've ever used has said never got to a dog park. If your dog needs exercise, leash them up and go for a walk with them.

    NOONE should Ever have 3 pups from the same litter unless you are a professional breeder/trainer. She is a novice, immature and shouldn’t own dogs. So tired of child like mentality people who decide owning. Huge powerful dog is “cool”

    My 13 yr old lab was attacked 2 times by my neighbors pit bull and i do NOT blame the dog its a dog. My neighbors dog got out both times it was an accident and thankfully i was there and the owner so there was no actual bites/breaking skin.

      Excuse me, but the dog got out twice and attacked your dog twice. The owner is negligent what if it got out and attacked again, the next time it ends up killing your dog or perhaps a child? That owner has to be on notice. If s/he can't keep the dog from getting out, s/he can get sued if that dog attacks again. These dogs are extremely dangerous when the owner don't have the dog under their control.

    As soon as they said "He was at the dog park" I rolled my eyes. There is no way I would let my dog loose in a park with three pitbull mixes in it! Especially when one irresponsible owner is giving treats to them.

    I'm with the judge. I never go to a dog park, never let my dog meet others and never let people pet my dog. My dog is my dog. Not for anyone elses entertainment or joy.
    Watch your OWN DOG (or child) and keep your dog on a FUCKING leash.

    Can't find fault with someone bringing 3 dogs by themselves and one gets brutally attacked?? That's ridiculous at least she's responsible for not being able to stop an attack if one occurs with this many dogs of a known aggressive breed it's not going to be the last time they attack I guarantee it.

      It's not only an " aggressive breed" that you have to Worry about dogs or animals they are all capable of attacking. It's not their fault, they are the type of dog they are, and they're born that way, I wouldn't take three dogs to a dog park By my self. In fact I don't take my dogs to a young park that's just asking for trouble .we have 4 and they don't need any other dogs to play with.

      @@mikesteele05 it's not legally relevant to Judge Milian because she's biased there's been other cases when she's found the defense liable for the exact same thing and there's no way to control them if something happens if this was litigated in a real courtroom she would have been held accountable for at very least half of the bill if not the entire thing I've watched almost all of the people's court episodes even before Judge Milian was the judge and she'll just decide a case based off of something really stupid sometimes and she will change her mind thinking no they are not at fault but then again if this or that happened......had he brought up the fact that her bringing more dogs than she could ever have under her control if something were to happen WHICH IS THE LAW and deciding to be giving food near another dogs mouth that might have swayed her opinion she has literally found others guilty when they did not have a dog who has bitten before the incident in the past and I don't think she made a rational logical decision it's my opinion and I believe a real courtroom would have agreed since you are responsible in most places for all bites caused by your dog.

    the negative pitbull comments kill me. i’ve literally seen other breeds get and or be just as aggressive as a pit can be. Pitbull or not, the plaintiff should’ve been watching and close enough to his dog to prevent something like this from happening.

      Unless the state they live in has a strict liability law, you’re agreeing to the risk when entering the dog park. Any case like this I’ve seen on here unless there is that strict liability law they lose

    I would NEVER take my dog to a dog park. It’s not IF a fight occurs, it’s WHEN a fight occurs. Dog owners usually are not paying attention to their dog when they are at the dog park either. A dog park is an open environment, your eyes must be on your dogs the whole time. Every time you go to a park, there’s a 50% chance a fight can occur. There are other ways to socialize your dog without going to the park.

    In Florida, dog parks are strict liability. If you choose to expose your dog to the risks of a dog park, the financial burden of any injury to your dog if it’s in a fight is your responsibility. This is to reduce court cases of this type, according JM.

    This is not going to be the first attack by these pit bulls (I actually wouldn't be surprised if this was the first attack). Littermate syndrome is a very real behavior issue in dogs (and no the dogs don't have to be actual littermates). Littermate syndrome occurs when you have 2 dogs (or more) raised together as puppies. This woman is absolutely insane to have taken on 3 pit bull puppies of all the same age. Their behaviors will get worse as they get older. They also are more likely to attack one another as well. She has no idea what she is doing. She isn't responsible for this man's vet bills, but she is definitely not intelligent.
    Having said that, dog parks are bad ideas. It is not in a dog's natural behavior to go to a big open area and meet up with other random dogs they have never met before to "play". That is not normal. If you want to take the risk of taking your dog to the dog park, you should be prepared for potentially dog bites, attacks, communicable diseases (viruses, kennel cough, parasites, etc), etc. There are risks to your dog taking them to a dog park, if you don't want to deal with those risks, don't take them. I never take dogs to dog parks. Nope.

    1st mistake was bringing treats for her dogs at a dog park that has several other dogs that will want the treats! 2nd the Plainiff was negligent for not keeping his dog in eyesight view and for being solely on his phone. This could have been avoided if they both used common sense

    All these pitbull cases just absolutely BLOW my mind. I knew growing up that a lot of people would be shocked we owned pits. I know they'd say they're too agressive and I never understood that. I had pitbulls all in our family and we had 2 personally in our home. One female first and later added a male. Nothing like this ever happened. They loved strangers and were always just like all our other dogs. And the same went for other dogs too. I really believe this has got to be poor owners. I just don't get it.

    Don’t get a dog without understanding the breed and their specific needs and make sure you can give them those needs because if you don’t the dog will act out. They’re just animals. They don’t know any better than to just be animals. They aren’t meant to be neglected or just be pet and fed. That being said pit bulls and huskies are the best dogs in my opinion! Great companions when you train them properly and give them what they need (I.e. exercise, socialization, etc) 😊

    Pitbulls should be under a Dangerous Dogs Bill. They are very erratic, jealous and vicious dogs when they attack. Do your research.
