Avoid liability and lawsuits with your drug testing program. Eliminate these top 5 mistakes employers are making in their drug testing programs. Be proactive and manage your drug testing program properly.
No Program, no company policy about drug testing. You should have a drug testing policy. What happens when your employee tests positive? This should be a written policy.
Not using a Medical Review Officer (MRO) to review all laboratory drug test results. This provides an independent set of eyes on your results. The MRO is quality control and rules out legitimate medical explanations for positive drug testing.
Mingling DOT and NON-DOT drug testing. These should be separate. DOT drug testing is mandated by the United States Department of Transportation (DOT). Use the Federal custody and control form for DOT testing and the Non-DOT or forensic custody and control form for Non-DOT testing. The DOT test is authorized by the Federal government, the Non-DOT test is authorized by your company policy so make sure for Non-DOT testing you have a company policy.
Not handling marijuana issues properly. Have you addressed medical and recreational marijuana in your drug free workplace policy? You need to have a policy regarding medical and recreational marijuana. Your company leadership must make decisions regarding legal marijuana.
Who is in charge of the drug testing program, has this person been trained in the drug and alcohol testing process? Is this person engaged in the process? Often called the drug testing program manager or the Designated Employer Representative (DER), this person must be involved in the program, they must be engaged and be educated.

The test ye I agree 😂I'm an adult I should be allowed to make my own choices in life in my own space what's it your problem for. But you get people having four hours sleep probably more dangerous than a guy smoking some weed at home after work by the way
In house drug testing should be banned. Send your people to a clinic for privacy.
I tested positive for THC urine and was fired. I immediately backed it up with a 90 day negative hair follicle test. They didn't care.
It wasn't until I spoke to co-workers who were hired on November 2023.
When the in-house nurse did their tests, they physically watched her test their specimen. One tested positive and have a script showing it was allowed. The nurse said since she tested positive, her test goes to a lab.
The other tested negative inhouse and was told it was fine.
When I did my in-house test, I never physically solved the nurse test it. I handed her the cup, I turned and washed my hands, and when I turned it back around she already had it into a smaller tube with the lid on it and putting a sticker on it.
She told me tests are being sent to a lab. I commented, "oh, that's new" and didn't think anything more about it.
I don't know if I tested positive in house and that's why she sent it out.
I don't know if I tested negative and she did something to my test??
I just know I got a call from some random lab on the other side of the country telling me I tested positive for THC and if I wanted to retest I'd have to pay $200.
I tried to fight it, but they tell me go anyway. Perfect employee for 5 years. No in fractions, no disciplinary issues, no attendance problems, volunteered for overtime 3 weeks a month. Bettered myself by learning two other departments so I could be cross-trained in three departments. Well liked and respected from co-workers, peers, and upper management.
I'm still in shock and I fully believe that I will be mentally messed up for a long time.
My employer has 3 options if you fail. It's up to them to decide which option will be given to the employee.
Heres what we are all saying when asked; Anti mj propaganda is as offensive to me as the nword. Please refrain from treating me different because I partake. I consider this as well as testing or asking about it a hate crime.
