Have a question: I have diabetes and in 2020 Metformin was recalled because of cancer causing carcinogenic material (causing i.e. bladder, liver cancer) was in certain batches. I was sent letter from VA to discontinue the metformin I was taking because it was one of the lots that was recalled. In 2023 June I was diagnosed with bladder cancer. Can I file a claim with the VA since the VA provided me with this prescription?

Worked as a VSR for a few years after I retired. I remember showing the rater I was assigned to the buddy statements. She looked at them and said she never believed them they lie. I complained about it. Because she was affecting lots of veterans. I ended up getting moved to a different rater. She ended up getting promoted to DRO. Never served a day in her life. Oakland RO

Great video and information Dewayne. I wrote my personal statements exactly as you described short enough not to drag it out but just long enough describing what condition(s) I was claiming as well as correlating symptoms. If I was claiming a secondary condition for an already service connected condition I would also include medical articles and reviews on how it was connected. This was just my rational and not advice from someone else’s experience. Not sure how much it helped but it apparently didn’t hurt my claim as they were all granted after positive c&p exams.

Loses credibility for many of us. Reminds me of reaching out to a company and they send an auto response that only correlates to the first sentence they said, but after that it has nothing to do with the original statement.
First thing I watched this a.m. Good stuff! Submitted an intent to file for increase on two 0% service connected and an increase on one 50% secondary. Good morning DeWayne! I just received my HLR back from the VA and they said I’m in a “Duty to assist error” it must be a VA ERROR. I’m set up with another C&P Dr. appointment. Reading the letter sent, looks like I am going to get all four things claimed on my HLR. I guess the C&P appointment is just a formality. Thanks again for all you do! Keeping us informed! ’m retiring from active duty, I hit the 6-mo mark soon and plan to file a BDD Claim. But I have a couple questions… 1) If I claim something on my BDD that is not in my medical records… will it get automatically denied, or will they schedule an C&P exam to verify? 2) When filing a BDD claim online, does it allow for personal statements on each item? 3) I already have my medical records… and there’s not an obvious list anywhere that says “List of diagnosis”…. I have 800 pages of records, most is just appts… how do I know what counts as a “diagnosis”? 4) since I’m doing a BDD and still on active duty… do I need to relate conditions to my service… is a Nexus still required for son thing like GERD since I’m still on Active Duty?

GOMAB FRAT! I messed up really bad. I was awarded 70 percent initially and my MDD symptoms increased and awarded 80% last year. I then filled a claim for secondary sleep apnea with my MDD due to VA stating I have sleep apnea. My initial ratings were for MDD and atopic dermatitis. The VA sent a letter in December stated an error in service connection due to me being in the guard/ reserve. My C&P exams verified strongly about my diagnosis. I am freaking out and have had suicidal ideations off an on the past two months. I have lay statements from fellow soldiers and my wife. My counselor, psychiatrist and dermatologist are concerned about me losing my rating. My civilian records are gone due to Alabama not keeping medical records past 9 years. The VA wants new and relevant evidence. My VA medical records or DD-214 has little evidence. I scheduled a predetermined hearing last month. I would be in a financial crisis if they take away my compensation and I am scared that my MDD will worsen to suicide. On the shield MAB what do I do???!!!!

Dude, I feel for you as a fellow Reserve veteran. But you have not shared any information that's helpful to be able to give advice on. WHY/WHAT are they saying is the reason??? Were you initially rated as disabled during Active Duty Training? Weekend duty? Deployment? Driving to a drill weekend? If you had in service evidence of a disability that was documented in your STRs that happened during Active Duty Training, for instance, then there would be no reason to sever your rating unless fraud was committed. Need more info please. Best, John

If a personal statement is one page, is that too much? I'm trying to tell when & what base my symptoms originated, hit on what symptoms I have, how they have negatively affected my quality of life, and how the claim, compounded with other medical conditions that occurred while in service have left me incapacitated.

@DewayneKimble the thing is I had a prior foot injury neuropathy made worse by non freezing cold injury. I went to Cape May NJ in wintertime. I'm native Floridian. My question is I received an honorable medical discharge doesn't that show it's most likely service connected? I never believed I was a vet until couple years ago so this is why it took so long to file. Over the years I have tried medications and therapies and treatments nothing has helped . It was a retired marine Colonel that explained things to me is when I filed. I'm a coastie.

When I say "They" pretty much everyone i have talked to on my claims repeat the same things. If its in your military or VA medical records YOU DO NOT NEED to submit it again because they have it and will review it as part of your claim. So I'm confused now if they do or don't, if it is or is not their job etc. But every VSO, C&P when I spoke to them on the phone, Same with QTC And in the beginning before knowing how to start , any VA admin staff (I know better now) I asked at a VA hospital in the beginning when i was trying to figure out the basics of how to start and support a claim before filing. Many times on the phone or in person with several of the aforementioned individuals. Also a former (retired) VA claims rep, such as yourself, who was at one time a member of my American Legion. This is why I think maybe we should all submit every supporting document (even those already in the records) every time we submit a claim with a cover sheet telling them each item of support in the medical records and highlighting it all,to aid in finding things quickly and effectively in an effort to help them. I get the pressure and backlog and I know everyone is not the same, most do a great job, and some fall behind due to stress and pressure but many things that end up denied should not have, if they were to have time to see more of what's submitted or as they always tell me "no need to resubmit what we already have access to". He was saying they are not going to go through your medical records and find stuff that can be claimed. That part is up to you. When I submitted my claim I knew the VA already had my STRs and VA treatment records so I didn’t submit those again, but I did put together a pdf “packet” with relevant STRs and VA treatment records for each condition so the rater had it all in one place for each condition.
@@BF-27 Everytime I file a claim VA tells me I DO NOT need to include any documentation that is already in my medical VA or military records as they already have access to those. That would be where much of the medical evidence the army and VA have that supports my claim. Even so, I always including copies of everything related to the claim regardless of what they say or if it's new or old pertaining to a claim. Cuts out excuses of "we didn't see or find enough supporting documents. He also warned us about raters ignoring actionable DBQ's so it's up to us to keep submitting and appealing as needed.

I submitted a claim for increased PTSD. I am currently at 80% total. My symptoms have gotten worse. Meds have doubled, therapy etc. I was denied. I appealed. They sent me a letter stating their was an error on THEIR part. Claims rep didn't reference my medical records when they denied me. I was notified of that in April 2024. So, I have essentially been on hold since December of 2023. I received a letter today , 7/2024, stating they are still reviewing my claim. Any suggestions?
Yes, look at the next higher percentage for that condition and see if you meet the criteria and if you do, do you have evidence and are you able to explain it. I'm 61 now, wondering you can get a claim, if had a pre existing condition before service, never was brought up in service or went to sick call about it. It has always been severe enough fir limited motion in joint, x rays could prove injured at 16 years old. Only have a letter to parents stating feelvon that joint, had PFT next day and thought about going to sick call, to get out of the PFT. I don't think I did. Stillnhave painnand loss of motion.1. Could a statement like this get an exam? 2. Is this letter considered a nexus letter?

Dewayne, I am submitting 3 secondary claims all related to PTSD and MDD. They are all due to conditions brought about the years of Docs experimenting with different drugs and cocktails of DrG’s to get me some improvement to nightmares, self isolation, suicidal ideation, depression to the point of sleeping all the time, etc., etc. I am a little confused after this video. My understanding was that I needed a 21-256ez. It sounds like I can put them on 1 21-256ez, and do 3 personal statements on 3 different 21-4138s. How terribly confused am I?

My injury happened outside of military service while being an active reservist. I fractured my tibia and fibula and permanent and stationary disability and though turning the documents to my unit I was still performing training and conditioned worsened during the service, would this still be something I can claim?

Isn't the person in example 2 allowing the VA rater to state that his/her issues are not military-connected? When I got out in '96, the VA denied my claim on Asthma which I was diagnosed on active duty. I noted that I had hay fever when I joined. Then a decade and a half later, when filing a new claim, they reversed that decision as asthma and hay fever have nothing to do with each other. I got paid $23k in back payment. I used it to get out of debt and stay out.

I call the hotline today for a status of my BDD claim. They said it was awaiting decision but they can’t make that decision until my official retirement date of 31 Jan 24. Does that sound right, because what’s the point of starting 6 months out to have them sitting on it for 2 months

By regulation, statements are considered evidence as long as they are credible (which they are unless you give them reason to doubt your credibility). If a rater ignores your statement you can bring it up on appeal. I’ve read lots of BVA decisions where denials were overturned because of personal statements, buddy letters, etc.

Have a question: I have diabetes and in 2020 Metformin was recalled because of cancer causing carcinogenic material (causing i.e. bladder, liver cancer) was in certain batches. I was sent letter from VA to discontinue the metformin I was taking because it was one of the lots that was recalled. In 2023 June I was diagnosed with bladder cancer. Can I file a claim with the VA since the VA provided me with this prescription?

Worked as a VSR for a few years after I retired. I remember showing the rater I was assigned to the buddy statements. She looked at them and said she never believed them they lie. I complained about it. Because she was affecting lots of veterans. I ended up getting moved to a different rater. She ended up getting promoted to DRO. Never served a day in her life. Oakland RO

Great video and information Dewayne. I wrote my personal statements exactly as you described short enough not to drag it out but just long enough describing what condition(s) I was claiming as well as correlating symptoms. If I was claiming a secondary condition for an already service connected condition I would also include medical articles and reviews on how it was connected. This was just my rational and not advice from someone else’s experience. Not sure how much it helped but it apparently didn’t hurt my claim as they were all granted after positive c&p exams.

I've condensed mine to what (condition), when did it happen and subsequent symptoms, how did it happen and diagnosis, and why it should be rated.
I had a well written buddy statement that did nothing for my claim. I ended up getting 100% P&T but it was a rough road. Don’t get discouraged, it’s a painful process unfortunately.

Loses credibility for many of us. Reminds me of reaching out to a company and they send an auto response that only correlates to the first sentence they said, but after that it has nothing to do with the original statement.
First thing I watched this a.m. Good stuff! Submitted an intent to file for increase on two 0% service connected and an increase on one 50% secondary. I’ve been educating myself for the past two months. Retired 13 years ago. Wish I paid more attention to this whole VA benefits thing back then! Good morning DeWayne! I just received my HLR back from the VA and they said I’m in a “Duty to assist error” it must be a VA ERROR. I’m set up with another C&P Dr. appointment. It has been three weeks and still have no explanation letter. I just found out by looking at my va account. Thank you! I’ll look at it. Because they also never did a back exam. GOMAB FRAT! I messed up really bad. I was awarded 70 percent initially and my MDD symptoms increased and awarded 80% last year. I then filled a claim for secondary sleep apnea with my MDD due to VA stating I have sleep apnea. My initial ratings were for MDD and atopic dermatitis. The VA sent a letter in December stated an error in service connection due to me being in the guard/ reserve. My C&P exams verified strongly about my diagnosis. I am freaking out and have had suicidal ideations off an on the past two months. I have lay statements from fellow soldiers and my wife. My counselor, psychiatrist and dermatologist are concerned about me losing my rating. My civilian records are gone due to Alabama not keeping medical records past 9 years. The VA wants new and relevant evidence. My VA medical records or DD-214 has little evidence. I scheduled a predetermined hearing last month. I would be in a financial crisis if they take away my compensation and I am scared that my MDD will worsen to suicide. On the shield MAB what do I do???!!!!

Dude, I feel for you as a fellow Reserve veteran. But you have not shared any information that's helpful to be able to give advice on. WHY/WHAT are they saying is the reason??? Were you initially rated as disabled during Active Duty Training? Weekend duty? Deployment? Driving to a drill weekend?
If you had in service evidence of a disability that was documented in your STRs that happened during Active Duty Training, for instance, then there would be no reason to sever your rating unless fraud was committed. Need more info please. Best, John

If a personal statement is one page, is that too much? I'm trying to tell when & what base my symptoms originated, hit on what symptoms I have, how they have negatively affected my quality of life, and how the claim, compounded with other medical conditions that occurred while in service have left me incapacitated.

@DewayneKimble the thing is I had a prior foot injury neuropathy made worse by non freezing cold injury. I went to Cape May NJ in wintertime. I'm native Floridian. My question is I received an honorable medical discharge doesn't that show it's most likely service connected? I never believed I was a vet until couple years ago so this is why it took so long to file. Over the years I have tried medications and therapies and treatments nothing has helped . It was a retired marine Colonel that explained things to me is when I filed. I'm a coastie.

When I say "They" pretty much everyone i have talked to on my claims repeat the same things. If its in your military or VA medical records YOU DO NOT NEED to submit it again because they have it and will review it as part of your claim.
So I'm confused now if they do or don't, if it is or is not their job etc.
But every VSO, C&P when I spoke to them on the phone, Same with QTC
And in the beginning before knowing how to start , any VA admin staff (I know better now) I asked at a VA hospital in the beginning when i was trying to figure out the basics of how to start and support a claim before filing.
Many times on the phone or in person with several of the aforementioned individuals.
Also a former (retired) VA claims rep, such as yourself, who was at one time a member of my American Legion.
This is why I think maybe we should all submit every supporting document (even those already in the records) every time we submit a claim with a cover sheet telling them each item of support in the medical records and highlighting it all,to aid in finding things quickly and effectively in an effort to help them.
I get the pressure and backlog and I know everyone is not the same, most do a great job, and some fall behind due to stress and pressure but many things that end up denied should not have, if they were to have time to see more of what's submitted or as they always tell me "no need to resubmit what we already have access to".

He was saying they are not going to go through your medical records and find stuff that can be claimed. That part is up to you. When I submitted my claim I knew the VA already had my STRs and VA treatment records so I didn’t submit those again, but I did put together a pdf “packet” with relevant STRs and VA treatment records for each condition so the rater had it all in one place for each condition.
@@BF-27 Everytime I file a claim VA tells me I DO NOT need to include any documentation that is already in my medical VA or military records as they already have access to those.
That would be where much of the medical evidence the army and VA have that supports my claim.
Even so, I always including copies of everything related to the claim regardless of what they say or if it's new or old pertaining to a claim.
Cuts out excuses of "we didn't see or find enough supporting documents.
He also warned us about raters ignoring actionable DBQ's so it's up to us to keep submitting and appealing as needed.

I submitted a claim for increased PTSD. I am currently at 80% total. My symptoms have gotten worse. Meds have doubled, therapy etc. I was denied. I appealed. They sent me a letter stating their was an error on THEIR part. Claims rep didn't reference my medical records when they denied me. I was notified of that in April 2024. So, I have essentially been on hold since December of 2023. I received a letter today , 7/2024, stating they are still reviewing my claim. Any suggestions?
Yes, look at the next higher percentage for that condition and see if you meet the criteria and if you do, do you have evidence and are you able to explain it. I'm 61 now, wondering you can get a claim, if had a pre existing condition before service, never was brought up in service or went to sick call about it. It has always been severe enough fir limited motion in joint, x rays could prove injured at 16 years old. Only have a letter to parents stating feelvon that joint, had PFT next day and thought about going to sick call, to get out of the PFT. I don't think I did. Stillnhave painnand loss of motion.1. Could a statement like this get an exam? 2. Is this letter considered a nexus letter?

Dewayne, I am submitting 3 secondary claims all related to PTSD and MDD. They are all due to conditions brought about the years of Docs experimenting with different drugs and cocktails of DrG’s to get me some improvement to nightmares, self isolation, suicidal ideation, depression to the point of sleeping all the time, etc., etc. I am a little confused after this video. My understanding was that I needed a 21-256ez. It sounds like I can put them on 1 21-256ez, and do 3 personal statements on 3 different 21-4138s. How terribly confused am I?

My injury happened outside of military service while being an active reservist. I fractured my tibia and fibula and permanent and stationary disability and though turning the documents to my unit I was still performing training and conditioned worsened during the service, would this still be something I can claim?

Isn't the person in example 2 allowing the VA rater to state that his/her issues are not military-connected? When I got out in '96, the VA denied my claim on Asthma which I was diagnosed on active duty. I noted that I had hay fever when I joined. Then a decade and a half later, when filing a new claim, they reversed that decision as asthma and hay fever have nothing to do with each other. I got paid $23k in back payment. I used it to get out of debt and stay out.

Is it possible to request the name of your reviewer if a previous claim was erroneously denied? For example, they stated in the denial letter that there wasn't an lod but you can verify it was sent abd received. After receiving my c file I saw it.

I call the hotline today for a status of my BDD claim. They said it was awaiting decision but they can’t make that decision until my official retirement date of 31 Jan 24. Does that sound right, because what’s the point of starting 6 months out to have them sitting on it for 2 months

I just received a deferred rating for my PTSD claim, reason states, examination. I had a nexus letter from a psychiatrist when submitted my claim and VA never scheduled me for a C & P exam before giving that decision. Is this normal?

As a former rater, guess what you are wrong. I'm assuming you know each rater. There are a few bad ones out there but you can't say all are bad.
By regulation, statements are considered evidence as long as they are credible (which they are unless you give them reason to doubt your credibility). If a rater ignores your statement you can bring it up on appeal. I’ve read lots of BVA decisions where denials were overturned because of personal statements, buddy letters, etc.

’m retiring from active duty, I hit the 6-mo mark soon and plan to file a BDD Claim. But I have a couple questions…
1) If I claim something on my BDD that is not in my medical records… will it get automatically denied, or will they schedule an C&P exam to verify?

3) I already have my medical records… and there’s not an obvious list anywhere that says “List of diagnosis”…. I have 800 pages of records, most is just appts… how do I know what counts as a “diagnosis”?
4) since I’m doing a BDD and still on active duty… do I need to relate conditions to my service… is a Nexus still required for son thing like GERD since I’m still on Active Duty?
