      Great information! Question....when completing the 526ez section v: Claim Information...current disability, column 2..if due to exposure, event... column 3..explain how this relates to in-service.....column 4..approximate date....Dewayne...my question is... How do you complete column 2 and column 3 if you have a current diagnosis for Bilateral Knee Pain and your Service Treatment Records show you went to sick call on Active Duty for Bilateral Knee Pain in 1992. Current Disability would be "Bilateral Knee Pain", what goes in column 2, column 3 and column 4? Thanks.

      If a veteran is denied VR&E in May of 2024 after applying for it in February of 2024; then requests their C-File in June of 2024 & still hasn't received it despite filing numerous complaints & despite dwindling time to respond to the VR&E denial; What are the veterans options to have the C-file expedited to their current residence?

    I work for Department of VA, Washington DC, we don’t even have a space to return too, - we got the offer letters. We work hard for the veterans. This will hurt the veterans.

      Same and I agree!! These guys have been through a lot, and sacrificed a lot for our country. I love the work I do, and if I have to return to the office to do it I have absolutely no problem doing so. I’m just afraid that if we loose staff our vets are going to suffer.

    I work at a VA and they’ve told us we can’t take the “buyout”. There are a lot of nervous folks, but the people who are going to suffer the most will be the Veterans we’re already struggling to serve. God help us all.

      maintain pride of what you do. Like any job, people become upset with change and the urge to slow down becomes a reality if YOU allow it. Nothing to be "nervous" about, the veterans won't suffer if everyone at the VA does what they were hired to do.

      Yes VHA is exempt due to essential only if you are in the retiring stages. Please go to your town hall meeting,

      I work for the VHA, and I took the deal yesterday. I am also going through the process for FERS Disability Retirement and 100% P & T. For me it was a win/win to take the offer. I'm vested with a little over 16 years federal service.

      ⁠@@paulenglett4824Good luck! They’re thinking of taxing va benefits or trying to make us take a means test. Hopefully it won’t lead to that. Also it’s a resignation not a deferred retirement so be careful you can lose all your retirement benefits if you resign instead of really retiring, even if it is a disability one. Hopefully I’m wrong on this.

      Good you brother. I got 70% after a 11 year wait on the board of appeals last November. Then applied for a higher rating percentage. And got another 20%. I was extremely lucky to get the 20%. Be careful apply for a % raise. I found out later. I could have been reduced. If I knew that. Inbound still be rated at 70%. It was all for spine, lumbar hips, and knees. But I am now under the 10 year rule. And have board of appeals claims still in that are since 2011. And filed new claims. Keep pushing those secondary condition. If you do go to the board of appeals and win like I did. And win. It will yake forever, maybe. However, I was paid in back pay over $200,000. So keep fighting. That's what I have always heard to do. I did but it took me a long time. Congratulations 🎉🎉🎉🎉🎉

      Took me 2yrs to get to 70%, working on the 100% club now, i filed 3 new claims with in a month of getting 70% and now im working on 3 more claims to be ready to go in 3 or 4 months if those 3 dont get me into the 100% club! Plan and work your plan with your Dr? I have a Dr if you need one in FL, you can work by phone you know, lawyers are your last resort, they really dont win claims either if you dont have nothing to argue with?

      @ it sucks seeing its the same for all of us but I have to say that regardless of MOS, branch or time in service the veteran community has and seems always will be literally just other vets helping each other not for money or attention but outta love. Much love and hopefully one day the young vets will have to listen to our horror stories and not be able to relate.

    I worked at VA and was tasked to clean a building which was meant to hold 350 employees but after covid there were about 20 in the building on any given day,made it sweet for me but definitely a huge waste of tax money

    The Doug Collins confirmation hearing was unlike the others. He actually answered the questions and was very pro VA. Unfortunately, by association I don’t feel that any of these people can be trusted.

    I take exception to “return to work”. It clearly states “return to office”. RTW infers remote employees are not working. Some may not be and should be targeted. Most are working and should not be maligned.

    Brother. I was IT,2210 at Canadaigua ny VA. 10 years ago i suffered a mental collapse related to my military experience, caused me to be on medical leave. My boss filed me as awol, he had a grudge against me due to my complaining to the afge union (was a member) about hostile work conditions he was creating for me. I was medically messed up badly and did not recover for a few years. They fired me for AWOL evel though i have complete medical evidence, in fact im STILL not cleared by my doc to return to work. Was never even given an opportunity to resigned even though i was tenured and union. To this day simply thinking about the situation os dangerous for me. What would you do?

    What does it say that people are hoping and cheering for people to be laid off from their jobs? Why do I care if a person works from wherever? As long as the job is getting done. Working from home has become a wedge issue. VA benefits has become a wedge issue. Veterans have allowed themselves to become divided. Its the old divide and conquer.

    Good advice. Expect delays now, take the time to submit all claim documents together. I'm a Rater who was hired as remote worker, can't do a daily commute of 4 hours. I'm out.

    Yes, it is the same email Musk sent out when he bought Twitter. Most of the Twitter employees didn't see a dime, so they all had to file lawsuits.

      Federal law states that once these people resign, they will no longer be paid. The law does not allow them to sit at home and still collect a paycheck if they are not doing the work. Only Congress can provide the money for a buyout. The letter said that if you accept this but out, you will continue to get paid until September. Not that you will continue working until September. And these are civil service employees, not appointed employees. So, Congress sets specific laws governing how and when they get paid.

      @ Musk didn't; the minute the employee signed the agreement, he removed them. Most of them never saw a dime, and most of the employees did not wind down. It was all a lie. Musk told them to sue him.

      So if any VA personnel opted for the buyout, then in theory it would extend times on claims for instance correct? If a person working on a claim decides to leave, does that claim just go back to the cloud?

    I’m a federal employee. We only have ourselves to blame for this lazy image we portray. Movies and sitcoms don’t help either, just watch Parks and Recreation.
    My only problem with that letter and its wording is that I have to be lumped in together with everyone. I’ve already been following those 4 stupid piers my whole career.
    If you feel you’re a good worker and not a F-off then you have nothing to worry about.

    No federal employee should take that offer up. It is a scam; the money is not there even to pay the buyouts. Only Congress can provide the money, and they are not going to do it. Once people take them up on the buyout, they will be told, "Sorry, we made a mistake, and you won't get a dime."

    What is the reason for the long delay to get an appeal hearing? I had my appeal hearing on 9/13/24 and was to by the law judge I would get my answer by the middle of January and here we are the 1st of February and still no answer. What is going on

      A Compensation and Pension (C&P) physical examination will be conducted using the Disability Benefits Questionnaires (DBQ) for each disability claimed. This guidance (DBQ) will help individuals understand how to prepare for the examination and what to expect during the process (C&P). For example, in one of his videos, Mr. Kimble explains that the DBQ for a C&P knee examination should measure the degree of flexion and extension using a goniometer.

      I have a DBQ schedule next week for sleep apnea/hypopnea. I had a local VSO submit my claim for sleep apnea hypopnea on 01/22/2025. I was physically assaulted hit in the face several times with serious facial injuries from another service member back in 1982 on a 3 week field exercise. I was treated by our local medics . I did not go in and see an Army Dr. My Company Commander and my wife recently wrote a Supporting Lay Statement. I was notified yesterday by Loyal Health Care to report for a DBQ next week. Is this a normal process for a DBQ ?

      @ Have you been contacted by the VSO who filed the claim for you? I think it is normal to have a C&P conducted by the VA for disability rating purposes, but you should contact the VSO because I believe they receive a copy of everything the VA does with your claim. I have heard of some veterans who required a sleep study, but it may be different, depending on the individual circumstances.

      The production metrics cause claims processors to work these very complex, detailed claims at break neck speed just to make your production numbers. It is 100% not conducive to consistently putting out a perfect, quality product - try as they might.

    I got a ticket via snail mail for running a red light. A camera caught my car in the crosswalk on a red light, snapped a picture and decided on a guilty verdict. I insisted it wasn't me and I refused to pay it, I didn't even have to go to court, the infraction was dismissed based on me essentially saying screw you. I then read an article that a high percentage of people simply pay the fines without disputing the findings or putting up a fight and that panic is what they count on to get people to quit and pay up. That letter going out hopes to catch a healthy percentage of marginal employees willing to take a payout, most of who would never lose their jobs from downsizing.

    I've had everything possible sent in to the VA including my form 9 then they come up with this Nexus Letter crap and the fact that i have to keep on going to the C & P examiner Mendelson who wrote something about my damned shoes that caused my bilateral foot condition which i referred him to the VA Law judge as a quack doctor. What magic trick do some of veterans need to cast to get our benefits? I've had a fully developed claim for years What's the hold up for my benefits?

    I actually can't wait to go back to the office. From home, I work from 5am to 7pm 5 days a week. I'd rather just drive into an office and do my 8. Plus, I've gained 30lb working from home in 3 years. There's also a gym right across the street from the federal building and I will be joining it back to the office on day one. I used to get my lunch workouts in and also after work. Working from home, I'm watched like a hawk with MS Teams and constant requests. That will stop when I go back to the office.

    I’ve been waiting for almost a year waiting for VA to recognize my wife and kid. I’ve called the hotline too and they couldn’t help me. I’m scared it’ll never happen.
    This is also the second time I’ve submitted,too.

      @Edge5055 yeah they got the paperwork for me on 20 July 2024.. she already has her dependent cac card via deers and shows as my spouse. Sent them an apostilles for the marriage license... and still it sets at step 2 of 5 since 20 July 2024

      DEERS has no real bearing on having a dependent added for disability compensation purposes. If there is an EP130 pending for you, it will be worked typically on a first come first served basis. If your dependents can be added you will be paid retroactively from the earliest possible date.

    I'm a clinician at the VA and I spent the first 18 years in my career in the private sector. I've never had more rigorous standards than in the VA. Also, I'm just gonna be very frank, you cannot say that you support veterans and support the actions of this administration. It is already harming the veterans that I serve, and it is only going to get worse

    They are making it harder to get your ratings. They are making changes so that "successful treatment" grants no or lower ratings.
    Next is to remove payments below a rating level. My guess is payments will start at 40 or 50% and TDIU if not gone entirely will be much harder to get.

    I’m sure the recent report of the orgy at the va in Tennessee by employees didn’t help matters, and it’s interesting that for the past 4 years illegals coming across the border got approved for everything but somehow a overbloated over budget VA takes years to approve a veterans claim, if the government was smart they would just would just automatically approve every veteran at 70% to start their money and medical care going and then from there adjust it up or down based on findings

    A legal accommodation is something that is granted to a worker through the Americans with Disabilities Act, which allows people with disabilities to work. So, for a veteran with PTSD, remote work might be the only way they can maintain gainful employment. Employers are required by law to provide disabled employees with reasonable accommodations as long as the accommodation does not create undue hardship for the company. Failure to accommodate or violating the terms of an accommodation is considered discrimination, which is a violation of federal law and depending on the state could be a violation of state law. I don't know how this would work for the federal government because I'm not sure who gets to decide what accommodations represent undue hardship and who would be impacted by that hardship.

      You're absolutely right. I just received reasonable accommodation for full time telework a month or so ago. My Agency, and I'm guessing all, has a reasonable accommodation team/staff within their EEO office. It's kind of hard for any agency to claim undue hardship by allowing someone fulltime telework if they've been teleworking since April of 2020. You have to have your doctor fill out a form specifying your disability and answer some questions as to why it requires full time telework. At my Agency, there is a medcail review team that reviews the doctor's letter and makes the decision if full time telework is appropriate.

      I have no issues with the VA, I dropped my private insurance, appointments took 2-3 months to see your primary care, a 15 minute limit on Dr visits, specialist referrals are few and far between. Dr’s whose bonus is decided by the fewer the specialist referrals, fewer lab tests, the higher the bonus, no thanks. It needs to be a hybrid system, let the Veteran choose.

    Folks are always saying that Veterans deserve better, should be getting this or that...well now you see what government thinks of veterans. Don't complain to the folks who have boots on the ground serving veterans, they are not decision or policy makers. If you want your voice heard contact your states senators and representatives. Voice your onions loud and often on social media. Flood their social media until CHANGE HAPPENS, not promised BUT HAPPENS.

    Question piggy backing off the workload topic. How do raters (and the evidence reviewers) get their workload (does it come to them as a physical work packet, an email or do they take it from a pile in an office, etc). And when they get their claims to review do they know if its a Fully Developed Claim as soon as they look at it? Mainly what i want to know is what are the odds that the VBA will start grabbing at the FDC in an effort to keep the appearance of staying on track high since the workforce will be reduced.

      @tjpont2149 I'm an RVSR. We have an online work queue. Claims are assigned to us automatically by a National Work Queue. We are directed to work the oldest claims first - unless there is some priority processing in place (i.e., homeless, etc.) The issue of FDC, while theoretically will speed the process of making a claim ready to rate, it doesn't have much of an effect once it is with the rating board. At that point, again, we are directed to work the oldest claims first.

      When I rated, they where assigned by the supervisor. Yes, when you start the review, you can tell if it's an FDC. The oldest should get worked first but that is not the case always.

    The NEED for most to work from home is not there anymore. I work at a military base. If I walk into personnel office, there is no one to help me. They're working from home so how does that work for me? They need to be at work. I have to be there everyday so should they.

      @@royharper2003 I can tell you as a federal blue collar worker who retired last March, that it made our job much more difficult because the people that we needed to support our work were working from home and would not return phone calls or emails, sometimes for weeks. It has nothing to do with jealousy or envy. They were simply not doing the work they were supposed to be doing.

    I believe this email was directed at people working remote which was started during covid. Uncle Joe, before leaving office, gave everyone the option of working from home forever. Well, the new Sheriff in town says if you want to keep your job, get your a$$ back in the office or resign by this date or else! You may be missing the intent of this email. I agree that people should be sitting at their desks in an office to do their work. An occasional WFH day is OK, but not permanent.

    Dewayne thank you for this information. I am currently waiting for a decision from HLR for mental health. I want to file for sleep apnea secondary to the mental health if I am granted. But since sleep apnea could be changing soon, and the way things are changing, should I just file it secondary to my tinnitus? Do I stand a chance? Thank you sir.

    The letter had to be offered to all federal workers. Otherwise, discrimination and equal opportunity violations. It is an offer….take it or leave it. There has been no changes yet….if any. No harm. No foul. I’m getting a kick out of all the dooming, paranoia, and conspiracy theories.

      I'm a federal employee, and due to retire in August from my GS- scale job. Not taking this buyout. Too many unanswered questions, with no one in CPAC unable to answer them. NO GO for me. I'll wait.

    I'm a retired vet and i work for the VA currently and i think this will be a good thing. The va has way too high a % of people that are not doing what they are supposed to be doing and its being reinforced by a very corrupt government employee union. Its time something was done cause if these people conducted themselves at a Non government job like they do at their government job, they would have been fired long ago. I see it every single day. If this helps to root some of those people out, then that's a very good thing for us vets. You know very well what i am talking about cause its in VBA also (i have friends working there currently) so you have seen this "government employee" mentality also.

      you know there are some very committed people at the VA. i’m sure you are one of them. I fear these cuts care nothing about actually improving care and really just want reductions any way possible. that means we loose good people with no replacements.

    Here is what I can say. I’m neither pro or anti work from home. I get both sides of the argument. However I will say this. I filed a claim dec 17th. While I’m still waiting on one issue to be approved or denied. I have been bumped in rating twice. One before December was over. And again on the 29th of Jan. People are obviously working. Specially since I was told I would have to wait month to get my claim revised and through the process. If it’s not broke don’t change the whole operation. Make some tweaks. Just my 2 cents!

    I've been waiting for my claim to even been reviewed early last year. The answer I keep getting is that they have been backlogged for over a year. So, it's been backlogged, since, Biden was in office. Maybe making people go to work and making the VA accountable for their mismanagement of funds will be better for veterans in the long run.

      @DewayneKimble No, it wasn't. I was talking to someone on the VA hotline on several different occasions. I'm already 100% rated. My claim was adding one of my dependents. They literally told me over the phone that they were backlogged for over a year. This was in the summer, the fall, and towards the end of 2024 that I was told that. I looked at my claim and it hasn't even gone to a reviewer. So, again, making them go back to work and stop the mismanagement of VA funds will help veterans in the long run.

      They need to evaluate employees based on the number of claims employees process correctly instead of assigning points to tasks. But that's not going to happen. Current standards will increase and the work will be more of a mess.

    Taking a year plus for a veteran to receive an award is unacceptable. I dont doubt some work hard, but thats not the truth for all employees at the VA. Change is long over due. There has to be a more efficient way. Maybe this is the shake up they need. God bless

    you mean after years of waiting for claims and appeals it might take longer? Why did it take that long to begin with? Maybe changes will increase efficiency. People here talk about the possibility of the veteran suffering....We have been suffering with extremely slow progress. I welcome the change, and I know this isn't popular. But veterans shouldn't suffer any more than we have been. Efficiency improves with direct supervision and Pride of job will help overcome any obstacle.

      There are many reasons why claims take so long, training of new VA employees, vets sending in a ton of evidence that takes time to review.

      The change you welcome will delay your claims even further. Be careful what u ask for. The claims are taking longer to process bc va has a much higher volume of claims to process due to PACT act claims and not a big enough budget to hire enough ppl to process them timely right now. With the decrease in workforce it will now take longer than before.

    Unlike Twatter , GS have legal protections and rights. And OPM should never go direct to employees, bypassing D/A HQ and HR offices. I think the massive lawsuits being filed will have to be resolved. Any govt program relies on legislation that grants funding and authority. The Executive branch is NOT the legislative branch and interfering with legally appropriated govt funds is a Crime . Musk does not hav the authority to, and EO are NOT laws, only policy statements. Musk and crew are racking up felonies by the hour. If congress authorized your billet and gave funding to,pay for it, on,y Congress can modify or unfund .eliminate that billet. Same for dept/agency, on.y Congress can stand up, fund, man and reverse. There are many legal entanglements and authorities. Again , only Congress can stand up or decommission depts/agencies. So this is all political malarkey. The USG does not operate on calls or emails, on,y signed dept letterhead signed by a duly authorized official .
    Any GS who replies is committing a dangerous and possible illegal process perpetrated by DOGEChite. The GS unions are having a field day filing suits

    Regarding reasonable accommodation employees every morning. I go in except for Friday, but even Friday. Sometimes all the handicapped spots are full. So in my opinion, they tend to go to work every day. Not only that, but this week at 08:15, there were no handicapped spots left!

    I’m currently at 90% (94%) have a claim in for plantar fasciitis (hopefully get me to 100%) my renters stopped paying rent in December, I can’t pay my mortgage without it, nor the rent where I live. I filed for “priority processing” but I have no idea if it will go through out if I’ll get an additional 10%.. I’m screwed without VA.. hell I’m screwed anyhow. 😡

      I’m 90% flat have a claim for sprain ankle in service, had C&P with X-rays showing bone spurs consistent with plantar fasciitis claimed Les Plantes tho, and pact act sinitus and bronchitis also claimed diagnosis while in service based of tours in SW Asia. I’m currently on waiting a rating step after 2 months since filed. Hope it works out for you praying for you Vet. 🇺🇸🫡

    If they want all employees gone then just give them all early retirement regardless of age and years in the federal workforce. Then you will not have to break laws and be shady about it. I seen postings online of the email and it seems unclear and leaves lots of questions. If you offered what I said I guarantee all would jump on that offer with no complaints and no fighting it. Come on at least make it easy on yourselves. Offering not even a years salary, maybe 7 months administrative leave and no promise of retirement when of age. No one is going to do that. Most have worked years for the retirement. Why would they just give all Thacker years up? Do you think they will be able to go get other jobs that will pay well at 40, 50, or 60 something years of age if they have worked their entire life in the federal system? No they will not be able to.

      @royharper2003 youre vested into a partial pension at the VA after 5 years. So after 10-20 years you are not going to "piss away your pension" since you already qualify for 10-20 years worth of a pension.

      @ It won't be much since the longer you work the higher you're pension and people will be resigning so they will probably just get a lump sum of their pension contributions, not an actual monthly pension payment as they would if they retire and retiring before MRA or 30 years of service comes with penalties that greatly reduce your pension.

    Mr Kimble… if the VBA can’t even do the simple admin changes in a timely manner, what makes you think they will be able to do anything else any better? They are taking MONTHS to get simple administrative changes and paperwork processed. That is UNSAT! If they can’t get the simple things done right and on time, they cannot be trusted PERIOD!

      @ sorry. Will never believe that to be true. If it were about actual disability claims then maybe. But, completing simple dependent changes? How many people does that take? If your private medical insurance took 8 months to add your newborn baby (and you got the medical bills to pay since they weren’t added) would YOU be ok with “I guess they don’t have enough people?”
      Bottom line is that they need less EXCUSES and more WORK being done.

      Every claim is different, I've had to take 4 hours to look at evidence that was submitted that didn't have anything to do with what was being claimed. There are several issues that causes long wait times. That's why we have to educate each other on this process so we know what to do and what not to do. There is not one federal agency that does anything fast.

      @ respectfully disagree. All the evidence needed to complete my dependency change (not addition… a change) was on the form that was submitted. Outside of a simple phone call to verify its validity there is no other “evidence” needed. Also, the exact same claim with another dependent took 72 hours to complete in 2023. You may be thinking this is a disability claim. It’s NOT. It’s a simple administrative changes PERIOD. No acceptable reason it should take this long. It’s ridiculous!
