Immigration attorney, advocate speak about Iowa law being challenged in court

    Winger argued the case before U.S. District Court Judge Stephen Locher on behalf of the plaintiffs: the nonprofit Iowa Migrant Movement for Justice and two Iowa residents who would be subject to criminal prosecution under the law making "illegal reentry" a state crime. The federal government filed a separate lawsuit making the same arguments: the state law is preempted by federal immigration law.
    Winger began by saying Iowa's law is "remarkable" in that she is standing alongside the U.S. Department of Justice. As an immigration advocate, she and the government are often on opposite sides in the case.
    Winger said SF 2340 would create a "state-led immigration enforcement regime," which "would be unique" if allowed to go into effect. She said plaintiffs brought this challenge because similar laws have been enacted in other states. If such laws are not challenged, the U.S. could end up with "50 states with 50 immigration policies--an unworkable system that will harm our vibrant immigrant communities across the country." She expressed hope that the court will enter an injunction blocking the state from enforcing the law.
    In the second part of this video, Erica Johnson, executive director of Iowa Migrant Movement for Justice, speaks to reporters. She said we can all agree that the U.S. needs a workable and human immigration system. But SF 2340 "is just the opposite of that. It's unworkable. It's creating fear and driving misinformation in immigrant communities around our state." She said the law was "inhumane" as well, which is why hundreds came to the federal courthouse in Des Moines to express their opposition to the law.
    On June 17, 2024, Judge Locher issued a preliminary injunction preventing the state from enforcing any part of Senate File 2340. Iowa Attorney General Brenna Bird immediately said she would appeal the ruling.

    If Miss Lib Princess were living among those “vibrant immigrant communities” she speaks of, she might have a different perspective the after the first few times she was assaulted.
