    Society is charging Non occupancy charges more than 10 percent. Secretary has passed in AGM. They are charging very high expenses.

    Thank you Vinod Ji for your Guidance. Please clarify that when we receive payment from a member, what is debited first. Interest amount, arrears or current bill amount. We were told by competent authorities that outstanding Interest amount gets debited first, outstanding arrears and current amount in that sequence. Please clarify otherwise members will never pay their interest and keep it outstanding perpetually. Thank you for your opinion in this matter. Anyone else can also please give your legal opinion. Thank you.

    Sir, in 101 case, our society charged 10k per defaulter(who were parties to the suit) but the order of the day Registrar, did not mentioned anything as to costs. Can the expenses incurred by the society in the cases be considered as legal expenses and same be recovered from all the members equally ? But in our case the costs was imposed only on the defaulted members against whom the 101 proceedings were carried out .

    Can an interest levy or add on this legal charges
    We filed a complaint against builder for changing plan without consent. To which MC hired a lawyer and now commiteee is going to treat legal fees under maintenance and charging 21% YEARLY like normal maintenance. Is it legal to charge interest on legal fees against builder

    Dear Sir: Good morning. What if the MC is demanding in violation of CHS Bye-laws e.g. Major Lift Repairs charges on per floor basis instead of per Unit/Member as stipulated in the Bye-laws. Is the member within his rights to refuse such illegal demand more so when the matter has not been prediscussed/preapproved in any meeting whatsoever.

    Sir for members we make mandatory to give affidavit that I follow all saying of society and will pay as and when MGT committee demands but why no affidavit from MGT committee that they adhere to byelaws and act for benefit of society not self interest.

    My society is creating gym above my 7th floor flat in a pre designed flat with open terrace which can be quite a nuisance.. pls can you guide me on handling this to not allowing society to stop from doing so

    Sir we are living in a chawl building area of our house is 450 sq.ft carpet, but our secretary is asking for 25000 to b equally shared by both parties if we sell our house, can the society charge less than the said amount...please help..

    Land conveyance k liye humne 6000 rs.diye, aur thode samay mein land conveyance ka kam b hua, magar hum sab members ne xerox copies of land conveyance maanga tho secretary dene se mana kar rahi hai.... tho kya kiya jaaye,, help kijiye.. please

    Same rule for housing​ federation recovery charges?
    13000 has been recovered only by us from the society charges.
    Can we challenge this?
    Please advise

    Can Honerable Court direct Society to pay legal expenses to the member (legal expenses paid by the member). A society has passed arbitrarily invalid resolution. Members filed a case and as a result the resolution has been cancelled.

      Since the resolution is cancelled by the court the amount collected is illegal and such it should be refunded.

    Sir i had question. Sir my society has rejected my Associate member so i went to Lawyer & they had charged Legal exp 8000/- can i take from the society this amount.
