The entire process is in many times long as in November it will be 2 years since I lost my dad. Again, excellent video as I’m getting together with my lawyer before the mediation process so we’re on the same page.
My tort is idiot simple: a dog bite. The money at issue is petty cash. Yet the defendant is a 'court-veteran' of divorce -- and did not refer the matter to her insurance company. She snagged the offending defense dog away from her ex via divorce. Now that was hard ball. She had her own. After its attack, that dog went straight back to her ex, pronto. I was shocked that the court invoked mediation -- as there are no issues to resolve. In my state, such a judgment is formulamatic. Plainly, the defendant just is both combative and cheap. Her big win: getting rid of her pack of dogs... six big barkers on a family street -- freaking out the neighbors. The zeroed out feed bill is more than sufficient to cover the tort. Amazing.
A few years ago a friend of mine at work slipped on hydraulic oil leaking from a machine and broke his elbow along with minor injuries. He was sent to the hospital and everything was reported properly. The next day how ever he came to work and was put on light duty. Apparently what ever doctor the company sent him to approved him for light duty. Should he have came back to work? I always have insisted that he should have stayed home and spoken with a lawyer. Luckily for him the company did pay for medical and lost wages with no lawyers involved. Could he have sued and gotten more compensation? The company was always careless about leaking oil and what not.
Someone is lied to you .....You do not return to work with a broken elbow ( internal fixation closed reduction ) Your whole arm is rendered useless Not able to use your wrist or hand or fingers His arm would of been in a sling And waiting for surgery..So how was he at work on light duty AND sent to be approved for light duty? No doctor is going to risk a person further injuring a body part that is awaiting surgery on his word/license. The company has a duty of care to its workers They would of been 100% at fault He would be paid for the pain/suffering And past wages And future wages And care I would say after all said/done And if he still has a reduction in movement And still has to have the plate and screws removed He would of had about 2 to 5 years worth of wages in rewards .......Im not a lawyer Or know where this happen but thats my guess

Really hard to say. So when you say your damages exceed the limits by 50k, do you mean your med bills? If so, why haven't they offered the policy limits yet?

Morning - depends. The voluntary mediations I used to do - we did have to pay for mediation. There may be court ordered mediation in your jurisdiction. I can't tell you what that might or might not cost. It's something you should ask your attorney and/or a local attorney.

Hi, not entirely sure what you're getting at. If you were not at fault for the accident, you'll file a claim with the other side's ins co - and they have liability ins to cover your damages like meds, pain and suffering etc.

How do I make them pay for future medical issues and for all the stress I've gone through. Here in KY than can offer 'fair market value' for a vehicle with no consideration for the time and expense it will take to replace it.

I don't know anything about KY law though - so I'm not sure how to advise you re: future medical expenses. Have you consulted with a local attorney by any chance? The mediator just wants to settle the case. In the eeoc world they say the mediator is very pro employer. They tell you your case stinks, no skin off their back. You take their lousy offer and the case is done.

Impossible for me to know - but if I speculated, I'd guess (just a guess) they know you don't have insurance and are using their own uninsured motorist coverage.
