They seem like nice neighbors.
They're dumb as nails and endangered the cop and her, all they had to do was turn the car off (take pictures first) and start beating on the door, what if that window was right at her bed and that cop started into the room and woke her up she grabbed a gun and shot him. Or better yet what if she slept by a gun and her hand was near it and he shot her. He had no legal right to enter that house
Bob ShitDickSam he didn’t enter the house... what you gotta realize is there was so many things out of place. Leaving your car on and parked out of place is deff cause for concern. Throw in the ladies age and the fact she might have medical conditions, I think the cop did the right thing.

Had to do something like this for my neighbor who lived in the apartment below me ones. I had to scale down my balcony to his and open his door because his alarm clock was going off and he wasn't answering my calls. Glad I did because his sugar level had gone so low and he was unconscious in his bedroom. That sight of him was so bad I won't forget it.

If I had to guess, she came home drunk, which is why she left the car haphazardly with the keys in it, then staggered in and fell unconscious into bed, which is why she didn't hear people hammering on her doors and windows. It looks like she was fully dressed when she was awakened, which also supports that hypothesis.

I snorted and spit out some coffee when he asked them that.
I think he was trying to say that there is another access point (the window) but he couldn't check there because you need a ladder to get it to (a ladder that he doesn't have so he couldn't check by himself before the fire dpt arrived). He wasn't asking he fire dpt if they have a ladder...

Most houses are pretty easy to break into. Locks and possible alarms on front door, but rarely any security on windows.

Wow that could have gone so bad! If she had a gun and thought someone was breaking in or she was laying there unconscious or dead. Had a neighbor years ago who was senile and would just leave her car running with the door open. She set her house on fire when she warmed up a pizza in a toaster oven in the pizza box. Her family finally put her in a home. She was a retired history professor with a doctorate. Very sad.
That was my thought exactly, what if she killed the cop or a firefighter because she thought it was a robber, he had no legal right to enter that house. Would she go to jail if she shot them if they where in her house? He had no legal grounds to enter that house
Bob ShitDickSam in that state he did have jurisdiction to enter since her neighbors were concerned about her welfare.

also: hard to prove because she could deny she was driving and just say she went out to the car to get something and wanted the heater or never moved it off the property...

Not every truck at every dept has a ladder on it. If they got called out and asked to make entry for a welfare check, they might not have one on scene.

Great neighbors ❤️ my mom is diabetic and gets really low randomly and lives alone now that I’m in college so all our neighbors know where the spare key is (we have security cameras everywhere as well) so if the car is in the driveway and they can’t get her to answer the door they’ve been given permission to get the spare key and let themselves in to make sure she’s okay. We’re lucky enough to have lovely and caring neighbors. Even though this one wasn’t serious neighbors like this can and do save lives I wish more were like this

This was exigent circumstances. A variety of circumstances may give rise to an exigency sufficient to justify a warrantless search, including law enforcement's need to provide emergency assistance to an occupant of a home. I mean technically it's not illegal to leave your car running or to not answer your door and the cop had no way of knowing if someone was in trouble or not so it didnt really constitute a search other than to satisfy his own curiosity. Then again if the home owner has no problem with it it isn't illegal for him to search so an argument could be made for either opinion.

We all know it's technically legal to leave your car running, to not answer the door, etc. What I stated was this specific situation was exigent circumstances. You could make all the arguments you outlined, courts would rule in favor of the Officer. Even if the tenant took issue, courts would rule in favor of Officer.

This is one benefit to one of Canada's new laws around impaired driving. They can now check for impairment up to 2 hours after arriving home, so they would have been able to do a roadside check on her even if she was inside.

That's looking after your neighbor and knowing their routine. Our neighbors across the street are a young couple.
And they keep an eye on us and our place. Our side of the porch broke off. When we got home from church that Sunday. It was fixed. Mark had came over fixed it. That's what you call neighbor. We are very blessed to have them watching out for us.

her car key's didn't have the house key on them from the looks of it.
