"Common Sense PREVAILED!" - Ian Collins On Muslim Pupil Losing Legal Battle Over School 'Prayer Ban'

  • A ruling dismissing a Muslim student’s High Court challenge against a ban on prayer rituals at her school is a “victory” for all others, its headteacher has said.
    Michaela Community School in Brent, north London, faced legal action from the pupil, who claimed its policy was discriminatory and unlawfully breached her right to religious freedom.
    In a judgment on Tuesday, a judge concluded the ban did not interfere with the student’s rights and was “proportionate” amid the school’s aim to promote an ethos of inclusivity and social cohesion.
    Katherine Birbalsingh, the high-achieving school’s founder and headteacher, said: “A school should be free to do what is right for the pupils it serves.
    “The court’s decision is therefore a victory for all schools.
    “Schools should not be forced by one child and her mother to change its approach simply because they have decided they don’t like something at the school.”

    The parents knew the schools rules but decided to try and get that overturned, they failed and the girl in question I have read is staying at the school to do her exams. So her religious freedom isn’t as important to them as she was saying is it?

    Any Muslim who is required by their sect( Shiite in particular) to pray 5 times a day should send their children to an Islamic school of which there are examples in the UK, or at best, be taught by a cleric or the imam of the local mosque! State schools in this country should not have to be expected to cater for other religious beliefs regardless of the ethnic make up, this is still a predominantly Christian country and we don't shove our religion down other cultures throats, pray in your churches, temples, ashrams or mosques but not whilst at school or at work, unless as individual's you can make or take the time to do so and preferably during rest/meal breaks!

    The school rules are the school's rules, until its primary reason is a faith school. I heard the reverse arguments. The Humanist Society have been arguing this way for as long as I can recall. .
    If the children's demographics became lopsided, when do the school become exclusive.

    But in another case a kid wanted to be a cat and took the school to court and won remember. If this continues and courts are used this way were people just rely on courts for basic stupid stuff our great courts will eventually lose credibility

    This could also be the parent accommodating her daughter. Frightened to tell her daughter that she needs to keep the school rules. I am really glad the headteacher won the case and hopefully this will be a good example for any other rule breakers. If the mother was so concerned that her daughter was unable to practice her religion, she should have taken her out and sent her to an Islamic school

    There is nothing in the school rules that says that the child cannot silently say their prayers, in their own head, while they get on with their work.
    I would put it out there that most teachers would not care if the child quietly MUTTERED their prayers in class as long as it wasn't disruptive to the class and the child still gets their school work done.
    Hell, kids get breaks in the day. Why can't the child do their religious needs then? Say your prayers when you can. In YOUR time, that is what breaks are for.
    The issue here is not religion per se... It is the disruption of the important task of educating kids to a satisfactory degree.
    THAT is the point of the school and that is what should be guarded against at any cost.
    If there is a disruption to that goal then it needs to be looked at.
    If a child has an illness and needs to nip to the bathroom more often during the day then, so be it... But that child *WILL* be told that they MUST be quiet and consider other children.

      I definitely agree with you. The respect should go two ways. I'm sick of hearing the expression 'Islamaphobia' when we don't do what they want, yet if I say 'excuse me' to one of them when out shopping (for instance), they completely ignore me and refuse to move. I then hear them speaking English with their friends. I have even heard them tell each other (in English) that a non-religious person is worse than a Christian, don't speak to her. Religious or not, I'm still a person.

    I agree with the decision and everything that the panelists said apart from one thing. One panelist said "As long as a rule is applied equally to every pupil then it's fair." That's not quite true because it's possible to have a rule that applies equally to everyone but discriminates against one group. Sadly, the world is full of cases where minorities have been unfairly treated by such rules, so it's a dangerous principle on which to judge fairness. A couple of extreme examples will illustrate this:
    "No pupil is allowed to wear glasses" - discriminates against pupils with poor eyesight.
    "No pupil is allowed to wear a turban" - discriminates against Sikhs.
    In these examples, the majority of people are unaffected by the rule - yes, the first one is silly, but I'm just illustrating a principle. And I repeat, I agree with the decision and think that religion should have no place in schools.

    I have my own beliefs in religion. What is so wrong with that? I do not want anyone imposing their beliefs on me. This is a secular country where we are all supposed to respect. I have no clue about the muslim religion and dont want to know as i have my own religion and beliefs.

    Living in a free society with religious crybullies is like living with an ab*sive partner. Any freedom you have to disagree or be different, they will twist into something that's "hurting them" or "violating their rights". That's why standing up to them is so important. Better yet, don't let them into your life/society in the first place.

    Why send your child to a non-religious school if you want them to practice their faith at school? They knew what they were signing up for. Equality for everyone. Respect for the individual. Good for the school for sticking to it's principles. If you want to practice your faith at school, go to a faith school. Practicing prayer at a non-religious school is not practicing respect for others. Keep your religion to yourself and stop trying to dominate others lives.

    They can still follow their religion.... they just can't impose it on others. Also this doesn't seem to target any one religion, the ban affect any that pray..... so it isn't discriminatory. And it's intentions are to focus the kids on their education and not on bullying. If they want to go to a religious school they also exist but state funded schools try to keep religion out of education unless it IS being Studied in religious education Studies
