      @@LillyLegal my question is my mum overstayed during covid that was the only reason why stayed, then left know she is barred and I would like to apply for her come because I am a us citizen. I have been seing I have to aplly for waiver of but seemed like you have to be in US in order to do it. Can you tell me what should I do?

    Hi Lilly. Thank you for sharing this video. My mom came to the US in 2016 on a B1/B2 visa but she over stayed by over 2 years. She got real sick and had to go back home. I’m now a US citizen and would like to know if I can petition for my mom. Thank you in advance.

    Hi lily This for my mom, she came to US for B1 & B2 visa, overstayed because of pandemic I extended her until a yr , file I 130 and approved but she wanted to go home and had interviewed w/ consular but she's denied to get green card because of overstayed visa. This is her case 212 (a )(9 )(b) ii, I'm so confused what kind of waiver I apply for her

    Do you still have to file both l-130 and l-485? I thought you have to only file l-485 if parent has not overstayed

      I-130 is a relative petition (this proves the parent child relationship), I-485 is the Adjustment of status (Green Card) application. You cannot file an I-485 without the I-130 because USCIS has to approve the relationship before they can approve a green card application based on that relationship.

      For a U.S. citizen child to petition for a parent to get a green card, the child must be at least 21 years of age.

      The form is currently free when filed with the I-485 so there is no harm in including it.

      Yes but she will need a misrepresentation waiver which requires her to have either a US citizen or permanent resident parent or spouse.

    Hi. You so help full. Missing q part, if the parents over stay for a years and them went Back to they country and now file a petición I_130 Just weeks after necome 21 years old

      Typically, If they left the US, then they are subject to different rules. They will need to either stay outside the US for 10 years or qualify for a waiver. the process can start but they will not be able to get a visa unless they have been outside the US for 10 years or qualify for a waiver and have a waiver approved.

      You must be a US Citizen to file for parents. You will not be able to file for them until you become a US citizen.

      If you gave up your residency by filing form I-407 there is no way to get it back unless there was duress. However, if you have immediate relatives that can file for you, they can still file a new petition for you.

    Hi Lilly,
    I am a 21 years old US citizen living in Ohio State. I want to sponsor my parents through I-130.
    But parents live abroad, 15 years ago returned to their country, my father was overstayed and my mother was an asylum seeker but got denied and return home with my father, will it be a problem ?
    How about with the bar ?
