because it's not youtube's purview (and thats one of the big problems right now. It's why it' easy pickins)
See here's how it works.
Yotube is a service provider. Under 17USC512 (it was instituted under OCILLA), a service provider is NOT liable for indirect infringement (ie it's a "safe harbor") based on a some requirements. One of which is that if they receive a notice of infringement they must remove the content.
Now that notice is a CLAIM, it's NOT at that time, legally substantiated (it's like a C&D letter, that's not a writ, a court order, it's just one party telling another party "cut it out" ). Which is why The alleged infringing party can notify the ISP that they believe they are NOT infringing at which point the content can be restored
BECAUSE IT IS NOT AN ISSUE ABOUT THE SERVICE PROVIDER, they acted with due diligence. It's now a matter for the courts to determine the validity of the claims.
Now, Repzion filed a counter claim( basically a denial that the work is infringing) which allows restoration of the content, but that does NOT mean Onision has been "legit caught abusing the system" - that has yet to be determined.
one can, completely and utterly lose in litigating a copyright claim, but that isn't the same as showing bad faith in the claim. Oh, they could both be true but losing the copyright claim doesn't auto-magically make the other true.

Correct! and here's why : it's in YT's legal interest to stay _laissez faire_ so they don't put themselves in a position where they've done some kind of action that could expose them to liability. they wan to run like uber and all the gig-economy players where they simply provide infrastructure and what "contractors and users" do with it ain't their responsibility.

I remember when I was an Onision fan girl. I was in middleschool at the time. I came across one of repzion's videos and realized that all the points he made about Greg was totally true (blaming people for their own issues and being shitty etc). Courageous One because of the fact that it’s video. Written sources have been around for so long that there are very well laid laws for copyright use (and most are about plagiarism.) With video we haven’t been around long enough to have these settled so deeply in the justice system, and with the fact that UA-cam is essentially the word of Law for 99.999% of these it doesn’t allow the actual precedence of law to grow.
