I don't think (to be fair) it's wrong to apply the idea he did "serve" our country as a President when applying sentencing. Yeah, we all know he did it to enrich himself ultimately but that's not proven. Just like you may reduce sentencing for a veteran, I don't think it's wrong to plead that in sentencing. I am a California attorney. I can’t speak to New York practices, but in California, the normal result of a conviction would be to remand the defendant into custody immediately. I wish you would have addressed that question.

My takeaway from this topic is simple: Former Presidents of the U.S., whether found innocent or guilty of crimes of this nature, are above the law, and as such will NEVER receive the same form of punishment that the average American citizen would receive if found guilty of a crime(s) as significant as this. Who gives a crap about what office he "held?" It's what he did to get there that matters!! This still pisses me off having honorably served in our U.S. Military for over 30 yrs in part protecting our country from its enemies, both foreign and domestic. I've never served but have many family members who did, going back to WW1 and, as things go, the only one to lose his life was on a SAR mission in 1955. This is the dying truth. My heart goes out to Judge Merchan. I can't imagine the inner struggles, stress, & concern over his & his family's safety considering trumpian maga madness temperament. I expect he'll do the just thing, the only thing remotely expected, acceptable to we the people. God bless him and his family.🕊️

They should find him guilty on how ever many charges seem appropriate. The judge should then sentence Donnie to 4 years for each count - but, because of the defendants' advanced age and poor health, allow him to serve them all concurrently.
Four years in jail for someone who has lived such a life of privilege would be hell.

What happens if one or more of the Jurors are reported as talking about this case with friends or family? Will they throw out the case???
Just 6 months for the biggest threat to America in the last 80 years is egregious.. idc if it's just on this case, it lays the groundwork for giving the minimum sentence in all cases
At this point if he is found guilty not giving him prison time would have just been a waste of the jury's time.

If Donald Trump is found guilty and this judge doesn't send him to prison, we should all report this judge by filling out a complaint form.
I am not getting my hopes up. Merchan never had the guts to effectively enforce his own gag orders on the ex-president. How the heck can we expect he will have the guts to imprison him after a guilty verdict?

I agree with the OP. Here's why: it's not fair that if we (being the regular public) commit crimes that's one thing; however, if we commit crimes against someone "higher up" or perceived as "better than you" such as a cop, a Congress person, a judge, etc., it's a level up factor getting you automatically more time behind bars. When you're fighting in court (meaning you're actually innocent) against a DIRTY cop, Congress member, judge, etc., though, it's a frickin' slap in the face, as that person should lose that "better than you" factor.
For conviction of 34 counts jail time should be mandatory!
