  • My latest video was demonetized (claimed) by 16 record labels for using 10-20 second clips for demonstration and teaching purposes. It is a clear case of Fair Use but impossible to fight.

      Artists should strike out on their own and forego labels. Then they can have the control.
      Maybe before the internet and such, labels were basically a requirement. Now? Should not be.

      I've read so much about "the industry" over the years. For an industry that's supposed to promote artists, they seem to do everything in their power to do just the opposite. As well they endeavor to keep artists paupers, while pocketing as much for themselves, since everything in that world comes out of the artist's own pocket: management fees, catering, airfare, hotels, buses, vans, industry fees and charges, you name it. It's a wonder the artist makes anything at all in the end.

      @Bryan Smith But I guarantee the artists (and yes, even record labels, publishers, execs, etc) are profiting from Rick's content as well. If they weren't, artists like Seal, Sting, Brian May, etc., would not be *appearing on the show.*

    UA-cam / DMCA needs a couple major changes:
    a) The UA-cam bot should send notice to the suspected copyright holder (not the poster/alleged violator) and wait for them to consciously acknowledge the intent to claim. Too many false positives otherwise.
    b) Escrow. Continue to generate full revenue, but hold funds in escrow and then if claim is wrong, OG still gets full revenue without penalties. YT content creators regularly complain about the lost revenue in popular videos that get lots of hits during the claim dispute window.
    c) anti-slaap style mechanisms - if a copyright claimer (?) files too many challenged/reversed claims, they need to be shut down. This is too lopsided. The copyright holders have too much power right now.
    There are YT'ers with wind in the background getting demonitized. New sites are inserting public domain footage in their news clips and then using that to strike down anyone else using the same public domain clip! I've had claims from random artists challenging a video of my family singing Silent Night acapella at a family Christmas gathering!
    The autostrike is horrible and needs to be fixed!

      Government would have to step in, but they’re in the pockets of the vested interests, so they won’t. Those vested interests are why copyright keeps getting extended and laws like DMCA exist. And if there were no government the vested interests would just collude anyway.

    Keep fighting the good fight, Rick. The copyright claim system is absolutely broke and in the favor of publishers, and Fair Use is basically just there to make us FEEL like we have some kind of power, which we don't.

      Of course the copyright system works in favour of the publishers, though. That's literally what it's for. That's what copyright is! The doctrine of 'fair use' is a very North American thing, and doesn't apply worldwide, so I'm not sure how much of a defence it provides on a global platform. Just don't use other people's material to make your videos, *or* at least accept that you can't make money directly from a video that uses other people's material.

      @@byCampo It's a lot of work and effort to clear every copyright, and we have received many strikes over the years. But we fight those strikes too, and every single one has been released by the claimant.

      @@Ripprock1 We never have asked, but we work with enough labels that we just send them the video links and they'll remove the claims. Others we have to use the copyright system to battle.

    The record business is one of the most ruthless. Label execs and label artists are of two completely different breeds. One celebrates the art of music, the other celebrates the hoarding of every nickel they can drain from creators. Keep it up, Rick! And keep celebrating and sharing the art.

      @@bucquoismusic that will ‘sometimes’ work with companies tar are using less sophisticated bots to find claims. Won’t work at all if people from the record label are watching Rick’s channel. From some of the things I have seen lead me to believe at least some of the labels are actually watching.

    They literally should pay you for promoting their music to a much larger audience than they would ever get on their own. I once got demonetized for playing some of Luis Milan's 6 Pavana's on my livestream. A 500 hundred year old piece. It's been "public domain" longer than America has been a country. Who could possibly own the copyright to it? Turns out a florist in Ohio, who used the piece in their promotional video. Insane.

      Well, a particular recording of it could be owned by the musicians who played it, and that would actually make sense. Not someone who randomly used it in their promotional video though. And not your own original playing of it.

      @@RichardBuckman slight conjecture: recordings of an artists work are typically owned by the producer/recording engineer who did the work, or the person who paid for it. That doesn't translate to owning the written work, just the recording itself.

    People get claimed for having silence in their videos sometimes because there is similar white noise silence in a copyrighted song or video elsewhere. The whole system is completely asinine and it only gets worse over time. Patreon, merch, and other product sales are the only reliable ways a musician can make money from UA-cam. Basically you can't count on any money from youtube itself.

      After being a suscriber for so long, and watching your livestreams and all of the problems you have with copyright issues, I can only think in changing the platform, cause this is being increasily a pain in the ass for all the music teachers (and I don't see any tendency to go backwards with all of this BS claims)

    They're doing both, Rick - accepting the promo you give (which they do appreciate in their own underhanded way) and taking your cut of that promo as well. The only risk they take is that of you potentially being so upset you never promote for them again. So unfortunately you're fighting a battle against yourself, in the end.

    You're not alone, there's even artists who have had THEIR OWN music claimed on and they held the copyright to, even with proof they still upheld the claim and it took a court case to resolve it. UA-cam needs to do better.

      Mostly the "bands" do not own exclusive rights to either the song itself (words, melody, arrangement) or their performance. The rights are owned by venture capital companies, publishers, record labels, etc. The many artists have no more control over the use of their material than Rick does.

      @@peterkelley6344 Either the change has to be profitable somehow, which I can't see happening, or Google has to invest money into fixing it while not profiting of it, which I also can't see happening, or there has to be some new legislation that forces them into changing it, which I'm pretty sceptical about but I guess it's possible.

    Rick! I love your work. I was raised on a strict dose of classical and prohibited from any pop culture- film or music, throwbacks or current. Your lists have offered me so much exposure that I never had without me having to do all the legwork to filter out talent from the rest. I don't even know if I'd recognize talent if I came across it. I love the application of music theory as it gives my classical brain an opportunity to make connections.

    It's a shame how educational videos are still being claimed and/or blocked. UA-cam should come up with some kind of 'educational' exemption for the claims on the grounds of fair use. The fair use clause is in there for a reason. Maybe an independent review of a video from a channel to see what kind of content is being produced so an exemption can be issued. The channel can then sign/confirm that all videos are consistent in nature and therefore fall under the same copyright classification. The problem is there are so many channels 'reacting' and breaching copyright law that everyone gets thrown into the same barrel to the detriment of genuine educators.

      Unfortunately he is combining this educational video with the sales of his Beato Book and Live Tour. Therefore he is using these songs and artists to sell his stuff and he is not paying them Royalties. This is, I'm betting, why this is happening. I bet if he didn't sell anything on videos like this he wouldn't have the same problem.

      @@nandakusuma22 No doubt that the AI being used is not able to catch everything and as much as the music video got caught by the creator it also would catch someone else FOR the creator. So it goes both ways and indeed isn't as accurate as human may be in discerning the difference. However I still stand behind my statement that him selling his goods in the middle of his video is not helping his cause at all. I'm hard pressed to think he is not aware of this. And if he is then he is using his supporters to try and help get things changed so he can then sell his goods on the backs of other artists. AGAIN... Disclaimer. I love Ricks videos and all he does so I'm definitely not hating on him. But he should take a look at his approach.

      Music is an exception to fair use in the sense that the most effective length of commercial these days is 15 seconds. What would it cost Apple to get a Stones song for 15 seconds? But everyone with a music channel is pumping this stuff out and making use of the most valuable music in the world to sell their music lessons. Cumulatively this dilutes the value of the music through over-exposure.

    As a librarian I am the go to guy for copyright and fair use questions. By law for educational purposes you can use 30 seconds or 10% of a song, whichever is shorter, for a presentation or project. Bots cannot detect content only the music. I thought your video was very educational. Keep up the amazing videos. Enjoy them thoroughly!

      I uploaded songs from an artist and album that was previously not on UA-cam. One of the songs was copyright striked despite the fact that it was a completely different song from what I uploaded. The fact that whoever is in charge of striking (whether a person or bot) couldn't catch that is extremely concerning to me.

      @@thedave5748 no clue. I know nothing about algorithms and such. Is it possible the song I uploaded sampled another song? It’s possible. That’s the only way the strike could be accurate. For more information, the song I had posted was Blanket Of Stars. The song from the copyright strike is called Let’s Pull Together. I found only two (one by The Troggs, one for Andy Griffith), in my opinion neither sound like the song.

    YT's whole process is laughable. I got a drone and, having no experience at all, I took it out to a park for a practice flight. I uploaded a copy of MY video, probably 20 seconds long just so I could send a link to my kids without the overhead of sending the actual video. I got a copyright strike!!! Wasn't monetizing, no nothing. No one else had anything to do with it. Stupid process.

      Yeah, I give up as fair use on UA-cam is a dead horse. Fair use includes parody, which I do, and BLAMMO. I pass the initial copyright check by UA-cam only to have Warner Entertainment, etc.... come in and strike it a few minutes later EVEN though it falls into fair use due to parody.

The parody defence is widely misunderstood; people think it means that if you write your own lyrics to an existing song, that's OK because it's a parody. In law, it's only a parody if your new lyrics are a comment on the original song or artist. If the lyrics are totally unrelated to the original song - say, you took Shake It Out and wrote new lyrics about your cat - that wouldn't be parody since it wouldn't be a comment on the original song or Taylor Swift herself.

Take Weird Al Yankovic for example; "I Love Rocky Road" has nothing to do with making a comment on the lyrics "I Love Rock N Roll"; "The Saga Begins" has nothing to do with making a comment on the lyrics of "American Pie"; and so on!

    As a 69 year old drummer who grew up in the best age of rock I want the younger generation to know of all the great bands that there were. Your videos do a fantastic job of educating all generations. I'm with you all the way and if they can't see that the bands you highlight increase awareness and sales then they are blind.     Some people might not appreciate how valuable channels like rick's are. As an 18 year old music lover from lran, i can totally understand it. Music is almost nonexistent in my family. I'm probably the first person who's playing an instrument, let alone guitar. My music taste is considered odd in my culture. No one really knows what blues is, or who hendrix was and etc. UA-cam is the only place i can fuel my musical interests and get inspiration; so because of that I like to thank you deeply for your channel and your efforts to keep it up.

      Great music has no borders! So cool that you have discovered musicians like Jimi Hendrix. If you want to write and sing your own songs someday, I highly recommend giving country music a chance. I hated it when I was your age, but now I hear it's influences throughout rock music, and also I love it for the way it reveals song structures so simply. Check out Jimmie Rodgers if you can - he's funny, authentic, and pretty easy to follow once you learn some of the basics of western music theory.

    This Channel takes me to class everyday. I have learned so much form this channel it's impossible to even quantify it. Sadly the youtube take down bots have run amuck and even channels posting old out of print music from the 20's and 30's are getting strikes against them. If we don't have people Like Rick teaching us about the music, it's going to get lost, especially to those younger folks. I'm 48 so I remember a lot of these songs, but someone who is 18 might not have a clue where to go for so many songs Rick educates us on

    Man, it's appalling how artists have been forced to abide by the most short-sighted, out of touch businessmen for decades. Imagine being a music teacher at a local music store and your boss hands you a piece of paper at the end of the day outlining how your pay will have to be divided between 16 different rights holders because you used copyrighted songs to teach music.     NOFX has one great song about this: "Dinosaurs will die". Not directly about the de-monitization (because that didn't exist in 2000 yet), but about how bad the music industry was becoming already back then. Also, El Hefe is the guy that made me pick up the guitar and learn more about music as a whole (grew up with a father that listened primarily 60/70s music and a little bit metal from the 80s).
    Let me quote: "Dinosaurs will slowly die and I do believe no one will cry, I'm just fucking glad I'm gonna be there to watch them fall". One day your efforts will pay of Rick, keep fighting this parasitic music industry we've got your back.

    The reality is that the music business (specifically publishing) has been banged up for years. There are a countless number of great songwriters who were screwed out of royalty payments because they were manipulated by the “suits” of the industry. You are right Rick. You weren’t “stealing” the use of these songs. You were showcasing them which exposes them to your audience. Keep going! Don’t let them censor you.

    I've rediscovered (and discovered) great bands because of your channel. I've then streamed the songs a bunch, and then I've bought albums - actual physical records in lots of cases. You, Rick, are a goddamn treasure and every single major artist out there needs to help improve this garbage. Couldn't the big guys work with the labels/licensing companies to do better? Maybe that's naive. On the other hand, UA-cam is stupid as hell for this, too.

      @@CFCMahomet While the artist may create the music out of love for the craft, make no mistake, it was done to make a living. Everyone works for a living, no matter how much they enjoy their job. There is no artist that makes music for free, no one sings for free. Sure there are free concerts but that's limited and SOMEONE is paying for it, usually sponsors.
      A much smarter way of doing this would be for the labels to offer temporary licenses for clips for like $5 or $10 to people like Rick or singers who make covers. The labels would make more money that way and THEY would have to less work for that money.

    I love discovering new music and musicians. At 76, my interest in both new and old music is the same as it was when I was in my early teens.
    I've often found that even if I'm not all that keen on a particular track or style of music that Rick features, it's still a useful and insightful experience to listen to him. Many are the times he's changed my mind about some unjustified prejudice or dislike that I had.
    Rick's channel is where we learn about both music, musicians, techniques, and history.
    Typical of UA-cam to penalise education by such a skillful and knowledgeable teacher.

    You featured Joe Pass (Virtuoso) whom I had never experienced and I was hooked. I immediately bought the album. So enraptured was I that I told three close friends and they, too, were unfamiliar. They went out and bought the album. That's four album sales just from one video saying "you gotta check this out". Add in all the others that followed the same path and that is some solid coin. You are correct in every point you are making, Rick. Stick it to them!

    I’ll never forget your Gordon Lightfoot if I could read your mind video, after I watch that video I downloaded a bunch of songs by him and still listen to them today. You’re exactly right, this is not a one stop shop where you go to listen to music, this is an educational promotional channel that gets listeners like me to go out and find and download the music that you’re sharing.     I had my 'Paint It Black' by The Rolling Stones guitar lesson video removed from UA-cam and got a copyright strike a couple of years ago. Even though there were several other Paint It Black guitar lesson videos by other people still up and running!! I was so mad about that. This copyright strike and demonetization by UA-cam seems so completely random. Makes no sense at all........grrrr, lol.

    I think you should play every song and have links in the description if people want to hear them. So you (deservedly) get paid and if people wanna hear more of that song, the artist can get paid. I think what you do is AWESOME!!!

    Used a few seconds of an obscure band in my newest video and they kept demonizing it no matter what I did. So basically it breaks down to giving this obscure band a lot of attention and doing it all for free because some suit wants to make 15 cents. Good lawd! :(

      You don't get to decide what's right/ wrong for other people's IP. Also, are you at any point selling your wares/courses in the same video that uses that song? If so that is not Fair Use. But this is what Beato does over and over and over. He's utterly dishonest and self-entitled about it too.

      Thats not how fair use works. Fair use is purely about weather its transformative in any way, which includes clips, remixes and reviews. The ONLY way fair use cannot apply is if the song is uploaded in its entirety in its original form. Thats literally it. But because major corporations can ignore the law and us little people cant afford litigation, the law becomes pointless.

      We can if we have paid for it. Im tired of being told that I have no rights when I own the fucking thing lol Besides, most of these bands put up their music for free on the internet now these days anyway (UA-cam videos on the bands channels, for example). How can they claim something that they themselves made free? And its digital at that point. Its literally impossible to steal something thats 1) free, and 2) doesnt even physically exist. If they dont want people using their content without paying for it, then they shouldnt be putting it up for _free_ on UA-cam.
      It used to be that "copyright" was JUST so you couldnt take credit for someone elses work. Now, its used by mega corporations to punish people for having the audacity to share something that they paid for. Ive been saying it for a while now, and Ill say it again: If you pay for something and do not have the right to do whatever you want with it, then its not yours. Its basically renting, but at full price. They dont straight up tell you that, of course, as thats a part of the scheme. Just like property taxes.

      @@SvendleBerries You are misunderstanding these things. You cannot use someone else's stuff to promote your own business/product. If he didn't discuss his stuff during the video then he would be 100% in the clear and can fight all the way to court for the video.
      Also, just because a copyright holder puts a song up on youtube or another "free" service does not mean you get to use it. They are putting it on their channel in which they make money even though it is "free" for you to listen to. Your argument doesn't hold up at all. Also sadly, you do not "own" stuff you purchase in the digital realm anymore. You are actually just buying a license to listen to it. Technically when you purchase a DVD (and this has always been the case) you are purchasing a license for YOU and only YOU to watch the DVD. There was a big to do about this when the Kinect came out because Microsoft applied for, and got a patent where they could use Kinect to count people in the living room when you watch content and block the content or charge you based on how many were watching. Digital rights should be renamed Digital Limitations because that is more of what they are. Copyright has always been around the "rights" to the content. How it is applied is up to the rights holder. And no, if they want to charge $1 to listen to a song then no, they don't want you to broadcast it to a group of people without them collecting. Again, you don't "own" anything but a license for you to consume the content in the way it was sold to you.
      You really should learn more about it. Even transforming the song slightly cannot be "fair use" for him to use in his commercial. If that were the case then people would make tiny changes to songs and use them everywhere. ...also, yes, if Rick talks about his audio system etc. on his video, it's an advertisement. ...the whole thing not just the part where he talks about it.

    It seems to me that UA-cam needs to create a stratum of Content Creators that includes classes such as "Curator" or "Instructor" where the bots don't scan with such an aggressive algorithm. You prove your intent to UA-cam, get the classification and get on with the business of teaching. You are a teacher at heart.

They want their slaves to be dumb, and compete for who is the best slave dividing and conquering every force of good that exists or ever can. Pure evil. The corporations who run those corporations and also run the media, Healthcare, housing industry are the big threat. Yes google Facebook etc are involved but they joined in, they aren't the top they are controlled and seem to go by the if you can't beat them join them philosophy. But they joined, they aren't the biggest threat.

    We love you and appreciate you Rick. I'm a song writer/musician/singer and it is because of the very greed and manipulation of the recording business that I will never submit anything to these clowns and continue cleaning toilets and floors. I'd rather be in total control of my music and work menial jobs than play their game and lose. You do nothing but help promote great artists and introduce many to great works of art that many would have never known about had it not been for you.

    I can't imagine the frustration you must feel, trying to do your thing while simultaneously trying to connect fans of music with the works of different kinds of musicians only to be shut down by bots and greedy middle-men.     You are a great teacher and curator. It is awful that these kinds of wonderful videos are restricted in any way. as a recovering English teacher, I can't imagine not being able to teach or not being paid for teaching if I used the materials that would constitute a basic curriculum and understanding of language. You are teaching a language, the language of music. You should be able to use any and all videos and examples there in provided you continue to do what you are doing which is educate. Peace

      As an English teacher, my students have to buy most of the books we study. Normal copyright rules apply. If it's in the public domain, then they can get a cheap copy or download it if they want. If it's not, then the writer and publisher are, rightly, getting paid.

      @@frmcf But Rick is not using the full piece of work. He is only including minimal excerpts to use as examples. That clearly falls under the spirit and letter of fair use. The substance and value of Rick’s videos is in his commentary, not in the excerpts from original content, which can easily be heard in full form elsewhere, and for which copyright owners are already claiming the income.

While it is true that the school where I taught did indeed have materials that students bought, referencing phrasing for idioms with specific examples that may have been used by singers or songwriters or broadcasters couldn't possibly be all attributed nor all those entities paid. If I quote Hamlet's Soliloquy, (to be or not to be), as an example of 'antithesis' (specific phrasing) there is no way I would be required to pay the publisher of Hamlet.

    You're right to be angry. I really learned a lot from that video and was impressed by how much work you put into displaying the beat count on screen exactly in time with the songs. I could tell that you were using as little of the songs as possible; you used only as much as was necessary to demonstrate the meter. And you went the extra mile by playing some of the songs yourself where you were nervous about copyright claims. That should be textbook Fair Use for educational purposes.
    I hate that many of the best teaching videos are ruined because of this automated system of bots that no one has time or incentive to correct. We're all poorer because of it.
    At least I discovered your channel because of that video, which is great!

    It's also crazy that 15 seconds of a 10-minute video somehow equals "we get 100 percent of the revenue." They're now stealing from the video creator. The whole system is insane, and UA-cam has shown zero interest in trying to fix it.

      UA-cam doesn't care about creating a fair system, they only care about not getting sued by the big players, so they unconditionally follow their claims, even when they don't align with the actual copyright laws.
      It literally doesn't make a difference to UA-cam who they pay for the video.
      It's really freaking sad that the legislators don't understand there's a parallel justice system going on that's killing the right if fair use (and making the legislators obsolete).

    Thank you for still (despite all the hurdles and frustrating bullshit claims) fighting for and creating those videos for us. Thank you for going back into the videos and fixing or removing or changing the video, although you were actually done long time ago/or proving that the claims are just wrong, otherwise we wouldn't have your very informational educational and entertaining releases. I am really disappointed by the system and am sure that many many great videos from content creators all over the world got denied and destroyed because of the same reason.
    I'm really looking forward for your other videos and please please, never give up! I send you my energy, Thank you
