Mama energy saving gas cooker ekak design Kara thiyenawa. Eke 40/100 , 45/100 gas saving ekak thiyanawa .but google wala research paper wala eeta kittu technology ekak use karapu awastha thyenawa wenath karana sandaha .emanissa mata patient ekak mekata ganne keseeda? Thx
If the technology is defined exactly the same as yours, its normally hard to get a patent. But if the technology is used only in other industries and usage in your industry is not 'obvious' (if you have to use your ingenuity to think how to convert the technology into gas cookers), then you can get a broad patent for gas cookers. You can get a patent for a very small scope anyway, but its not worth that as anyone can change their design a little and bypass your patent. If you want to lock others from entering the business, you have to try to get as broad patent as possible that other's can't escape from. This is a hard analysis to do, and normally require a trained patent lawyer. They are normally expensive to hire, but I can send you contacts of a few good lawyers if you want.
I’ve got a revolutionary business plan which is a software which solves few problems. Still we didn’t start the software making process. Can I apply for the patent with the idea.?
depends on what part of the car you want to patent. Tesla very first models had around 700 patents just for different parts of the car. Say for an example, you find a really good way of managing energy transfer from batteries to inverter, then you can patent that invention. But just an 'Electric car' can't be patented any more. You can get a design patent to your electric car appearance (may be the shell shape, headlight shape, overall car shape etc..), which is also really important as your competitors can't copy the 'look' of your brand
As Sri Lankan patents are not shown publicly in google or any patent search engine (so sad that its the case), others can actually apply from other countries and may be get it granted. But as you have a priority date, you can apply in that other country and make their patent cancelled. Either way, as you have done the invention before, their invention is not NOVEL. Therefore, even after the time limit, they can't ideally patent it as a new invention.
you have to register it as a logo. Then its your own logo perpetually. But if you register it as a design patent, it will expire in a time limit. But remember, you can't register a complex machine design etc.. as a logo. It should be a simple design that represent your brand.
Hope its OK to reply in English for this. You can get a design patent to vehicle shape and design. For that, you just have to sketch the design (there are design patent guidelines to get a proper coverage, you have to study them in details to get this properly). That is one way. This will stop someone making a car which looks almost like your car. If you want to get a patent to the functionality, you have to show innovative / inventive parts and get patents individually (can't get a patent to a 'car', as its already invented :D ). For an example, you can get a patent to your innovative new break system, your new innovative steering wheel arrangement that works better than current steering wheels, your new lighting system design which is more efficient etc.... These utility patents are taken to individual systems separately, but you can't get a single patent to steering system + breaking system + design + seat arrangement. These are separate and non-related inventions, and the patent office insists that you apply for these patents separately.
this step takes a really long time. In international patents, there is a rapid path after paying a premium, which may work in 6~9 months if your patent application is really good and no prior arts found. But an average patent application may take 2~5 years to get it granted.
Drawing and a proper description (with claims) is more than enough. No need to physically make anything. Just put your invention in the paper and submit for approval. Patent is given for ideas, not for the physical products.
best thing is, if your invention is good, you can find investors. First, you can apply for a local patent, and secure your invention. Then you can talk to anyone and try to find funding. For good inventions, finding funding is not that hard. Inventions need a lot of money to take them to commercial selling stage, but there are so many people who can help you. Trying to own 100% of your invention and trying to do it yourself may be not the best idea.
Actually, nothing is patented in Coca cola. They have registered the bottle shape as a logo, so it hold perpetually. But their recipe is kept as a 'trade secret', not a patent. So, nothing about the recipe is patented, filed or published
Its possible to get a process patent, if the process is novel, realistic and if its an improvement from current process in any way. But there is a negative in patenting a process. It means you are disclosing your process for everyone to see. Then the competitors can copy the process. Unlike a product patent, a process patent infringement is extremely hard to detect and prove (for an example, if you invent a low energy requirement process to melt plastic, how can you prove that other factories are using exactly your process to make plastic?)
