  • There’s a dispute between a store and a customer. The store calls the police, reporting something that’s not a crime. The police show up to investigate the said non-crime. They demand ID. Now like many states, West Virginia does not have a “stop and ID” law. However, if they have reasonable suspicion a crime was committed, and that a particular individual committed that crime, they can perform an investigative detention which can involve forcibly obtaining an ID from a suspect. So what is the crime? Can the alleged crime of “trespassing” be used to detain and ID a shopper who has not been asked to leave the store, and who has not been given the opportunity, or even allowed, to leave the store by the responding police officer?

      Myself I'm a 37 year resident of Hampshire County WV, and my oh my I've got occurrences in my memory that would blow your mind. Unfortunately from the late 90s & early 2000's before body cams were worn. I truly wish the happenings I speak of were video- documented. Should have been winning cases in court too, lost by miles. Sad.
      Anyways, I love your channel and admire what you do. Very intelligent in your profession! I also thank you for what you do on here and for the people.

      Question. Was he ever trespassed at that Walmart? What happens if he went back there? As far as I know we don't have any such thing as "being trespassed" anywhere in Australia. In my State of New South Wales we have the Inclosed Lands Protection Act 1901. Section 4 of this Act details "Unlawful entry on inclosed lands" as follows:
      (1) Any person who, without lawful excuse (proof of which lies on the person), enters into inclosed lands without the consent of the owner, occupier or person apparently in charge of those lands, or who remains on those lands after being requested by the owner, occupier or person apparently in charge of those lands to leave those lands, is liable to a penalty not exceeding-
      (a) 10 penalty units in the case of prescribed premises, or
      (b) 5 penalty units in any other case.

    Your client was absolutely right on everything. For it to be trespass, they have to tell him to leave. It appears Walmart employees singled him out for this incident. The best way the police could have handled it was to just stand by, keep their mouth shut, and let him leave. This would be a peaceful resolution to the matter. The officer in the matter did not maintain the peace and escalated the situation. She proceeded with false charges.

      If your walking through a park minding your own business and the cops happen to I.D. you for no apparent reason and then later on some crime happens near the park, guess who there going to come looking for? Then you may be stuck having to prove your innocence when you were just minding your own business. You should never I.D. Period for your own safety from wrongful arrest or interrogation

      i write this everywhere, because there is a very simple explanation to this: the police won a case in the court when a wannabe-cop sued them for discriminating him (not hiring him) because of... HIS HIGH IQ. So it is legally proven that the police officially DOES NOT HIRE people with high IQ for the job, because, as they stated in the court, this job will be BORING to them. So you can state that all or most of the cops hired by the department are NOT high-iq individuals. That's why you see what you see: a bunch of low- or mediocre-IQ people behave like low- or mediocre-IQ people. Nothing special to see here.

      The SCOTUS has recently ruled that cops can be sued for malicious prosecution and the requirement to show that violation is that a favorable disposition to the dependent be granted which now includes dropping of charges! So if this happened sometime after April....her qualified immunity is gone!!

    Felony deprivation of rights, unlawful restraint/false imprisonment, assault, battery, etc. etc. etc. all while armed and at all times threatening lethal force and all the upcharges and increased sentencing that goes with it.
    She belongs in prison, and so does the other cops who aided/abetted. If cops were reliably held accountable this would be far less common. None of the officers on this video should be able to claim ignorance and they all heard all the facts necessary for any reasonable person to conclude the cop illegally arrested the person in retaliation for not waiving 4th amendment rights.
    Citizens are told ignorance is no excuse all the time, that needs to apply even more strictly to cops, DAs, judges, etc.

      And the great news for government actors; if they magically make up some law, in their head, just dreamt it up - It now offers them qualified immunity for their actions.
      So where does the victim here go for recourse? (honest question)
      You might go after the city/county and the department to show that each of the individual actors was trained improperly and that lead to the deprivation of rights.

    Citizens who know their rights- "You are violating my rights, be advised, I will sue you.."
    Literally every officer in this country- "Thats fine. You do that. I really don't care."
    This is due to Qualified Immunity and departments being allowed to investigate themselves. Yes, in the end, he was right, they were wrong. But it doesn't matter whatsoever, he still had his liberty temporarily taken away, he still lost time and money, and those officers will continue to go out on patrol feeling confident that they can ID anyone and arrest them if they decline to provide it and never worry about consequences to their actions. This man will likely sue, be given a settlement from Tax dollars, The cycle will never end. We live in a police state.

      That's so laughable. Walmart has such an advanced camera system it will map and track your face and they share that data so if you are trespassed or banned it will immediately alert in the system. They can take that mapping and it will pull everywhere you went in the store. All large retailers have this, I worked for a small retailer with 24 stores and we're in the process of rolling it out when I found another job.

      Some places the cost per person in jail is $1300 per night. Not saying petty crimes should be ignored, but they should darn well be more selective about who they lock up for BS.

      Even if some of those other officers knew she was wrong, they still would not step in and tell her that. They back each other and let the courts deal with it. In the end, they were all wrong and the guy can sue for violation of rights and let the courts handle it again.

      It's not just law enforcement. Recently I've had two searches without a warrant by "code enforcement" people and an asst. fire marshal. The asst fire marshal is coming again without a warrant in coming days. They've all been refused. They've even threatened administrative warrants. In a record request we found a warrant with a name at the judge signature box, not court seal, and no indication of what court it supposedly came from. They don't have a clue about the law. All I know is it is very hard to find a civil rights lawyer in Texas that knows these activities are against the law. My only hope is to find one before SOL runs out on me.

    As an asthmatic, I still panic at the thought of anyone else towering over me to try and force one of those things on me. Glad this man confidently stood up for his rights.       The cops like other professionals, and using that lightly, usually have to be going through educational classes to upgrade what they should know, and keep current.. Like 30 credits per three years.
      This can be cpr, basic first aid or just reviewing the local and state, and federal statues. There would be less of this stuff if they did. If they do not meet the educational credits then no pay raise till they do. How does that sound.

      Yes we are not yet arresting criminal cops for stuff like this but some cop will be the first. Ask Dereck Chauvin about that, he did nothing that had not been done many times before by officers but,, he became the first to be held accountable for it.

    So now onto the civil suit -- seems these days he can expect miminum of $50K, maybe upto 150K. Which wouldn't be near enough. True justice would mean she goes to jail along with every cop who backed her up, and none of them would ever be allowed to work for the public, that might approach justice.

      I'd probably throw the Prosecutor that initially tried to push for a plea deal rather than immediately dropping all charges into prison for a year or two as well (and say a 10 year suspension of their law license). Pure scumminess and definitely not serving the People.

      If you carried out those same physical action it would be kidnap... So if the situation does not meet the standard for arrest and none of the conditions or criteria for arrest are satisfied, then it can not be an arrest. Void of the classification of an arrest the actions are all criminal. But the system doesn't like to recognise reality.

    Thank God there is another human being who refused to "obey" the unlawful muzzle policy. A mandate is not law. I got chased by 3 store employees and then finally a manager at Menards for not wearing one. I was in ordering a $5K garage kit to build. He kept repeating...."I'm asking you politely" and I kept repeating "I'm answering you politely, that I will not have someone dictate if I can get oxygen." What amazed me was all the sheeple that just "followed orders." The ignorant bring down the informed.

    Even if the victim won in court he still lost because he was publicly humiliated, sent to jail, paid bail and legal fees, and went to court. While the cops laugh it off behind their qualified immunity.

      The crime was trespass. But because she messed up badly, the actual crime was a violation of the 4th amendment, and SHE was the perpetrator. And the real problem is that SO MANY cops believe you are required to provide your ID when they demand it. And they seem to demand ID for just about every interaction, regardless of whether demanding that ID is lawful or not.

      @@iknklst Exactly. The first thing she should have asked, did you ask him to leave the store. Part of the Supreme Court rulings the person must be first asked to leave, refusal will then be a criminal act. Until that person is asked to leave, its a civil case.

      @@rodh1404 I think the only time trespass is a crime is "Trespass after warning." I may be wrong, but the first trespass simply verifies the person has been asked to leave and warned to never return. Only if they return is there a crime.

    Same as always. The DA bluffed all the way to the court date trying to badger him into taking a plea deal instead of actually looking at the laws that might apply here. When they finally did look, they realized they had no case and dropped it.

      I agree. The DA's office always start out supporting the police and try to push for a plea deal. It may be that the DA thought he had been tresspassed because the lady cop kept saying that, but the video clearly shows he was never asked to leave by the store employees.
      I hope he sues the cops and the Department.

      I was fortunate to have experienced a similar court date. The incident was in a CVS. Since I'm not stupid I knew that we were on camera so I kept my hands to myself and left. The manager made all sorts of allegations and I got charged. Day of court they offered me three plea deals and I turned them all down with a shit eating grin and right before they called the case, charge dropped by the prosecutor. Damn it felt good

      As much as I hate for auditors, this is why they exist. People can just silently call the police on you without saying anything to you and then lie to the police and the police are just coming to arrest you. It's actually a common problem in America, if I call the police and allege the right thing on some random jogger jogging down my street they will come and respond a certain way and if I allege the right shit they'll take you to jail and force you to bond out with no evidence... I had a neighbor who called the police on me for all kinds of shit, everyday at 1 point And everything he accused me of was a lie But the cops came to my house every day to tell me off and threatened to arrest and ticket me everyday regardless so I put up some cameras in and outside of my house and hired a lawyer(Without saying a word to him, you know lol playing his game) And eventually the cops stopped showing up because he called the police a few times and lied to them after I had hired my lawyer and brought him to the sheriff's department with me but they showed up at his house and threatened him instead So he eventually stopped and then decided to start threatening me ever start threatening me every time I left my house lol one time he chased me down the street With a nail gun and the police wouldn't come arrest him but they have no problem coming to threaten me intimidate me and arrest me over that's me over false allegations that have been confirmed false.... It's a mess bro, it really is, what the cops don't realize is that sometimes they should just leave people alone And if that's not an option how about just arrest the right person, I had proof of him making false police reports threatening me harassing me a harassing me and they didn't do anything to him... Not exactly sure why but I have a pretty good idea lol usually that only happens if his wife works as a dispatcher or some crap there are some crap, if somebody who lives there was a cop I would have been dead so I know that's not what it is but it's still weird
