This would stop pretty fast if they made the camera operators appear for the court cases. They're the accuser, and you have the right to have your accuser.
They currently play this game where nominally an officer reviews the picture and reading (ie glances at the printout) and signs off it and is therefore the accuser. Ask to face your accuser in court and an officer sits down and says yep it was that car in the video and the radar readout said that speed. **bang** "guilty! pay up sucker".
There is no camera operator its an AI. You have a 6th amendment right to face your accuser. Which in this case is a non human entity. Those cameras are unconstitutional. We cant have them in Michigan. Supreme court said no.
I've beaten these unlawful camera tickets where I live in Cleveland, Ohio. I'm excited to see people do their own research by studying what the law says and using their own codes and statutes against them. It's to bad most people are believed they can't seek a remedy in court or thinks they have to hire an attorney. I was also happy to see the judge rule based on the facts and the law. Mad respect for that judge, I'm proud of him, because there are judges that don't want pro se litigants winning in court. They view us as being stupid or anti govt. Sick of hearing that argument when people served and died for this country to allow us citizens to challenge the people they swore to protect us. I'm disappointed with the city saying they don't care what the statute says and their going to continue to do this. Which means the powers at be that swore to protect our rights will choose greed in order to gain revenue for their political subdivision (city to the ones that don't know law). I hope people go to their city council during an open forum meeting to address this, but they'll sham you mostly, but hopefully someone is smart enough to hold them personal responsible. Hint hints their oath of office
There was a traffic cam right by where I lived in south Phoenix, they stopped fixing it after the tenth time. Funny how it mysteriously stopped working about a day after it was fixed each time, then they stopped fixing it.
I got a ticket a few years ago in CA for doing 35 (the posted limit on that street outside of school hours) on a weekend, during the summer, at around 11pm. The judge upheld it saying the sign said "When children are present" which means children can be present any time day or night as that is their safe space. I took it to the next city council meeting and demanded they change the speed limit on the street to 25mph if that was the case and they refused saying it was the drivers responsibility to decide if they needed to slow down outside of school hours.
I got pulled over by a cop doing 40 in a posted 40 through a school zone that said only when students are present. The cop said I was speeding through a school zone. I told him it was Saturday and the school zone sign said only when children are present. He was rubbed the wrong way but had to let me go.
That judge is just excusing his salary there. If there were no children around the sign didn't apply. A qualifier of that sort is only useful if not always true. That screams for appeal. usually a traffic court appeal is few bucks for a do-over at the county level.
11PM? Wouldn't there have been a curfew for kids at that time? I don't know why people support pigs the way they do. I wonder how safe they feel when they see the red lights in their mirror. Trump supporting the bastards as he does is absolutely sickening.
So legally it is this, if it is a city law, you have to pay, as the judge is correct, as children may be present. However, if this is something that affects a code of law with the DMV, as in their publications it specifically has the code of law, and the definition, to which that usually would stipulate during school hours. If that is the case, you can appeal on those grounds, and the case would be dismissed.
One point not mentioned is the tickets have a Police Officer signature..The two I got did..😮 How is that if no police officer was present..I just rode through a school zone at 7:58pm, why is the school light flashing.. 🤔 August 1st, 2024..
No officer writing that ticket/signature means it's not valid... it's not protecting kids. This is policing for profit. Gotta build up that $$$ for those inevitable lawsuit that police seem to have.
In the early days this got a few tickets tossed. The officer couldn't say they saw anything themselves. Later they decided the signature meant the officer witnessed the contents of the photo as valid and this was considered good enough in most jurisdictions. Those that had laws that required witnessing the actual violation in person (or wording the courts wouldn't accept meant seeing a photo counted) Took longer to update their statutes. There are still a few jurisdictions where you have a way to refuse the validity of the ticket or some such. So basically it's optional to pay them IF you do the refusal correctly. That last is pretty rare though so check with a lawyer first for that or anything else legal. I'm not a lawyer and not giving legal advice.
we had that in ohio until they changed the law that said a police officer had to be present when the traffic camera caught the supposed violation. some places still use them, but in my home town in particular they just shut them off because of that ruling, and conflict in the appeals process if you wanted to fight the ticket.
The argument about it being cheaper to just pay the fine doesn't appear to include the increase your insurance bills will get for getting a speeding ticket..
Good point, but it may not involve the insurance at all. I've had a family member get a red light camera ticket and since no police issued the ticket it didn't involve any points added to the driving record nor any notification to the insurance company. I don't doubt that it's probably different for each state.
I watched a video about the Fulton County Water Board (could have been FOX 5's own) charging a home more than $30,000 for their water bill. The problem? The home has no water lines! Even despite a Water Board employee saying it was wrong to charge the owner, the Board still insists the bill is valid. Imagine that! Unfortunately, I can't say I am surprised one bit about those illegal cameras.
How can that street be considered a school zone when the school is as they 1600 to 2000 feet away on a whole different street. It is nothing but a cash grab, $75 by nearly 6k people. That's almost half a million dollars.
If you really want to see a bad one, go look up the N. Slappey Blvd. cameras in Albany, GA. A five lane 45mph road with NO flashing yellow lights to even warn you there's a sudden 25mph school zone, and the school is on another road and nowhere near that main highway. Thousands of tickets dished out with residents threatening a class action suit against the city and the camera company. It's a huge mess.
There is a camera on Welch Street SW and University Avenue in Atlanta. You should definitely look into that camera. Since I got a ticket 3 months late in the mail, I went to the location and did not see any sign.
Hundreds of miles of roads are mislabeled with speed limit signs that are placed by the locals, and not the state. It would be a really good idea to check on the actual speed limit set down by the state on that particular road.
Here's the caution on that one. Many such laws have "or such (lessor) limits as the dot (and/or local municipality) determines" so if the official law defaults a road to 50 and the dot in it's official capacity places a 35mph sign for a stretch of that road and you do 50 anyway the ticket will be valid. So double check with your DOT and/or lawyer if it matters. A handmade sign from nearby landowner who also wants you youngens to stay off his lawn doesn't count, and an HOA printed and placed sign at worst gets an hoa fine for violations (NEVER LIVE IN AN HOA). Sometimes municipalities think they have more authority in this than they do, usually smaller ones run by ego's vs brains. And sometimes a sign is not in the city limits even though they thought it was when placed. I know a guy got pulled over under that situation once. Lawyer went into court and pointed out the sign almost a mile outside town the cop parked next to it and pulled him over still a half mile from town. ticket went bye bye. Took a few more cases before the sign finally got pulled. I think a miner state official got caught and raised a stink.
So let's say at approximately $75 a pop, the city of Atlanta raked in almost half a million on improperly placed cameras and illegal tickets. SMH.... who's benefiting from those funds, there needs to be an investigation into them, the camera placement, DOT (state and city)
I pray the issue gets fixed before it wrecks havoc on the already chaotic auto insurance situation we have in this country **speeding in a school zone ain’t gonna be kind to your premium**
One of the biggest problems with school zone speeding is the arbitrary and capricious definitions and speed limits for school zones set by school districts and government. How can anyone expect drivers to go 15 mph for close to a mile, especially during the morning rush to satisfy the greed and power grab of some bureaucrats or private camera company?
How is it that the (most likely corrupt) DOT and skrool board get away with breaking their own law of 1,000 feet and not get sued under a class action law suite ??

@@KingFergus The right to confront you accusers merely means they got clever on how they define accuser Is the officer or his radar gun your accuser? This makes the officer your accuser. A bit of a stretch, but not as obviously a 6a violation. The number of stories of these being misused shows that there needs to be updated laws with regard to the cameras or maybe just going back to having them banned.
It's not a legal ticket unless it's served to you by a law enforcement officer who personally observed, estimated, and verified the violation and contacted the driver and verified ID.
Cities near me went all-in for red light cameras. What we finally found out was that they shortened the yellow light duration. It was private companies that installed and contracted with the cities to collect the fines.
We used to have cameras like that but most of the tickets were dismissed because the cameras didn't show up to the hearings to testify. Something like that but they got removed.

Such a racket. Take a whole day off work, waiting in line and through security to hear your case, even if you get a ticket thrown out, maybe you get court admin fees, etc. Who would do that?
The letter from the school (3:17) only shows that speeding tickets declined not that any accidents/incidents involving the school staff or students did so. I hope the school/city gets sued and has to give all of that money back with interest.
They need to give the money back to the people who have paid these fines but they also need to have the tickets removed from their drivers license because it's driving their car insurance rates up as well.

"They" vote them in year after year so... meh.

There is one word to describe why the City of Atlanta wants these cameras where they are:
*REVENUE*
Could also be racism. What's the demographic of the population that commonly navigate that road?
Surprisingly, a HUGE percentage of that revenue goes to the camera company, not the city.

Wouldn’t issuing false fines be classed as mail fraud?
Good question, one would think so. And, mail fraud is a felony. Seems like something that should be pursued by someone who's been ticketed.
Try to find a lawyer to take that case and if you do then find a judge that would hear it. It most definitely is fraud however the fraudulent party is the one making the rules.

@@mlong9475 Yep. The only way to fix things like this is to get the courts to force the change, the legislatures to force it (in both cases there can be conflicts of interest, you may have to go up a tier or two) or to make it more expensive (hard to do, retaliation does happen). or to bring lots of attention to it (this news report).
That's why the make paying them with no points so easy. Basically it's either take off work and spend the time and expense of fighting the ticket, or pay the new "tax".

Several years back I received a radar ticket from the Beaverton, OR police for 35 in a 25 (no school zone). One savvy motorist found that the radar van was set up one block outside the Beaverton city limits. Their limit was on the west side of Target and the van was on the east side of Target. Received a surprise letter in the mail with a check from the City of Beaverton and a Xeroxed letter of apology from the mayor. All citations for that day were refunded AND DMV ordered to remove the violation from all records of those cited. So proud of it I hung it in my cubicle at work for a time with a small sign above it saying "score one for the common people".
This sent a shiver through my spine. It’s shocking how bold this government entity has become. I am definitely going to be reading bylaws in my county. 😢

I was mailed a traffic ticket from a place I had never been. Hoffman Estates, which is near Chicago, sent it in the mail. easy win for a lawyer to pursue as a class action and get paid. Hope one comes forward to take this case.
It is.
They tried this in my town. They eventually stopped because you have to be able to confront your accuser. You can't do that with unmonitored cameras.
You must have missed it. Our government has been rolling rights back. The 6th amendment is no longer valid.
All you have to do is go to court and say you weren't driving; case dismisses.
Go to court ask for the officer writing the citation

The people that set them up illegally should be jailed for violating the laws! Camera wasn't even on the same road.
We had a camera something like that.
It kept getting damaged, I don't know how.
After the third camera, they quit replacing it.
There was a traffic cam right by where I lived in south Phoenix, they stopped fixing it after the tenth time. Funny how it mysteriously stopped working about a day after it was fixed each time, then they stopped fixing it.
Good luck getting that many tickets refunded. Bet the cameras come down one way or another now😂😂😂
Forget the refund and just take down the cameras. At least that will prevent other victims
Those 6000 people should vote as a block and recall or vote someone out of office
@@kaseyboles30 Thanks for the valuable information..🫶
That's why Tennessee supreme court stated camera tickets are a violation of Constitution.
we had that in ohio until they changed the law that said a police officer had to be present when the traffic camera caught the supposed violation. some places still use them, but in my home town in particular they just shut them off because of that ruling, and conflict in the appeals process if you wanted to fight the ticket.

Some minor violations don’t go against insurance or add points to your license.

Wow, over $375,000 in fines issued by a school zone camera that isn't supposed to be there.
There's a reason why these things were banned in Texas.
They just had to refund thousands of dollars in Clayton County for this same reason! Keep fighting!
Either this is a scam or a mistake. The fact the city won't drop the illegal fines points this issue towards scam.
Why can't people just do the right thing. They know they messed up. Apologize and simply issue refunds.
Because no-one wants to be wrong, and a refund could occur, totally unfair.
a friend got a ticket and took it to court and got off because their MUST be a warning sign of the camera within 100 feet
In my city you only go that speed when school is loading and unloading children which has a blinking light that indicates that.
There is a camera on Welch Street SW and University Avenue in Atlanta. You should definitely look into that camera. Since I got a ticket 3 months late in the mail, I went to the location and did not see any sign.
So it takes a camera to give a ticket to a cop going 14 over, cops don't give speeding tickets to other cops.
Thank you to that man for standing up. All heroes don't wear capes
I pray the issue gets fixed before it wrecks havoc on the already chaotic auto insurance situation we have in this country
**speeding in a school zone ain’t gonna be kind to your premium**
One of the biggest problems with school zone speeding is the arbitrary and capricious definitions and speed limits for school zones set by school districts and government. How can anyone expect drivers to go 15 mph for close to a mile, especially during the morning rush to satisfy the greed and power grab of some bureaucrats or private camera company?
The corruption in this age of information is unbelievable! So so many bureaucrats need held accountable and sent to prison!
In Massachusetts, getting a speeding ticket and not contesting it (if in error), would increase a driver's insurance premium.
Plead not guilty and make these corrupt morons prove their case in court.
That's true everywhere; but only for officer-issued tickets, never for photo-enforcement tickets (can't identify the driver).
How is it that the (most likely corrupt) DOT and skrool board get away with breaking their own law of 1,000 feet and not get sued under a class action law suite ??
Yeah use a Camera instead of an Officer… I guess the human officer costs more.
Ridiculous! Have an officer not a damn camera!

@@KingFergus The right to confront you accusers merely means they got clever on how they define accuser Is the officer or his radar gun your accuser? This makes the officer your accuser. A bit of a stretch, but not as obviously a 6a violation. The purpose of these experiments was to gauge the extent to which individuals would comply with an authority figure's instructions, even if those instructions conflicted with their personal moral compass. Participants were led to believe they were assisting in an unrelated experiment involving the administration of electric shocks to a "learner." These simulated electric shocks gradually escalated in intensity, reaching levels that would have been fatal if they had been genuine.

These cameras should only be on the immediate streets near a school, not half a mile away on streets that are not even CLOSE.
The number of stories of these being misused shows that there needs to be updated laws with regard to the cameras or maybe just going back to having them banned.
It's not a legal ticket unless it's served to you by a law enforcement officer who personally observed, estimated, and verified the violation and contacted the driver and verified ID.
Class action law suit sounds good to me! Maybe the school gets a kick back from the $$
Should be illegal in any state to receive a ticket from a company out-of-state with these camera setups.
It doesn't look like the school is even on the same street where the cameras are located.
The State Law defines a School Zone as being up to 1,000 feet from the boundary of a School Zone, therefore a school zone camera installed at 1,600 and 2,000 feet from the school are not LEGAL!!!
Therefore every Ticket issued by these 2 Cameras are not Valid and must be cancelled, expunged from the Driver's Record and the Fine refunded...
Such a racket. Take a whole day off work, waiting in line and through security to hear your case, even if you get a ticket thrown out, maybe you get court admin fees, etc. Who would do that?
One local records as you drive away from the school zone. You would think they would be concerned with car speeds entering the zone……
The letter from the school (3:17) only shows that speeding tickets declined not that any accidents/incidents involving the school staff or students did so. I hope the school/city gets sued and has to give all of that money back with interest.
Can a city be called a scumbag?
They need to give the money back to the people who have paid these fines but they also need to have the tickets removed from their drivers license because it's driving their car insurance rates up as well.
The people who got tickets need to be refunded if they already paid and the people responsible for these illegal cameras need to be charged with a crime if they refuse to remove the cameras.
