    You have given them a year to get the tractor's, that is more than enough time. I bought a loader from a guy and I ended up in the hospital. I paid him for it and I finally told him that I was not going to be able to get it picked up and to resale it because I didn't know when I could get it. I told him it wasn't his fault but mine and he just made $200.00 because I couldn't get it in a timely fashion. You can also put in the sale agreement that you have 30 days to pick it up and if it is not there will be a $20.00 a day storage fee. Good luck. I do enjoy your videos and congratulations on your upcoming wedding.

    I would suggest payment upfront.
    Give them a month to collect.
    If not collected after a month then charge a storage fee. If not collected after say 3 months resell them.

    You need to charge him storage. Because that's what they do here and Iowa. If something's sitting over a certain time, they start charging you storage in a storage is probably already more than what they paid for the equipment. So I would say the equipment is yours

    Most auctions I've purchased from is 14 days or 30 days to pickup then after the time frame it's 25 a day storage fee then after 60 days you forfeit your money with no refund. I live in Texas and purchased tractors in Nebraska Kansas and Iowa and had zero issues very friendly fols up north

    Some individuals don't have the same passion, but are "impulse buying" and then rethinking. Have purchasers put down a 25% deposit that is forfeited after say 30 days when they don't pick it up....1 year.. !?!? Too long 30 days tops... Sometimes you gotta have rules...!!! I was a nice guy and got taken advantage of when I ran a business....In God We Trust, All Others Pay Cash....We All have issues to deal with, but business is business, not a charity....

    I tend to not let things worry me. If its paid for Im Ok with it being here. I once sold a guy in Califorina a V 12 lincoln engine. He asked how long to come get it? I stated its yours until I die then it will get sold at my estate auction. I sold a guy in New York a Running driving 59 ford Ranchero. He paid cash and I never heard a peep from him in almost a decade. He called and came with a car hauler. He was dissapointed it wasnt running the tires where flat and it had gone downhill. I put it on the hauler with my wrecker and sold him a 72 chevy pickup.

    I would just re sell all those tractors to someone else, and I would not bother to give any of those guys their money back, at this point I would call that a storage fee. You likely missed out on selling these tractors to someone else while you where storing them.

    Storage fee seems fair. Post on this video to pin at the top a list of trucking companies you know are fair to use to get equipment around the country. I suspect the buyers were all in it until they found out what the trucking expense was (so high!) and then abandoned the projects, two or three tractors hauled on a hot-shot trailer to the east coast was probably quite a lot (maybe with cooling competitive trucking industry the prices have lowered recently vs before?). The Allis Chalmers forum has frequent thread updates from a guy who transports old tractors regularly stating he has a run to some area and if you are on the way he can grab something extra, and extras have included non-orange and non-tractor things like Model Ts.

    Give set timeline to pickup the goods set at the sale date, then a per day charge after that date. The higher the better for motivational purposes. If they can’t pick it up or contact you after a timeline agreement it’s yours and possibly a bill. Simple contract

    I bought a tractor a few states away and told the guy it may be a few months before I could get it. He said fine and I had it picked up a few months later. People need to stay in contact with each other and make changes that both parties agree with if necessary. A second phone number may help if it's an older person or bad health situation. Leave each other plenty of info.

    Fellow Kansan here. First of all, congratulations on your upcoming wedding, and my understanding of state law is if not paid within 30 days the item will be sold, period. Only speaking for myself, anytime I purchase something, I bring the means of collecting and removing the items in question at the time of the sale.

  • @lindanelson8400
    @lindanelson8400 7 місяців тому

    You've given them every opportunity to come get those tractors. Now You've given them a deadline in the form of a video. I think I'd go a step further and send them a registered return receipt letter with the terms stated in this video. I wouldn't give them a refund. It's abandoned property taking up space on your land. Sort of like when you don't pay for a storage unit, after a time the storage company auctions off the contents.
    This also coincides with my motto on life. "Every time I give someone a break, I go broke."

    I wouldnt normally comment on any business structure but i will say this..... Almost any and every shop i have ever walked into had a sign on the wall saying you have 30 days from the time your item is sold to you or you have been notified your item is fixed to be picked up. Day 31 starts a storage fee daily and after 60 or 90 its the shops to do with what they like.

  • @marks8068
    @marks8068 7 місяців тому

    Id start with doing proper sales registration, dated bill of sale with name, signature, adress and creditcard info on it.
    If the deal includes a one month pickup time note that clearly, and include a XX amount of money on top of the purchase price that gets returned to the customer if they pick up the goods within the agreed period, AND include a statement that every item left on your property after lets say 3 months past the "end of pickup period" gets sold for scrap.
    You are a commercial business, every square foot of space needs to make u money, keeping other peoples shit on your property doesnt do anything for you.

    what is morally right, and what is legal may or may not be the same thing. If they are still up in the air at this point, I would have a certified letter sent to them with a 30 days from date of receipt to either start paying exorbitant storage fees, or retrieve it in that 30 days. After the 30 days if they have not done those things, then sell. Document everything. You may drop the Fordson off in my driveway 50 miles west of ya... LOL

    Crazy D, did you happen to ask that lawyer if you were entitled to charge these people for storage costs for these tractors? If not, it might be worth asking them if that is something you can bill as storage fees to current date to these people, and tell them in the letter that you send the people who haven't picked up these tractors, that they have to pay the storage fees for these tractors and have 30 days to pick up the equipment or it will be sold. That's what I would recommend. If you are entitled to charge storage fees, and they don't want to pay, then you can forward them to a debt collection agency and get your storage fees back from them.

  • @jeffhoman767

    Ran into this with my mother when my grandmother passed away in 17. There where the three kids, my mother and her 2 oldest brothers. The family farm was split between the three and there was some of their equipment on her part. She in turn said 6 weeks and that was it but kept adding on time and nothing was ever done till ultimately dad and I said by the end of February of 21 that’s was it, if the equipment wasn’t off property then it would be sold or scrapped and that’s what we did when we got to it. So in short give a time frame and when reaching that limit remind them and once at that limit reach one last time and then proceed from there.
