  • Hannah and Richard have been doing a split custody agreement where the children were with each parent during the day and at night. Hannah's work schedule changed and she wishes to put the children in daycare for the day. Should either parent have to pay child support? Check it out!

    I'm scared of germs, too. But, my kids went to daycare. And, it builds up their immune system.

      My daughter went to daycare for two years from age 3. The thing is, once kids begin to mix, they bring germs home. The same as when they go to school. Kids are germ merchants. So after she started day care, *I* started to get sick more, so the guy actually has a point. Perhaps he is worried for his job if he needs extra time off due to things he might catch from his kids. I’m self employed, but I can see how it could be an issue.

      As a person who actually attended daycare I hated it. It was like going to another school after school. My husband and I chose our jobs to be able to work without needing to use daycare. I understand some people have no choice but for our situation, I thought of our work schedule prior to us having kids.

    I don’t think this was a fair reconciliation. He has a valid point they split the time and if he had placed the children in daycare during the time he has them he would simply pay it. She took a different work schedule and instead of working with him to swap times where he would take them during the day and she would take them at night she opted to place them in daycare-so she’s pretty much not going to have them since they’d be leaving and going to him after. And when the judge brought up child support he should’ve said “yes, base child support to each other off of each of our pays” since she would’ve had to make
    The mother pay as well since they have shared custody

      OP, you have no idea if they attempted to work out schedules, if anything it actually sounds like they did but it just didnt work. They could also already be at an adjusted time.
      THAT said, i will agree that i felt the judgement was wrong. But for one reason and one reason only.
      That man clearly has a rather severe personality disorder and this is something that should be taken care of by the state.

      @@undergrounddojokeyboardcag701 Again it doesn’t change the fact they have shared custody and evenly split the time they have with the children. During the time they are in his care if he has to utilize childcare he pays for it as it’s during his designated time and she wouldn’t be paying it. She is fully aware of how they split their time with the children. She chose to take a rotation that would affect her ability to care for the children when they were in her possession so she opted to place them in childcare. While that is her right to do during the time the children are in her custody there are two things that should not be affected by it. One of them being his time with the children, his designated time shouldn’t be affected in order to accommodate her decrease in physical time with the kids. His financial contributions also shouldn’t be affected. This is not a situation where she is the primary custodial guardian and he’s a weekend and holiday father and she has to rely on childcare to ensure she’s able to financially support them full time. I hate my ex husband, absolutely loathe him, we still have joint 50/50 custody. Neither of us received child support nor do we receive reimbursement for child care costs. We both care for the children for half of the month every month. This is an instance where the best interest of the children was not being taken into consideration or how it would effect them. I also know in the state I reside in given the shared custody she actually wouldn’t be able to place the kids in childcare without his approval as they would both have to consent to allowing the outside party access to the children. That’s something people also seem to forget, every state doesn’t default to this mindset and some are actually fairer in their rulings regarding the parents in these cases. I would actually urge him to use this ruling as proof that it would be in the children’s best interest to reside with him on a full time basis.

    That dad has no idea that keeping kids in a sterile environment all the time would actually make them more susceptible to disease later on in life, making uneventful colds a life-threatening situation for them. If I had a parent like that in my classroom, id have social services called. I’m surprised the mom didn’t prescribe the kids to go out and run around in the dirt around farm animals-it’s fantastic at that age for allergy prevention.

      Technically you can't take a person's child away because of a mental disorder unless it is interfering with the care of a child. We don't know that it is yet with him. But the good news is that because they have shared custody the mom has the right to make choices without his permission as long as she has the judge backing her up. Which she does. I'm not massively worried about the kids unless his OCD escalates. At that point, the mom can file for full custody with him having supervised visitation. And then he'd be ordered to pay child support which is actually more than what he's paying now at only $500/month. So if he's smart he won't let it get out of hand and he'll follow what the judge says.

      How do you figure that? He only has them half the time. The rest of the time they're either going to be with her or at daycare. Daycare isn't the father's time. That's her time. I actually feel bad for her doing that. She probably wanted to switch the hours and he probably refused to do so because he clearly has OCD. OCD people don't do well with change. It has to do with that they constantly try to control everything. She's going to be missing out on time with her kids. She can't be happy about that.

    If they have a shared custody agreement in which she is responsible for the children during the day and he is responsible at night then why would he have to pay half of the cost of child care during the day? If he hired a nanny to what them at night so he could sleep interrupted would she have to share in that cost as well?

      My husband had to pay for day care even though he was available to care for his daughter during the day and worked nights. The judge said “mom feels it would be beneficial for daughter to go to day care” so even though he already paid support, he had to pay for the child care bill as well. Keep in mind, this was “needed” because mom just wanted it. She didn’t work but would not allow my husband to have her some days.

    This was not fair to the Father, it was the Mother's choice to put them in daycare during the time she agreed to have them, he has the children at night and not has to pay for her decision to work during the day. That isn't fair.

    One of the very few times i dont agree with what was done. If i were him i would get a lawyer. He may have made out better dropping the BS about dirty daycare just gone on his last argument about he takes care of kids during his time she should pay for daycare during her time.

      jim hike That’s just it when it comes to child support. Judges have plenty of discretion and can order what they believe is in the child’s best interest. Google §154.123 of the Texas Family Code.

      Child support and custody are two different things. She being a doctor is irrelevant. Judges have discretion to do what’s in the child’s best interest and in this case, the judge believed it was fair for the parties to split the cost.

      I under stand all that and i think the laws and judges lean toward punishing men. And with the big differance in income should give him some child suport so the kid has the same quality of life at both homes. As it is she has the disposable income to be the supper parent he does not. That reflects on kids as they grow up mom did everything for me took me places and bought me things dad did very little. You know that and every person that has had a divorce. She offerd to have him pay child suport but didnt offer to have her pay xhild auport to him based on her salary rather than pay the day care. How is that not favoring the woman? Im sure her xhild auport would be more than $1,000 mo.

    So if the Dad wants to get Pizza during his time can he send her HALF the bill?
    The judge is caught up on how 'cheap' to BABYSITTING service is...but the judge FAILS to realize the mother just got OVER
    They agreed upon SHARED custody based upon day parts...
    He was responsible for NIGHTS
    She was responsible for DAYS
    So now...he still has NIGHTS 100%
    Yet, she now doesn't have DAYS anymore because she unilaterally chose to outsource her day part to a babysitting service...and to make matters WORSE....he has to actually pay HALF of the bill SHE chose to incur, in order to NOT have true custody during her SHARED child time.
    Again, if Dad goes on dates and uses a babysitter at NIGHT during 'his' shared time...I'd hope your honor would see it the EXACT same way and award HIM 50% of 'that' reasonably priced babysitting just the same....because it is EXACTLY the same scenario.
    I'm sure he'll find a 'nationally' accredited sitter of 1 & 2 year olds...😂

      100% agree! This is the first verdict I didn’t agree with. Dad takes care of nights on hundred percent and now mom needs help with her half of the day, so why is it fair that dad has to pay for a half of the daycare she got for HER time. I would say the same thing if they had a nanny. If the nanny is only there during the day then she should be responsible, if it was a night nurse that is only there at nights, the dad should be responsible

Cause at the end of the day he is still going to have them every night. She is getting off not having to be bothered with her own kids and getting paid for it.

      Oh she probably has and knows that it's useless to explain it to him. People with OCD aren't rational. Their underlying issue is control. He's afraid of germs because he can't control them and can't stop his kids from getting sick. Nothing about that is rational and trying to "explain" only frustrates them and they will become more and more stubborn the more you "explain". There are components of delusion with people who have OCD. You can't talk to them until they're willing to listen to what you say.

      I agree. They are BOTH the parents and while it DOES sound like a nice daycare, the children are very young and I see his point that maybe it would be best if they stayed with family.....or he at least needs to have an equal voice in where the children go to be cared for. I went to daycare. I very much enjoyed it. We made friends there. We got the opportunity to socialize. He's not even giving this a chance. He's just judging it to be dirty and unfit without even looking at it first.

      What if he had a daycare at night for the children, would she have to split it with him also? Don't seem quite right if he has them at night and he gets nothing for taking care of the kids but she gets money for daycare where she is not taking care of the kids.

      you know that woman needs to work, right? He has the kids during the night... they are sleeping. She is the one that does most of the work during day time. Yes, no child support... but who pays for that womans rent, her expences etc? If she works only the nightshift, so he can get his will and she takes care of the children during the day... when exactly would she have time to sleep?
      He wants a SAHM for his children, but didnt pay her (not the child) for staying home... doesnt work that way.
      Also he looks more like someone who works in an office (with his phobia etc)...so no nightshift for him...
      In bonus point most people dont understand: Shared Time means also shared expenses for the children for ALL activities... (Daycare, School, Hobbies) outside the home. In our country its actually the law, you have split custody 50-50 than you pay half of ALL expenses for the kid as well! Only if you havent 50-50 one pays the other child support on a monthly basis 🤣

      @@charlesayers3177 because split custody 50-50 means the both need to pay 50-50 for ALL the expences outside the homes.... simple. kids cost money . clothing, school supplies, medical etc. Kids cost a lot more than some rent, food and water. If you pay only child support its because you dont have 50-50 so you pay one sum for ALL cost (in- and outside the home based on your income) If HE want her to stay home, than he can pay her her earnings that she will lose OR he can shift his workshift... simple. As long as she needed to work, he needed to pay half of all cost for daycare, school-/schoolsupllies etc. If a parent not even want to pay that, than they should use a condome...simple

    Just curious, if they have split custody wouldn't the judge have to calculate both of their child support payments and then the difference would go to the the party that makes less??

    That ruling is not within the bounds of the law in any state. They arrangement is clearly shared custody. Unless the parents agreed, then there is not a payment in lieu of child support. In there cases, they put it in form of child support. The daycare cost is added to the child support calculation. The cost is based on the amount of money each parent make. Its literally the amount of offset income. The Dr would end up paying the most of the daycare cost and it would be in form of child support to the other parent. This would be overturned on appeal in a heartbeat because even in Texas, the state is required to add addition cost to the child support formula. The reason they do this is because this is the only way they can seek payments through title 4 funding.

If the appeals court didn't not overturn this then they are way in the wrong and every man who makes a higher income than the custodial parent can use that appeal case as precedent to reason that they should not pay a higher portion of child care expenses simply case they make more. Please give me the name of the appeals case you are referring to. Most child support always try to reason that the higher income parent should pay the most just because they make more. I really would like a case I can reference where the appeals court didn't agree that the higher income parent shouldn't pay more of the cost when they clearly made more money.

      t t In Texas after a temporary orders hearing (hearings held before associate judges-Dallas county), a party can request a de novo appeal (must be requested in 3 days following the hearing), and have the temporary hearing redone. Those appeals don’t make it to the appellate courts. They are heard before the district court.

      That's really not a appeal. I am referring to the appellate courts. They routinely uphold that the parent who makes the most money pays most of the cost. Most of the time its the non-custodial parent who makes the most(problaby cause they don't have the kid that much) so I don't see why a appellate court would rule in the Dr favor on this. Every noncustodial parent out there would use that ruling if they did that so I don't see a appellate court not reversing this decision. Not having this Dr pay most of the cost would open up a big can of worms.

    The guy should file for full custody, since she doesn't have the time or don't want to spend time with the kids and have her pay child support plus insurance from her almost 200k salary. Then he can get his family to look after the kids in the day. The judgement should not be because it's just 500 it's the principle.

There's no child support because time is 50/50, it makes no sense for dad to pay for what the kids do on mom's time. And vice versa.

      Her female BIAS was showing...when she asked him that STUPID question, he should have said SURE let's based child support on the WIFE'S salary honestly because HE really has custody....if the kids are in daycare during the day and SLEEP at his house....how the F would HE pay 'her' child support?
      The judge's head was up her butt forgetting the facts of THIS case, simply ASSuming a more 'traditional' scenario where sbe could squeeze a non-custodial Dad.
      In FAIRNESS if they have shared custody and either parent wants to get a Babysitter during THEIR TIME, it should be their responsibility and their bill NOT a shared responsibility.

      The judge had the idiotic Tx law in front of her. Equal time Equal pay. If he wants to fight it he should takes it to the court that will change their custodial agreement since she makes more money than him he should get a 60-40 or 70-30.....
      I think that she should pay more if she makes more. BOTTOM LINE IS he didn't REALLY care who watched then during her time he just wants it to be free.

    This is the first verdict I don’t agree with ...if their agreement was she has them in the day and he has them at night then if she needs daycare then she should pay for it especially as it’s so she can go to work to earn three times more than he does !
    Maybe he can have them in the day and her have them at night ?.
    Or at least she pays a larger percentage of the daycare cost as she earns so much more than he does ...if he had them more hours she would have to pay him child support ....yet the judge was threatening to put him on child support when they split care 50/50 ?
    I do think daycare is great for kids if a good establishment is found ...

    I think the judge miss the point of why the guy didn't want to pay. If they have an agreement for him to keep the kids at nights everynight and her to keep them during the day every day. I don't think it fair for the guy to be paying for the time she don't want to be spending with her kids. I can understand if it was school expenses, but not for day care when she is not working during the day. And for the judge to have threaten him with child support for kids he is supporting and have 50/50 custody was like rubbing salt in his wounds.

      There are 24 jours in a day 12 hours each work is 8 hours. They have already been to court. Dont think the dad would win in child custody cases germaphobe dont normally win. They lack ablity to completely care for kids. 1 ablity to leave the house emergency happen hed call her. 2 teaching then to be afraid of the outside because of his fears. Ehen they get to school age he will not retain custody.

What your income level is plays no part in shared custody because you're obviously spending more than if it was a custodial/non-custodial arrangement. Although it’s was not full, I think it she calculated both of their child support then subtracted them, the amount that came was awarded to the parent making less.

      @@rayhaanalykhan I spent 20 years as a single dad raising my 3 sons. Courts are able to just bend over backwards for women. Finally at about year 15, the court finally woke up to what shes been doing over the years and put the protective order in place with her only having supervised visits. She eventually didnt even do her visitations. Luckily I had custody. Plenty of crap stories over the years.

      @@rayhaanalykhan barely and not at all. She originally only had to pay 70 a week for all 3 but got over 4000 behind and they began confiscating her tax returns. Then she quit working the court bent over backwards for her and wouldnt find her in contempt. In about the 15th year when i took her to court for violating a court order, we got the court to put the order of protection in temporary and she no showed the following hearings for 9 months. They even were allowing her to just call in. I was at each hearing date for 9 months. The last one they even tried calling her and she wouldnt answer. The court reluctantly made the OP permanent. The last 3 years she didnt have any visitation. Its absolutely amazing watching the courts leniency toward women, not just my ex. I saw the judge tell a guy one day that if he didnt have this certain amount of support paid by the next month, the guy was going to jail. The judge told the guy that he didnt care if the guy had to sell everything and live in a tent. I dont know what happened to that guy. I filed for divorce the day after learning of her plan to lie to police to get me arrested. I called the lawyer first thing that next day. I struck first.

      Pierre Ashton Who said she is actually spending less time? She said she works during the day. Her schedule could be 5am to 1pm which typically means she isn’t completely foregoing seeing the child even a full 12 hours. Based on their testimony, they still have a split agreement.

      ​@@miekaash6831no. She's following the laws of the Texas courts. Child support and custody is such a tangled mess to figure out that going by the books usually the best way to do it. With her being a Dr, they would be in and out of court every time the hospital puts her on a different rotation getting child support amended. Everyone is so quick to judge, but not think about the reasons behind a decision. You can't make decisions in court based on your feelings. They have a custody agreement in place. Regardless of how much time she is spending with them during her "time" with them, the agreement has to legally be followed. So unless he wants to fight for sole custody and hit her for child support, then the law has to be followed. Sometimes it just sucks.

    This was a terrible reconciliation. If they have a split custody agreement and she can no longer honor that agreement why should he have consequences. And to threaten him with child support when he has split custody was tackie.     The mom cracked the code: have "joint" custody so she doesn't pay CS, she's in charge of the kids during the day, and the father during the night, yet in practice she doesn't watch over the kids at all since she's at work, so the father has to pay 50% of the cost for day care during her hours.
    So in a nutshell, instead of paying CS, she only pays half of the daycare expenses and forces the dad to do so as well. Very unfair decision by the judge and I'm surprised she allowed this kind of arrangement.

    This judge was totally for the mother and not the children. She wasn't neutral.
    If a parent doesn't want their kids to go to daycare, the judge shouldn't force the father to pay 500 a month for something he does not agree to just because the mother wants to. If she wants to send them, she should pay, she isn't taking care of them during their agreed upon time. While he takes them in during the night.
    They have split custody, threatening him with child support when there is no fixed custodian for the kids, when they clearly should pay child support to each other, should get you under review Judge Vonda.
    This whole matter should've been settled in child custody court where 1 of the 2 would get full custody of the kids and the other decides what they do / where they go and the other pays OR like I said above.. the mother should pay.
    In a few years she might want a nanny too and send them to a private school worth 5000$ a month... does the father have to pay half for that as well if he disagrees?

      A'Lay Solace - It seems that he wasn’t working with the Mother in a resolution, obviously her work situation had changed. He could of arrived at court with a child care resolution. But he didn’t offer any real resolution and was being obstinate.
      However it seems that the cost of the day care should be the same for both if the Mother makes triple what he makes. Shouldn’t there have been an offset to determine how much each would pay. Calculate what the child support amount would have been for each parent, then subtracted the difference between the two? I believe based on this the Mother would have been paying the child care bill.

    Sometimes I watch these older videos and calculate how old these kids are and wonder how they are, especially because of this father I couldn’t imagine him being my father I’m sure he’s a wonderful guy if you get to know him but jeez dude germaphobia is an issue people battle with and get better I just hope he learns that

      I mean if you watch the end his behavior is almost alarming, sure maybe they just wanted to do a bit so they told him to do something funny, but if that was true emotion it’s startling. People battling a fear of germs irrationally must really take a tole on one’s life, I imagine it to be near impossible to form deep meaningful connections and build many relationships with people due to being terrified of what they may carry….it was a bit my bad lol

    So the man bass all the over nights and the judge threatens him with child support in Florida she would be paying child support. She makes three times as much and has no overnights that's at least 1200 a month

    This is massively unfair, and this usually fair judge is absolutely unbearable here. They have a 50/50 agreement; she is no longer willing to do her part herself, and he has to pay 50% for something that exclusively benefits her. And this judge is even threatening him to pay child support in a 50/50 agreement situation. Pure injustice.

    Yup. I agree with these comments too. I agree with the dad. He shouldn’t have to pay the day care when she’s the one who wants to put them in it. Like he said he would pay full if it was his time he had to watch the kids. It should be her full responsibility of paying the daycare since it’s her time to watch the kids.

      She's a doctor and just said her job no longer allows her to stay with them during the day. He should help pay part of the expenses. He didn't check out the daycare because he didn't want to. His phobia isn't her problem. He wants his way and is being stubborn about it because he's not getting his way. Ridiculous.
      Maybe there isn't a family member who wants to or is able to care for them all day.

    The judge TOTALLY 'missed' the point AIRHEAD style here....
    1) 24 & 18 month old 🚼 do NOT 'need' to go to school, because soooo much is beyond the capacity of a parent to TEACH a 2y.o. 😵
    2) He is ABSOLUTELY correct.... Because their split agreement was based upon one party doing DAYS and the other doing NIGHTS....if said party CHOOSES to 'do something', go somewhere, where that party can't or doesn't want to take the kids...it SHOULD be, that party's bill.
    * The caveat, that the judge MISSED is that 'normally'
    1) ppl work during the day
    2) kids either HAVE TO be in daycare because a) #1 Daytime work or b) Kids are of proper school AGE...but the BIG miss was
    3) This party who had AGREED to work NIGHTS vs DAYS...totally UNILATERALLY 'chose' to switch where
    1) It couldn't have been that long that she pulled this CRAP because the kids are 1 & 2 ( it's not like she's been doing it for YEARS and needs a break from nights, she didn't even sacrifice ONE freaking year FOR her babies) another thing that's sh*tty specifically for THIS parent is that she is a DOCTOR at a hospital, so nights vs days is MUCH more of a personal cgoixe for her, it'd be different if she were an engineer or CPA where the shift is daytime or ZERO work...she absolutely could work nights only AND still have been a PARENT w/ no real deterrent to her ability to earn ( especially until the kids are more age appropriate for Pre-School if not Kindergarten....it's only a few years but 1 & 2?)
    Either way IF whichever parent had custodial care of them and wanted to 'go out' or warehouse the kids on their watch that SHOULD equal their nickel NOT 50%
    Just like the Dad said...if this is the case, then if HE feels NIGHTCARE is appropriate I suppose she'll pay 50% of that?
    This again isn't a case where there is NO CHOICE but to warehouse the kids because both HAVE TO WORK DAYS...
    She PURPOSELY does not WANT to be a Doctor on night shift, when she ABSOLUTELY could and has been....she didn't say 'Hey the hospital said I'm FIRED if I don't do Days'....no she wants days likely to be involved with the politics of moving UP the corporate ladder quicker, which YES she's right, working days would serve that purpose better....it's a matter of CHOICES.
    Either she WANTS to be there during the kids developmental stages as a PARENT ( where most/many don't get to choose) or she just absolutely PREFERS to not be bothered with 'that'
    But to make the agreement...one party CONTINUES
    1) Working during the DAY and then
    2) Caring for the kids at NIGHT &
    3) Now PAYING for HALF of the care during the DAY, during the time the other party had agreed was THEIR responsiblity?????
    At that point isn't it just HIM being basically the FULL TIME parent and since she DOES NOT have the kids DAY or NIGHT....wouldn't it make sense for her to just pay CHILD SUPPORT at this point
    He's feeding them dinner and obviously their sleeping, waking up, getting dressed,having breakfast and going TO DAYCARE from his house (on his way to WORK) and then RETURNING to his home after WORK/DAYCARE...
    that means she has NO CUSTODY, all she did was choose the DAYCARE where HE takes them and picks them up from....that ALL she has to do is pay 50% of daycare and have ZERO physical responsibilities AT ALL.....
    Why wouldn't she just pay CHILD SUPPORT at this point....she's not covering ANY meals, doing ZERO baths, zero bedtimes, zero mornings ready for school....
    How is it 50/50 if the kids are in daycare when he's working AND with him when his off....if that's the case they should SPLIT night time custody since she has changed HER availability....
    So if he wanted to go on a date, would she responsible for paying half?
    He should just declare for custody and then CHOOSE how he wants to handle it, with a family member etc since he is responsible either way....because again if they sleep at his house every night, he'd be the one transporting them back n forth from WHEREVER they go, so why not just be the whole BOSS vs allowing HER to manipulate the situation, make him drive back n forth to a daycare he doesn't want AND pay 50% of it
    = Hell nah
