- Maternal grandmother wants custody of her granddaughter after her daughter passes away. The child lives with dad, has been living with dad for the past year, but grandmother wants child and for dad to pay her child support. How do you think the Court is going to rule?
To all who do not know she has now become an actual judge. Although these are all reenactments for our educational purposes. She is an official judge as of the end of 2022

At the risk of sounding racist I'm going to say it, I've seen a lot of black female judges and every single one has been the absolute best. I hope this trend inspires a generation. We could use more fair judges.

I completely disagree. The Grandmother was raising her grandchild while caring for her dying daughter - her daughter died and she lost her grandchild at the same time, she's grieving, you can't blame her for wanting to with her daughter's daughter.
She will have someone file an anonymous report that he is viewing porn and the kid will be kidnapped by the State and dumped with Granny.

or dad might work and needs a babysitter everyday. i dont have kids but i work 9 hours a day 6 days a week and that is my scheduled time not the extra hours i put in throughout the week. (im one of the chefs in a resturant)

There's plenty of couples, single people that have sitters more than 8-10 hours a day, some gasp! even have live in Sitters, get free room and board and some cash for being a sitter, cooking, cleaning. it literally goes on ALL the time. They also split up BEFORE she got sick. He isn't allowed to move on?

Any lawyer would have told her to file an anonymous complaint with child services in order to have a chance with getting custody of the child. Of course that same lawyer would have probably also told the woman that once child services starts an investigation and rules against him, it might generate other legal problems for him which will possibly impact his job and impact his child support payment.
Whenever I see this series on youtube I can't help but think it is all staged. It is an attempt to educate people on Texas civil law in order to prevent civil cases that would be considered a waste of court time.

This magistrate is right up there with Judge Caprio from “caught in providence”. She’s is fair and consistent. There’s “Letter of the Law” and then there’s “Spirit of the Law”. The law allows the judges to use her discretion “Spirit of the Law” and Judge B uses it appropriately. You’re making the founding fathers of this country proud of you!!

“Hurt people hurt people.” No truer statement. Grandma is grieving and hurting another person. What she doesn’t realize is taking a child away from the dad doesn’t just hurt him. She’s wounding her own grandchild causing that child a lifetime of pain. All because she is hurt and has became bitter. Sad, because she’ll probably lie and accuse him something bad and find a person to lie as a witness. She’ll find a way to destroy this man!
He needs to completely cut her out at this point he should supervise the nightly calls if he allows that to continue.

Sometimes you may have a babysitter even when you are home because you are working from home or you need extra help. The child could have special needs, medical issues, or maybe the parent is just overwhelmed on particular days. Unless we see evidence otherwise, nothing shows that the babysitter is unfit or mistreating the child at all

If I wanted to payyyyyy a babysitting service BY A STRANGER it’d cost me 2/3rd’s of my entire months income from one of my two jobs and that’s not feasible for just living off rice and beans with no governmental assistance either cause apparently single fathers like me don’t qualify for food supplements or financial aid like ever. Sorry I disagree with you, the child is her grandchild. Part of this problem will be grief, and anger towards her former son in law for as she see's it leaving when her daughter needed him most. Breakups are rarely clean and simple especially when there is children add in bereavement of a parent at such an early age. This woman is grieving and scared of losing her grandaughter as well as the thought of seeing her neglected.
I'm willing to bet my home Grandma was the reason for their split up, They also split up BEFORE her diagnosis and death. The child went to the sole surviving parent being Dad. I love watching your show to see the father's being treated fairly a lot of mothers tried to hurt the father sometimes that can be discouraged them from doing their part but I love you help a lot of these parents with the support that they should have been got for these children keep up the good work
If the grandmother wanted child support, she must request child custody and visitation. It had not been established that she is even seeing the granddaughter. She wants the money and is not spending it for the granddaughter"s benefit. Really nervy of her.
Yeah I mean I can kind of sympathize with the situation ig, but it does appear that way. If he hadn't been around the child for the last 2 years of her life, why didn't the grandma fight for custody right after she passed or why didn't the mother try and make sure the grandma had custody when she passed. Like why wait a full year if it's really important to you

He's totally right on this situation he's her father and she's underage at 6 years old... I have a four year old little girl that's with me 50/50 which isn't fair I was fighting for full custody.. I proved to the court about my daughter's mother how bad of a drug addict and alcoholic she is with seven DUIs the courts still was unfair I might be half.. the court systems are unfair in the state of Wisconsin they go for the women no matter what no matter how bad she is and how much you proved that she's unfit to take care of any child.. my daughter is so happy with me and she is my world even her teacher has said you are a great father and a great provider for your daughter it shows in school you're all she talks about and how much she loves you she's a very smart little girl because of you this is what her teacher said she says I know the core systems are unfair it's a good single fathers like you.. There usually has to be a number of factors, one of which is it's in the best interest of the child, for a grandparent to win legal grandparent's rights. Then there's cases like this one where the grandparent tries to use it as a control tactic and actually have no legal rights to their grandchildren.

I know a man who lost his wife and he was left with 2 little girls. He had a babysitter 3 evenings a week. 2 of those evenings he spent doing household stuff like grocery shopping, laundry and he said he was glad the girls had female company even though their mum wasn't around. The third evening he played chess with his father. As far as I remember that went on until the youngest was about 15. So grandma should not assume any neglect just because a babysitter answers the phone

Grandparents don't have rights to their grandchildren. Unless the parents are deemed unfit but would still need a court to grant them Guardianship or custody.
My dad tired to claim this crap with me. It didn't end well, he went from having access to my kids to completely cut off.
My mom would always threaten me to get control of my daughter when she was an infant. Instead of teaching me how to do things to care for my child, she would threaten to take her away. 😮😢

I am living through this nightmare right now, my ex passed away 3 years ago and my youngest is 21 now.
Yet they are still hounding me for support.
They keep saying its a mistake but every month I get another letter/bill demanding payment and the arrearage keeps adding up.

Under Texas statutes, grandparents have a right to sue for managing conservatorship in a two situations. The first situation is when there is proof that the child's present circumstances with his or her parents would significantly impair his or her emotional or physical health (e.g. abuse, neglect or other harm).
Since she is CLAIMING the word of a 6yr old she dies not have a flying chance in hell to get custody. She can get a PI, but the cost would be so exorbitantly high she'd be broke.
She might have had a case if she stuck with the fact the child lived with her for the past 2 years mom was going through cancer treatment and it would be in the best interest of the child to have some type of contact with her still; however, primary custody is NOT the way to go. Just because he "abandoned" her daughter doesn't mean he did so to his daughter.
THEY were split up BEFORE her diagnosis. HE PAID child support until SHE DIED. HE being the sole surviving parent got full custody of HIS child. I'd be getting a R O against grandma and moving FAR AWAY

I was in a somewhat similar situation. My parents were going to get divorced and my mother was going to release all parental rights to me. She never wanted me in the first place. However, my father was killed by a drunk driver before the divorce was final, so by state law at the time I was ordered to be returned to my mother. I was almost four at the time so my memories were developing. I went through two years of hell with her, physical and mental abuse trying to turn me into what she really wanted, a girl (I'm male). After two years, she finally decided I wasn't worth the effort and shipped me to her parents. They called my father's mother and said "either you take IT (yes, they said IT), or IT is going to foster care." My father's mother (my Grandma ❤❤❤❤❤) got me that day and she raised me from age six to adulthood.
How is that similar to this though? The father wants his child. The grandmother is being vindictive. I'm glad you found a loving parent. Some people just shouldn't be parents.

I have a support order out of Florida where they garnish my wages from DFAS, I'm retired military and reside in Texas! Will a check be sent to me afterwards or will I have to sue the Florida Child Support Division or sue my ex?

I was a responsible person at 23 that knocked up a junkie that did everything she could to try and keep me from getting custody of our newborn child.
I hired a lawyer and jumped thru every damn hoop required of me to get custody and I did!
Her non existent father and step mother tried their damndest to keep custody from being given to me and it backfired on them every single time!
The one single greatest time was when I had my own grandmother with me to pick up my son and they tried to make a scene about it not realizing that my grandmother was sitting in the car watching everything.
There’s no better feeling than knowing you are in the right and other people see it while the trixters get caught up in their own lies!

Grandparents falsly think they’re entitled to rights of visitation. This is not the case.
They don't have the legal right unless a judge order it, but they have a moral right and the children should have the presumptive right to see them. I don't understand how it this related to the video.
It depends on the state. Some states have grandparents laws where the grandparents DO have rights to see their grandkids in cases like this (a relationship between the child and grandparent is already established and the parent has passed away). However, visitation, custody, and child support are three different things.
@@jaimeduncan6167 Texas, where this case is, has grandparent rights. However, it's very difficult to get even visitation. This grandmother went about it the wrong way. Instead of demanding primary custody and child support, she could have asked for visitation because it would be in the child's best interest seeing as she lived with her grandmother for the 2 years mom was dealing with cancer treatments. All grandma kept saying was dad abandoned mom not that he abandoned the child.
All 50 states have Grandparents' rights. Each state has their own statute.

There is no such thing as grandparent's rights that trumps over the father when he is taking care of the children's needs. My ex wife's mother tried to deny me visitation when my ex was living with her. The judge told her that grandparents don't get to dictate the life of their grandchildren unless me or my ex was being neglectful or harming the children. There is no such thing as grandparent's rights.
Well there are. In Illinois there has to be reasons. I was told if the parents are neglectful or abusive I can demand visitation. If my daughter were to die, and my SIL refused me I could demand visitation

The judge told her that there is no such thing as grandparent's rights when it comes to custody when a stable father is alive. Visitation was up to me. I made sure my kids had a relationship with their grandparents.

Great question. Many people file cases and lack standing, i.e. they don’t have legal grounds to seek relief from court. In some cases, however, non-parents have standing.

This Judge is so wise, this Grandmother wanting money for a child that doesn't even live with her is absurd. She needs to be careful or crazy gran will end up losing her granddaughter and actually you can tell by her attitude that parental alienation is already taking place and this father should perhaps re-evaluate what access this woman gets to his daughter.
I would've asked for a restraining order against the ex-MIL. If she's trying something legally, she might try something illegally as well. With a restraining order it won't be his word agasint her (odds to her favor), but the opposite.

With all due respect, a grandparent has no authority over a legal biological parent. Many state laws even allow a biological mother whose a drug addict, to keep her child even if the father is more of a fit. The system is backwards. -- All I see is a grieving Mother who needs counseling for her unfortunate loss. Lymphoma is one of the most recoverable and treatable cancers to get so to lose a child from that, very sad.
