If anyone gets a debt collection letter from a debt collection company , bailiff they should write I capital letters at the top "IN DISPUTE" then photocopy the letter and return the letter to the debt collection company by recorded delivery .
Whilst "IN DISPUTE" debt collection companies cannot legally/lawfully act

1) His 'interpretation' such as it is, seems to be based on a made up case. BBB attempted to find the case on the lists available to professional lawyers in the UK. It was not there.
2) Vobe's, not being a lawyer, is simply mis-stating the law. How the law works is absolutely clear and has already been tested in the courts. BBB even provided references to people being sent to prison for failing to pay council tax. That would not be possible if the enforcement process was invalid.
3) Vobes has a long track record of mis-representing things to present sensationalised interpretations.
If you want any further information I would recommend watching BBB's de-construction of Vobe's nonsense. BBB is a real barrister. He would be in trouble with his professional body if he were to mis-describe the law publicly.

Basically said to them "If you're going to turn up at my house, you'll need a warrant signed by a Judge, otherwise you will have nothing to enforce, and you are harassing me". They claimed they didn't need to produce one, but soon got the message. They aren't issued by Magistrates anyway

but why should I pay the Council who want to reduce vehicle speed to 20mph and turn our areas

Also a chunk of the council tax is entitled ‘Policing’ but most police stations have been closed down a long time ago. Our local station closed and reopened as a food bank! A true sign of the times.

@@Dublin10 i had owned the house over 10 years and completely gutted and refurbishment it, I was unable to work due to serious fatigue/ mental problems and was under a doctor and a care program. I could not even manage the forms to fill in. Someone from dwp came to my house to complete all the forms as I had messed them up for the first year. They did not apply for my council tax and I was simply unaware until I got the bill. I wasn’t offered any way to pay it off and was made bankrupt without given the chance to speak to a judge ( I went to court expecting to explain it but I was ushered out of the court waiting room after signing something to say I was there) next thing I know I have a bill for £15k to overturn it. I had equity in my house and they claimed it to pay £800. I never recovered from it.
They took the rest of the equity, about £30k to pay themselves.

Council automatic entrapment fines of £70 and the costs they pile on while you challenge them are totally immoral and illegal!
If you even read the rubbish Council Tax Regulations, it clearly states they can not charge costs or extra fees and also their sub contracted EFA goons can not charge either. A then a real court Order has to state costs within such document are awarded and what they are, its not automatic, it has to be awarded by the HMCTS Court and written on such sealed HMCTS Court Order by the HMCTS Court, clearly stating it was written by the HMCTS not the Council or Serco, and such document to have a HMCTS valid and genuine case number printed upon it. Also even then the Order is not live until payment of all court fees have been paid by the applicant to HMCTS for the Court case, as many times its paid by a slate account and not real money. So many scams are happening, even HMCTS are scamed and doop in this.
Since there is no valid challange to council tax, you only have yourself to blame if you get additional costs.

There are no real HMTCS court Summons or Orders issued.
Have you read the Human Rights Act lately, the right to fair trial and the right to life, or even the Geneva Convention ?
Even the Council Tax Regulations states they can not charge extra costs or fees.
Costs and fees has to be awarded by a HMCTS Judge and also written in such HMCTS Court Order.

@@StudentDad-mc3puYes I have actually, and it's says Billing Authority. Let me know when you find a Billing Authority. Also read all the Courts Acts as they do state only a HMCTS Court can issue Orders and also such awarded Orders have to state permission allowed for costs or what the costs are.

these taxes are imposed on us and we all just accept it! I've never been in arrears with my council tax but I imagine the most vulnerable would be struggling, I'm glad this has come out and that all those effected get this harassment stopped. Pays to know about this.

I lost my house of 30 years, the last 10 of which had been paid off, so i fully "owned" it for 10 years. Lost it cause of back taxes due to working less cause of hip problems and unable to keep up. I always somehow knew things werent right with the system but could never prove it, nor could anyone around me. I came from a very Democratic state, so i was doomed from the start. All this illegal activity towards the people needs to end already!

Yep they added on £4000 somehow I had to get CAB to help and wrote it off to this day I still suffer with mental health due to them and I can't open letters. @@markennyee I need to watch it again, but that's not the point if I understood it correctly. It's not a question of whether the liability order has been made, but the fact that the enforcement officers must be able to actually produce it - written proof from the court, not the council.

The reason there is no legal liability order is because the council write their own. And the court judge or magistrates have nothing to do with council tax liability orders. Hence, there is no legal order that can be presented. BAM!

So glad you posted this Richard. I know it is truthful because about 7 weeks ago I resolved an over eager EA telling me they were coming to collect goods for unpaid balance on last years CT, which I had stopped paying around summer 2022. Looked up the applicable Legislation and, because they had not provided a postal or email address only a letter with PO Box and several text messages, I replied by text message to the EA citing the specific legislation, and at that time also the section stating a breach of the Act allows a debtor to seek damages from the EA in court. Didn’t hear anything from them after that. Then a few weeks ago , I had a new notice for 2023 year CT demand, also not paid 😊👏🏻.
Now I’m eagerly awaiting a follow up red letter, to repeat as before but will add this ruling and look forward to seeing the buggers in court for breaching the Act twice and on 2 separate case. 🤸🏼♀️

Once this happens the debt is paid off by the debt company for you - how helpful of them. They cannot charge you twice for the same thing that's the law...... IT CALLED COMMON LAW. Yes the common law movement is powerful but once we got a judgement it's fun watching the PTB's scramble to 'adjust' other methods to make ends meet ! Then the game begins again over & over the PTB's lose every time we (common law supporters) hold them to their own rules.
@@StudentDad-mc3pu I guess you didn’t fully comprehend the subject matter. First, there is no such thing as a Liability Order, second there is no obligation for any living being to pay tax. Period. This is clearly set out in Law, and confirmed in current Legislation. You need to read the Tax Act; read Blacks Law Dictionary to fully comprehend the Legal meaning of specific words we all assume to know but in fact mostly we do not. There has been trickery at play against our best interests as human beings, for hundreds of years, and yet more trickery at play in plain sight today.
It doesn’t matter to me whether you believe what I know to be true, but it would definitely serve you well to take a deeper dive into everything to learn the truth. Quite simply put, Legislation applies to corporate entities, not living beings. The illusion we are liable for anything in commerce stems from the deliberate misinterpretation of words, being taught from infant school to multiple generations that we are a “Citizen”, “Person”, “member of the Community” etc., (all identifiers which use capitals in official papers and all denote we are not living entities ) The Birth Certificates are not a record of our actual birth, simply a Registration of our strawman existence in Corporate. The BC is a security instrument which is placed in a trust, of which we should be the beneficiary... but instead have been artfully crafted in Legislation as the trustee and responsible for managing the trust - al the while the Govt became the actual beneficiary of the trust .ergo all our future labour and energies. That is how the tax is applied.
We are literally nothing more than a living being, yet whenever we refer to ourselves in their defined terms, eg: Full Name on Birth Certificate rather than just our given name ( birth name without the surname of our Father) we conjoin in their corporate world Legislation which makes our us liable for whatever punitive system is in play.
So, in Legislation Council Tax is a property tax by a Corporate body levied on Premises used for business by a Person in Commerce. Standing in our lawful right as a living wo/man, it does not and CANNOT apply.
As I said, it doesn’t make any difference to me whether you agree or disagree, it just is what it is - to do with as each of us would care to do.

Oh my goodness thank you Richard I’m actually dealing with this unforeseen situation myself! I have also been fighting a council tax bill for 7 years against an error I made re my business premises and I have persistently challenged this and each time I think it’s cleared up… suddenly out of the blue I get a bully boy bailiff hammer my door… just had another horrible incident when I has CBDL literally intimidate me beyond belief.. I have an ongoing dispute and he had a writ of control and I’m very vulnerable too presently yet he mocked everything I challenged and in the end I felt so under duress with the threat of removing all my furniture and I had Airbnb guests who were petrified as he threatened them that their goods would also be seized! Shocking and thanks to him I had complaints from Airbnb. The worst thing he ridiculed me over was the date I lost my amazing mum ‘suddenly’ YES I BLAME THE JABS saying it was long enough ago that I should be over my grief so I will be filing a complaint but it’s hard enough facing getting up

also, to trade while insolvent is a criminal offence.
It is impossible for a council to declare itself bankrupt, all it can do is issue a Section 114 Notice. A council cannot go technically bankrupt because it has a guarantor - central gov (i.e. 'the state'). They ARE still providing 'mandatory services', however after a council after issues a Section 114 Notice they cannot legally spend money on non-mandatory council services e.g. Christmas lights/trees in public spaces.

@@dantastic6262 you are perfectly within your rights to pay a private contractor to perform many 'council services' e.g. empty your bins for you. However you cannot deduct the cost of a service provided by some else from your council tax since you have to pay for services you use or not. Council tax is not pick'n'mix at Woolworths.

So there is plenty of cases were people got forced verses the opposite.
Also how will this work when digital IDs are forced on to us all.

That explains something….Bristow and Sutor always let me know to expect a visit by sending the usual vaguely worded threatening text that they may be seizing my goods, followed a day or two later by a phone call from an unknown caller (which I never answer lol!)….HOWEVER the last two times a car has pulled up outside but the occupant never gets out the car and just sits there for five or ten minutes shuffling papers etc, and after waiting a bit then drives off! I would suggest that they’re still putting a bill in for the visit, otherwise why go through the charade of parking outside my house briefly?

I think this was an appeal from Swansea District Court to the High Court. I imagine the Council will appeal to the Court of Appeal or leap frog to the Supreme Court (as I recall Leighton was seeking to do anyway as of public importance, but was presumably refused).
This will have retrospective effect in that it will mean all prior enforcements will have been made illegally and so should have been unenforceable and so defendants will be able to seek their goods or funds back, which have been obtained under false pretences. The councils / bailiffs cannot afford to allow this judgement to stand, which otherwise will be binding on lower (District) courts.
So there will be more to come I suspect (appeal).

If we all stood firm in not paying what we believe to be unjust fines, parking, congestion, Ulez and the like. We would overwhelm them completely.
I for one ignored a penalty charge for the Bradford Area Ulez back in June this year, they got bored after only 3 letters. Which surprised me how few letters they sent.
My personal theory is if they send 100 letters with fines, and lets say 80% pay (guessemated figure} They consider that to be a pretty good return. And ask themselves, what are the chances of getting any money out of the 20% of non payers, and simply write it off.

The point is you pay for a service that you have agreed to. It's an agreed contract. Imposing a demand on someone who does not want , nor require that service is not lawful.
That is the basic principle that we all should be in agreement with. It's the bailiff company that would be liable for the £4000 fine, they have a choice, if they don't pursue it ,then they won't be liable.

Am delighted to have this piece of information as I am currently right in the process. I requested for a copy of the liability order, i was tossed back and forth between coucil departments and yesterday i was told my case is on hold? For the next 3 weeks.

This is brilliant news. I would also add that this ruling should also technically apply as a relevant case/ruling to the utility warrants!
What is important to remember about the utility companies is that they’re misusing health and safety legislation for civil/financial enforcement….they are not allowed to cut any home off from gas and electricity (that only applies to commercial premises).
Remember….essential services are, well, essential to live….so if any foreign registered corporate entity (acting under an occupying government’s authority) cut you off, it’s classed as a war crime against people by an occupying force! Remember the outcry that the Israeli occupiers committed a war crime when they cut off Gaza’s power? Occupying corporate/government administrations cannot cut off essential services to the people.

I stopped paying council tax 3 years ago. I got the usual crap ending in a liability order. I sent it back to the court along with a note telling them they were committing fraud and that I'd bring the police and have them all arrested....guess what ? I heard nothing more from them

Also Richard the council have been unlawfully telling people that they have obtained their invisible liability orders from the magistrate court from a magistrate. However, a liability order can only be issued from the high court by a high court judge.
I just stopped paying poll tax in 2017 . I removed implied access to all dept collectors from my property and I haven’t received a bill from my council in three years .

Eventually the bailiffs turned up so I removed their implied rights of access .( send a recorded letter to head office of the bailiffs letting them know they have the implied rights removed . Then you can call the police to report someone harassing for money with the threat of violence if they do turn up again ) .The alleged dept was returned back to the council . I haven’t had any correspondence with the council and they have not sent me anything for the last three years .

The Council Tax Departments and the Magistrates Courts have become very sloppy in the process, because most orders were never challenged by the householders. Finally a defendant has gone back to the legislation and enforced it properly. Should stave off the bailiffs for a while until Government changes the regulations.

Ah ok, so new landmark ruling effectively prevents enforcement agents from seizing goods.......however if enforcement agents go seize goods (even though they're not supposed to) you can sue the enforcement agents, thats if you have enough money to do that and find legal representation willing to undertake the job.

I got a ccj against Lambeth council in 2022 and they simply ignored it.
Can the public or representatives of the public, sue the courts (or the individuals signing off on this anyway) for collusion with councils?

i think it will just mean a delay.
the councils and the courts will just have to get their paperwork in order, which will only be a matter of time.
they will be forced to have the paperwork actually signed by a judge, giving them more work to do.
it will slow the process down significantly, but not stop it.

@@redrooster5444 Well that's going to make things very interesting, since they won't want to be returning to signed documents if that puts them at risk legally.
They can’t provide a written court order against a debt that is illegal. It’s driven by fear. A big change will be needed, but this will involve a contract and honestly on the councils side. We pay, or don’t, way too much for too little. What do we get for council tax, not much. It costs £10 a week to get a bin emptied! I want to see a breakdown of costs and where every penny goes, like i would for any service i pay for. I’m under no contract to pay anything, still waiting for a reply from 1 of the thousands of employees at our local council.

I still haven't received the details/law that compels us to pay council tax. Any tax for that matter. Tax was brought in years ago, to pay for weapons, troops etc, in times of war. I'm still waiting.

I'm currently £60 in arrears on my council tax so was cheered when I saw this video but I am unsure as instead of officers document stated offices so I won't believe this just yet.
