Question: we had the Mediation, came to Settlement amount with Medicals kept open. No MSA. Next will be all the signing. Making it all official. How do i KNOW with 100% certainty that Medicals are Open, this WC insurance Co will remain Primary payer for injury, what will we see. Be signing to give us that assurance? Should we be getting a new Insurance card from them. Can we ask for one ?

If you settled with a stipulation settlement the defense doesnt have to settle with Medicare set aside . They can give you lifetime medicals and avoid giving you the set a side . I know it happened to me . I got a stip and life time medicals . Remember the defense offers you what they want to settle with or for . Lastly there may not Be enough money there on settlement to mandate a set aside . Communication is key between you and your attorney
Naomi thought the MSA would elevate the settlement amount overall . But it really doesn’t . Your injuries are specific calculated . I get it . But I also thought if one couldn’t compete in the job market that would force a compromise and release . But that is not the case either . The defense will offer what they want to offer period .
BearPapa49 is correct. Stipulation settlement does not require an MSA because work comp continues to have the responsibility of primary payer for your work injury.

If you don't expect to be on medicare within 30 months, why would the insurance state that in the C&R form?
So they can check the box showing you do not need to submit an MSA.
