    The first judge ruled against you because You didn't go to court. I have found this to be the case with many judges. You not showing up to the proceedings makes the judge feel like you don't care about the outcome and creates a bias. Always go to court.

      @@NorthridgeFix I understand that, I am a business owner as well. But since the complaint is against you and the business (you are the person at the business who was blamed). When the complaint is made it is against the business via the actor, employee, representative, or agent that represented the business in the situation. The entire court proceeding is to determine fault in the way the agent of the business acted, reacted, or compelled harm in some way to the customer, client, or plaintiff party. The law states that the agent of the business cannot be named as a part of the lawsuit unless proof has been given to show that the agent of the business acted outside of the professional scope of the business.
      Judges and the whole Judicial system want the first hand account from the actors involved (the customer and the person or agent at the business). Someone just representing the business can lie without perjury since they don't have the first hand knowledge of the situation. Someone who has first hand knowledge cannot escape perjury if they lie. Always send the person with first hand knowledge to testify in court as it is deemed good faith in the Judicial system. Not sending the person with first hand knowledge will be deemed as a tactic to be able to hide information and knowledge of the interaction.

      When you sue a business any employee can be selected to represent the business in court. The owner does not have to go.
      Could you imagine if every time a major business, lets say amazon was sued the owner had to go or the suit was lost? No way that would happen.

      some ppl are scum*bags and have no shame doing this even if it's mean making others ppl suffer, i remember a co-worker at household electronic delivery service being accused of delivering an LG TV clone(made in china) to a client, what the client actually did was : bough a cheap LG TV clone,that TV probably stopped working after a week or a month, the seller refused to change it/return his money, the client decided to buy an original TV from our store(same model,same screen size), after few days he come back to coplain that the TV stopped working and after he checked the TV he find out it's a clone, the store had to replace the TV clone and the client end up with 2 original TV while the co-worker got it's full price cut from his salary for the next 6 months

    I feel your pain my friend. Had a customer do the same with my company on an iPad Pro. Brought it in for a screen replacement (cracked all the hell, but still powered on) and requested a quote. Called her up about an hour later with the quote, she wasn't happy and decided to pick it up within 30 minutes. 8 days later I get a summons to small claims court, blamed for breaking the screen during a repair. Needless to say, it did not go well for her as I brought the overhead counter camera footage that clearly shows it was broken along with the entire sound of the conversation. She was ordered to pay me $275 because I had to close my shop for 3 hours during the court session, I left with a smile.

      I guess you have to have cameras everywhere nowadays, in the car, in the house, outside the house etc. I have decided to carry pocket camera everywhere I go now.

      @@gagaklumayung7995 so true. I have 11 cameras inside and out of my shop. 8 in and around the outside of my house and all 5 vehicles we own have front and rear dashcams which have saved me in a couple wrecks already and paid for themselves. Just can't let things go by nowadays.

How many times did she pull this stunt with someone who didnt have a camera. Id think a couple thousand dollars is more reasonable. She'll make 275$ next time she pulls it off easily.

      Happens all the time in business. Especially dealing with charge backs. I went through it 2-3 times a week with customer trying to steal my product and say it never arrived when it clearly was signed for lol

    Dude, I was seriously getting SO angry at the start of this video, but in the end, justice was served. THANK YOU for sticking with this case and not bowing to an unjust ruling. Our entire society is injured by bad judges. They undermine the foundations of our system. But they are humans, after all, and prone to error. That’s why we have appellate courts.       The sad part is that this person, the customer, likely planned this from the beginning. He's probably done it before. Typically, scammers don't think of themselves as a degenerate scammer. They do mental gymnastics in their head and feel "justified" scamming others. It's the same phenomena whereby a-holes don't see themselves as a-holes. They usually have a justification for their behavior in their warped, defective minds. Usually childhood trauma of some sort.

The customer lied to the court to help win & get money for a new laptop. If you watch Alex's videos - you would know he would never say that.

      It's a silly argument. Why send a Mac to a repair shop if it wasn't broken?
      A laptop that won't start is worth nothing. It's a doorstop not a computer.
      If the customer sent a Mac that's worth nothing, to a repair shop, wasn't repaired it's still worth nothing. Even if it were further damaged, one cannot further decrease the value of something that is already worth nothing.
      Thats precisely what the 2nd Judge said when he dismissed the case.

      you have no idea how prevalent this is. I work for an ebay store that sells mostly used items. They have to be tested before shipping to not only make sure the customers get working products, but to avoid the expense of dealing with returns and hurthing the store's reputation. Here's a shitty life pro tip: they will sometimes show me pictures of their broken product they bought the replacement for, and say that I shipped a broken item. We cannot contest this in any way because it's a huge waste of time taking all those pictures just for the few bad eggs that use this tactic. So we are forced to pay them back on top of the free shipping we offer on all orders. Thank the gods it's not my own store, but it still makes my blood boil.

      This happens in other areas too, e.g. services. I had customer stating "thing A" was working the whole year before we touched the system and opened a very big, international escalation that we are to blame. Mail explaining the issue to him prior to the escalation didn't help at all.
      It wasn't very hard to find an evidence on the system that he was lying and that the system was set the way it could have never worked before. But we had to waste valuable time of many people around the world just so he can feel important. You bet he didn't say I'm sorry afterward.
      I really don't get nature of those kind of people, ignorant, egoistic, think that world turns around them. And lacking the ability to accept the fact they are wrong.
      It does test one's soft skills too. :)

    Some judges are notorious for wanting to "split the baby" - i.e create a compromise judgement where no one is fully satisfied. Unfortunately, when one party is completely innocent this approach is blatantly unfair. Glad you found a no nonsense judge on appeal.

      We record every troubleshoot from a top view camera and save it on a NAS, usually complaints arrive in no less than 3 months. Also this helps to quickly review any worker fails and other incidents.
      Arrival unboxing is on video with a status arrival picture of the asset and after fix state to make sure user cannot blame us for damaging a screen when we just changed a mosfet.
      If you keep every step documented (even exact parts used in a replace) and it was out of your control there is no way that an angry customer will win a court case as all info is stored on the ticket by the technician.

      That's what I don't like in this kind of situation. Why didn't he counter sue, it will serve as a deterrent to others and also teach the customer a lesson. By letting him go free, he's indirectly helping him

    Although, I would be curious if certain states have consumer protection laws that put the responsibility on the merchant to ensure the customer gets their product (whether it be a retail purchase or return from repair or something).

      that couldn't possibly apply when the customer is the actual shipper of record.. where he ships to and from is his responsibility. In this case the customer shipped to himself.

      Especially that the customer provided their own 3rd party shipping label, they would be fully responsible for adding insurance and filing the claim as the purchaser of the shipping service. The best argument the customer could have would be if the merchant was negligent and poorly packed the item; however, one could counterargue that it was sent in generic packaging instead of OEM box as per TOS.

      @@amak1131 The appeals judge didn't have time; however, it would be great to ask the customer did they purchase insurance w/ their 3rd party label? If answer = I don't know or yes, then proceed to follow-up question "Did you contact your shipping carrier about this?"

      ​@@ryanglaser5336 It certainly sounds logical and is a point that could help clarify matters but in terms of what matters to the court, is whether or not NorthridgeFix was to be held responsible for the replacement of the device and whether or not the shipping compannies involved should be made responsible is a matter for a different case that the costumer should of started a different complain about. Also there's the logic that if they had insurance, and the shipping company was required to replace the items, they either should of done so, or there was a dispute already and the client either didn't want to pursue it further or was denied already but without knowing the time frames it's impossible to say for sure what happened.
      As for the appeals judge not having the time to dedicate to the case, I find it unlikely, like if they left the room I would think that's because they had no more cases to attend for that time period, went to take a break, or a different judge was going to take over for another set of cases

    I've passed for something similar. First time, judge opted in favor of the customer. We applied again, and this time, same thing. Judge listened, and suddenly stop everything and decided in favor of us.

    Congratulations brother!! I spent 3 years making 7 different appeals on a case that was finally ruled in my favor on the 28th of December. I'm going to be paid 3 1/2 years of back pay and court fees because of all of the appeals and how long it took. For so long I've felt that there was no justice in our court system. Finally I got a judge who listened to me and not even 20 minutes into the hearing he interrupted everyone and ruled in my favor and made it very clear that I was dealt a severe injustice by not winning my case the very second it was read in court. Some judges are literally just that, judges and they judge you by the way you look, talk, act, color of your skin etc without even reading your file or just looking at how much money the defendant has put in his pocket. Especially if you are fighting Big tech. Then when it goes to appeals, the next judge just judges you by what the first judge ruled on. So I'm very happy that you got it ruled in your favor on your appeal. Way to stand up for yourself.

      and that's why there are 3 tiers of courts. So you can can bring your case to them if you feel like the judge didn't do his duty.

    Kind of crazy. Half of the time when a Motherboard goes south, it's much cheaper just to replace it than trying to fix it. Glad that the Court finally saw your side and won. Keep up the good work.

      Typically when I fix a motherboard on an apple device, it’s a tiny cost pennies/cents for the part and a couple of hours diagnosis and actual fitting.
      Typically, Apple motherboards are in the region of 200-600 dollars/pounds, so in the case of an Apple computer, it’s actually much cheaper to fix than replace if you know how to diagnose.

      That kinda feels like Apple mentality. Parts should for the most part be very affortable, but even with the more expensive workhours in diagnosing and repairs, this still shouldn't have to be more expensive than a board replacement, with some exceptions.

      That's only because the manufacturer like Apple prevent repair stores from being able to buy all the needed components to repair a board. They also restrict access to schematics to make it harder for independent repair. If not for these anti-consumer practices a motherboard fix would be a couple hundred dollars at most and we would have a lot less e-waste going to landfill.

      yes but it could happen that the device was damaged by the repair shop and then they try to pass it as "shipping damage"; I've known individual sellers from eBay that when solded a valuable item they upload a one-take video (no editing) showing the device in perfect working order, they turn it off, put inside the packing material, box and labeling to prove they've sent it in perfect condition to the buyer.

      @@alerey4363 well ebay and alex arent the same, on ebay scamming is like a naturak task, with people who have no experience in this type of repair, trying to fix something but end up making it worse. Thats why its best to just find 1 or 2 people who are trustable and have the experience in repair. Even tho its costly, no point on going the (i know someone who can do it cheaper route)

    I used to be an operations manager for a large towing company. I would have to go to court often because we'd get sued all the time with people claiming that items were missing from their cars. 1000s of dollars worth of clothing, devices, car audio equipment, you name it. We lost every single case regardless of the evidence. I remember a specific case where a guys car was stolen and completely stripped. He sued us for $5000 because all his car audio gear was missing and his insurance company would not cover it. Even with the impounding officer's statement that the car was completely stripped, we lost that case even after all the appeals were exhausted.. It was ridiculous. I'm glad you prevailed.

    I'm so happy that this story has a good ending and proud of you that you pressed on to have justice.
    From my experience in electronics retail and end user repair, I've seen too many customers with malicious intent.
    It's the sole reason I'm not setting up my own electronics sales and repair service. There are a lot of legitimate customers out there, I'd say they're the absolute majority.
    But I've seen just how much damage in resources and time can the malicious few cause, and it really throws me off.

    I’ve had a shipping situation where the customer turned away their shipment because they didn’t recognize our company name on the shipping label then wanted compensation for the “lost” package they ultimately received but was simply late. Weeks later, mommy wanted to know why we didn't complete additional repairs declined originally when her daughter said to not perform them due to expense. Sometimes customers use the business they do business with to take out their frustrations on you. In general, a bad review is a product of one’s self; even a 5 star review is an example of how happy we are about our own decision making skills. There are internal problems the customer has and is denying they are theirs to fix. The 1 star review this issue earned us was written by the mom of our 19 year-old college student trying to live vicariously through her daughter who either didn't think this a big deal to begin with or her helicopter mom was doing all the talking on her behalf.

      Because the defendant was a woman and the customer primary evidence was a claim of an agreement over a phone call with someone who wasn’t in court.
      What I find mind boggling is how the first judge could just dismiss outright perjury. 500$ for a box? I want to see the bill for that. In fact it should have been submitted as evidence so that the defendant could verify that the bill is real. The facts were mostly ignored by the first judge.
      The truly disgusting part is: how many times was this specific computer claimed in court? “I used a new power supply.” Is most likely the cause if the dead computer. I can see this guy just sending his computer to multiple repair shops then suing for no-fix repeatedly.

    I "love" it when people contradict themselves. Even if everything was true the customer told the second judge that you are not a certified Apple repair service provider and that you don't have the tools for that. But isn't he the one who knowingly shipped his machine to your shop? It's like knowing the stove is running and hot, putting your hand on it leading to a severe burn and complaining that the oven was hot at the time you touched it.
    There are shitty customers as well as there are shitty service providers. Pity you got to experience this. The customer was clearly looking for a way to scam his way to get a replacement for his broken machine.

    This scenario is why I took pictures when shipping out equipment. Before packing material, all sides and internal(if possible), after packing material to show I used enough to protect the device, then one in the box before sealing, and more after sealing to box to show the outer carton was intact. And one final picture showing it was on the courier's truck intact. These were saved with a PDF of the shipping label and filed with the work ticket. I never lost a damage claim for anything I sent back.

      @@mrsemifixit I shipped retired servers back to the customer for a managed hosting company. The servers had the serial number printed on both the front and back, and the internal shots it was easy to capture one or the other in the shot. It was easy to zoom in to the numbers since the camera had such great resolution. Easily worth its cost in the claims we were able to successfully refute.

      ​@@mrsemifixit The issue isn't that it is proven to the average person, you just have to be enough to reasonably trick someone. What Saberus suggested doesn't ensure anything as a liar could still take those before damaging it.
      In fact that is a smart thing to do.
      Pictures and video can't prove anything, but they can trick a Jury/judge.
      That is all you need.

    I been in shipping for 20 years. When it comes to fedex or ups if no ins was put on the item it's given $100 base by ups or fedex. When he made the shipping tag for you it was all on him to put the amount needed for ins. I can't understand how you have to pay when everything was done on his end. Good job standing up for yourself.

    Northridge fix. You are an excellent service engineer and I have observed your technical ability and techniques. You are precise and as accurate as can be or expected from an individual as yourself. The criminal justice dept is corrupt many a time. But here in the UK the same applies. Go to court to defend yourself, or else it will not go in your favour.
    Yes, I know it's unfair, but this is the courts thinking; that you couldn't be bothered to defend ; so they couldn't be bothered to judge and makes their job easier to sign off. Lessons learned. Thank you and I'm glad you won second time round. In future record it on WhatsApp and send the video to his phone to prove no damage was incurred by you prior to his delivery

    One thing that grinds my gears about customers like this, is that they'll try anything for a free penny. Beginning of the story where the judge ruled the customer in favour of the court did indeed make me mad. I'm so glad you appealed against it. If the customer stated that you wasn't an Apple Certified Repairer with all the tools and schematics, why did he come to you in the first place? Makes no sense to me. But overall, a happy ending and justice was served. It's people like this that take away valuable time and resources to try their way of outing you as a bad repair. I hope you never have to deal with him or any other customer like that again. Thank you for sharing your story. 🙏🏻

    One piece of advice, take videos and pictures of the item while you are packing it. Leave specific marks on the tape and the box and record them or put a tamper-proof sticker on the box while taking the video and or pictures. You can delete the videos and pictures after the customer has acknowledged no issue with the item. These could save you so much pain if you have to go to court in a matter as such. That way you will have foolproof that the item was mailed without any issues. One thing I did not hear from you is that you had proof that you mailed the item without the issues (Broken) reported by the customer.

      I do this with pretty much everything that I buy of high value regardless whether from eBay, Best Buy, Amazon, wherever. I unpack it on video and validate it is what I purchased. Same thing when I return or sell something. I take a video of of packing it up. Once I get refunded and/or confirmation of receipt in good condition, I usually delete the video a few weeks afterwards. It's unfortunate that we can't rely on honor system, so many people trying to scam someone else these days.

      if they have a specific 'pack' station, they could just set up a camera at ~45° pointing down at the desk that just records on movement, if its a decent res it should pick up the shipping label and that would be all you need to do, if its set up right it could even just 'loop' record (replace oldest file once disk full), then you don't even have to think about it unless there is a problem like this.

      Great idea. We take pictures of product right before it goes into the shipping boxes too. Works great both ways since sometimes we DO mess the order up. We can look at the pictures and quickly confirm.

      @@htwingnut Same here. I actually bought a 'head mounted camera' specifically for the purpose of recording the opening of packages of things I receive.
      I repair specific types of turntables, but due to too much hassle with shipping and items getting damaged, I now only accept local delivery and pickup for repairs. Nice bonus is you can demonstrate things working, and review the issue together with the customer before repair.

    Thank you for standing your ground and not giving in to this customer. Unfortunatley a lot of people would have given up after the first ruling and eventually paying the customer. The worst part about doing that wouldn't be the $1,200 loss. The worst part is in doing so it tells them that they can get away with lying to the system and be rewarded for it. My guess is that they person will think twice about filing a bogus claim in the future.

    Its a good practice to make a photo of packages when they arive, and when they are shipped back for such nuances. Saves allot of headaches.

      The plaintiff wasn’t accusing the shipper of harming the physical value of a broken machine, he was suing for the full value when new and evidently was only awarded its highest approximate scrap value. Still not fair considering the waiver he signed but BOTH the repairman shipper omitted making mention of whether or not the shipping label had insurance included, meaning that he probably didn’t take note of it and was defending a position which perhaps he didn’t really need to. I would only take photos in cases where items leaving the store were uninsured. No sane logistics company is going to accept an obvious piece of crap package for delivery when it was insured...

    The person probably knew exactly what happened, and was trying to get you to buy him a new computer. It probably arrived fine, but then he took it out back and dropped it. Everyone knows that shipments like that require insurance. Further, just like you said, once it leaves you couldn’t possibly be held responsible. The worrying part, is how wrong the first court got it. Sounds like they were trying to make everyone happy, and thought you could ‘afford’ the $1200 to keep the guy happy.

      I'd say that they are 4 past "customers" that Mr. Alex tried to service and they were unsuccessful in screwing him over.
      Any additional dislikes will be even more of them and possibly their friends/cronies.

      The first judge is yet another big tech shill who is obviously against the right to repair movement. They are unfortunately a dime a dozen right now and they bow to tech Giants wishes by ruling in the favor of these well orchestrated scams that have been targeting tech repair UA-camrs over the last year or so.

    That's a great story! I think it really gains a lot of traction in court when the shop owner is present at the hearing. Judges often think there may be something to hide when an employee is sent instead of the business owner. The second judge was much better at asking questions and looking through the fog presented by the customer. I'm glad it worked out in the end. Today, many people file cases because they feel there is nothing to lose and everything to gain. They are simply out the filing fee. This is the world we live in. Humans often bring in variables that we can't forecast. I'm happy for the outcome.

      No, the thing is that in a trial evidence will be presented and questions asked. If that is done poorly then you may well lose even if you otherwise have a valid case. Judges are not mind readers and have an obligation to decide only on the basis of what is actually presented. My guess is that the sister could not do that effectively. Judges are supposed to be impartial, they are not there to represent you.

    You should record yourself opening and testing the package so you have a baseline reference of how it arrived in your shop. Might save you from trouble later on. Keep up the good work

    Oh, I can see where that case was going. It was supposed to be a "The judiciary system agrees that uncertified repair shops cause damages to people devices" As part of the ongoing attempts to discredit anyone that's aligned with Right To Repair movement.
    The lack of reasoning for the original verdict is very telling how there was bias involved with that judge's decision.

      Maybe the person he sent in his stead the first time just did a terrible job explaining the story from their side. You're assuming way too much here; if there was that much bias the outcome wouldn't have been any different when the guy showed up himself and supposedly told the same exact story the first person was supposed to.

      It has been extensibly documented that bias does indeed infuence in desicions over logic.

      @@bradlasalle2888 the thing is that we don't know whether or not the guy's sister did a terrible job explaining her sister. Considering that he sent his sister in his stead and she knows the case, his computer repair shop is likely a family-run shop where his sister knew how to explain the situation.
      The point is that there is so many things we don't know and just making assumptions.

    Big lesson. Before starting a business, seek legal advice to protect you. If already started and you don't have legal protection, pause, get is it as soon as 10yrs ago. Alex survived losing $1200 because of the legal terms the customer agreed to before trouble started. Salute Alex.

    Glad to hear that the case went your way. I've had a similar situation where I was being extorted of monies that was all based off lies. Lucky for me there was no substance to any of the points and the judge ruled in my favor. Although it was a relief it was a headache I didn't need and I know how you feel. Keep up the good work

    What a story Alex! I really felt you were screwed in the first part where you had to pay $1200, but thank god you went in the court and justice was served. Seems like the customer was just all about the money, and I thought to myself throughout the video as to why he wants $3800 when it came in dead, especially including the fact that he opened up his iMac multiple times to replace the power supply (so he could've killed it himself and most likely did), and that it left your store not fixed anyways, so it didn't make sense at all.
    All and all, I'm glad you are back and you don't have to waste your hard earned money on useless customers. Keep it up Alex!

    I think that there should be a score system for judges. Something as simple as the percentage of cases reverted by the court of appeal. If that percentage goes too high, that judge goes on review, and could lose his title.

      Don't forget some appointments are for life and retirement is optional in some cases so you can have some pretty old people deciding on issues they have a fairly limited understanding of.

    It is always good to come by a judge who actually listens to what people have to say, looks at the evidences and takes a moment to think about what happened. In most cases it looks like they are too tired to care about anything so they just quickly write down some standard decisions for your general kind of cases and call it a day.

    Damn Alex, I’m not even halfway through the video, but could just hear the stress in your voice! I’m so sorry! I too was in business for a VERY long time and could simply tell how professional you are from the very first time I saw this channel! BTW, I’m retired now! Sadly, there will ALWAYS be people like this that will either outright scam or otherwise try to somehow get over on you!
    Small business owners get screwed a million and one different ways, but everyone assumes that you’re rich just because you own a business! They just don’t realize all of the factors that we have to deal with! They don’t see how busy we are and that our earnings are directly correlated to busting our ass many times 80+ hours each week! They don’t see that we may make a good living, but it takes years to get established, and once we are we don’t have a multinational corporation helping us save for retirement! They don’t know how detailed our records and books have to be! They don’t get that we end up mastering contract law because of situations just like this one! People like this only make it exponentially harder to run a small business, stay reputable, and are ultimately a ginormous reason why we lose money and small business insurance is so expensive! That said, your business insurance should pay such claims, but it may not even be worth it. I’m just glad that you will not have to pay in the end!
    I guess this is why the American justice system may not be perfect, but it does have certain “checks and balances” or multiple layers of courts with each one being “higher” than the next. It’s NOT perfect, not by a long shot, but it usually does work and is certainly better than most of the world’s other courts!!!
    Wow. Just, wow! Still shaking my head! I feel you! 😞
