@@ilovesnow2399 for FFL’s things have changed. They can sale braced pistols again. A friend of mine pawned a braced AR-9 before the pistol brace rule went into effect. He went to pick it up and they kept his brace. He went to the pawn shop today and got the brace back. The pistol brace BS didn’t bother me but it did have an impact on FFL’s & other gun related industries that have to follow the law very closely.

What’s so amazing is the ATF had to know they had not complied with the administrative rules when they issued the ban. Thus, the only explanation is an order from the White House to proceed immediately with pistol brace ban.

A few things worth knowing: When the government appeals this injunction, it will go to the 5th circuit court of appeals, which has of late been very gun-friendly (It issued the rulings against the ATF rule on bump stocks), so there's no guarantee that the 5th circuit will stay this injunction. If the 5th circuit does not stay the injunction, the government has the option to file an emergency appeal with SCOTUS, but whether an emergency appeal is heard by SCOTUS is determined by the circuit justice, not the full court. The circuit justice for the 5th circuit is *drum roll* Samuel Alito, who is tied with Clarence Thomas as the most gun-friendly Supreme Court justice ever. So if the government wants to fight this ruling, it's going to take LONG time before they make any headway.
Very important to also note that due to how the US court system works--this ruling IS NOT nationwide UNLESS SCOTUS rules on it. From the University of Georgia Law School website: "higher courts bind lower courts within their particular state or circuit. With the exception of the U.S. Supreme Court, courts of appeals and state courts do not bind courts outside the state or circuit in which they are located. I am so happy you don’t even know man. I don’t make a lot of money. I invested in a Ruger PC Charger for my home defense of me and my family. Within months of putting it all together, we got hit with that ban. The most disappointing and infuriating thing to happen to our freedoms in a long time. Now I can feel safe to use it for home defense if needed. I own other firearms but this one was nice because the ability to utilize Glock magazines and to maneuver around my house quickly. Plus it folds up into nothing and can be taken on road trips or camping. Just extremely happy about this
It wasn't cheap for anyone. By the time you factor in a barrel, hand guards, brace, optics etc etc the MINIMUM you were losing was around $500 +/-. That's not chump change and the ex-post-facto law of nature was HIGHLY illegal and unconstitutional.

Then wouldn't the common use test apply to states restricting 30 round magazines? ie (NYS and California)
If 200,000 is the metric for common use, SBRs are common, suppressors are common, hell fully automatic are common.
This should have been struck down on common use alone, millions and millions are in use, hence common use

I've been watching the RKBA debate since the 90's and I must say it's nice to see the good guys getting some wins of late. It's remarkable that once the NRA was out of the picture, we actually got groups that fought for our rights instead. Also noteworthy that the theatrics about "the evil gun lobby" went away along with the controlled opposition.
NRA relies on 2nd amendment infringement to to stay in business, they have a giant headquarters with staff and a big grassy lawn to water and mow. Gotta keep those unconstitutional laws coming.

Very worried about the Illinois assault weapons ban, those of us have until EOY to "register" our rifles and other items that are listed as banned, next step will be seizure I'm sure, currently there is less than 1% compliance which will likely make the majority of us instantly felons
