    You are absolutely correct ! Towpiglet had a good video on this ( I think about 4 years ago) & he explained it almost ver-bateum as you just did in this video. Just never log "sleeper birth" & if officer ask you, ( which I have been asked a couple of times) do you have a sleeper birth ? The answer is : No sir I do not. The first DOT officer that ask me that said, " good answer" & smiled.

    As long you log off duty, you are fine. The issue is people use sleeper berth to take advantage of the split. So they claim sleeper berth even though they don’t have a min req sleeper berth.

      I was originally told it was not okay and threatened with violations by a port I frequently visit for logging off duty and sleeping in the truck.
      That's how this whole problem began. Now I have the proof to say otherwise. Was a whole lot of headache but hey I learned a lot of both good and bad haha

    I've read through the "Green Book" and agree. As long as you're not running team and not using sleeper berth split, you should be good.

    I "think " when they say must have a sleeper or when you must have a sleeper that meets thier requirements is running teams.

    You can't challenge a volition's in a court it's like a warning but goes against your score. Unlike a ticket, then you have to go to the court to challenge it.
    You would have to write a letter to DOT to have the Volition to be removed. Laws also can change States, too. States like California's rules and regulations.

    The way I see it is. If I log off duty I’m off duty. It’s not their business what I’m doing off duty. If I’m off duty I’m off duty. If I’m around the truck or in the truck it doesn’t mean I’m on duty.

    Thanks for the clarification. I'm gonna get my CDL and drive local for my current company a couple years. Then I'll get my hot shot set up complete and get on the road. I'm gonna study all the red tape like these rules and buy small extra stuff hot my set up before massive expenses of the truck and trailer.

      The red tape is killer man it's always a game to try to navigate not only the federal but also state ones. Sounds like a good plan man good luck. I plan on returning to Hotshot in a couple years. Not the time to be In it right now.

      @JustinMettleMcMahan yeah market has been steadily on a constant decline for over a year. I couldn't even keep my trailer filled and so many loads were like 50 cents or less mile.
      CDL guys are really the only ones surviving. I only know one CDL guy still running. Everyone else hung it up

    What if you are told to move the vehicle or get towed. Yes you will lose.. you are responsible for the freight and the truck. Stop! If you wanna be a trucker go drive a truck...OMG!!!! Stop!!!

      What exactly is the problem? Go into PC and move the vehicle to a safe place. I've done it multiple times after going off duty. Being responsible for the freight and truck is exactly why we have insurance. There is nothing I can do to stop a property crime legally besides waiting for the cops to arrive.

      @Gordon Davis What law is being broken by having to move the truck under PC to a new safe location? Please enlighten us all how this is not okay. It happens every single day to thousands of truck drivers due to the lack of legal truck parking. I've had an inspection the day after doing this. They questioned it, and I explained what happened. No issue... shit happens.

IF your sleeper does not meet the criteria of a sleeper by the federal statute you will not beat this.. dream on

      @Gordon Davis doesn't meet the statue so you claim off duty not sleeper berth very simple. You can do what ever you please off duty. Only have to be off duty for 10 hrs. Sleeping is not even required on 10 hrs off duty.
