Same case with my nephew. Parents incited daughter to file 3 false cases against him. Nephew now battling depression. Went to her parental house for delivery and did not come back.Nephew has not seen his twins since past 3 years.

No she is not as per law if husband and wife earning equally then also man has to maintain wife by paying her 1/3 rd of salary and 50% of his assesy

1. If the wife has sufficient personal income (net); and
2. if husband's personal income (net) is not significantly higher than that of wife.
Then no maintenance is allowable to wife.
Same for claimant/husband u/s. 24 or parents under Senior Citizens Act.

Firstly, it is decided whether the claimant is eligible for maintenance or not. Only after the court finds her/him eligible, the question of quantum of maintenance arises (1/3rd share of wife is adjudged when wife has no income and non-claimant/husband has no other dependent. There is no rule of "50% assets" in India).

Nowadays only money matters .. both are earning huge amount of money but are acting like a beggar in front of judge.
Pre nuptial agreements should be allowed in Indian Law.
If people want to marry, the PNA should be registered at the same time as the marriage with the Registrar of Marriages.
The problem is that men use their heart to get married while women use their head.
The men should undergo a 15 day program before marriage where 500 such litigations should be shown and explained to them.
That should dampen their ardour considerably.
The Law is heavily loaded in favour of the women and it is impossible for any man to find a fair judgement.

The petitioner is idiot . He can easily file custody in US and get custody . Then ask wife to return the child to US. If not red corner notice will be out in the name of wife. Then mention Indian court that paying alimony will be like supporting criminal activity

If u can't raise a child with 35lac annual income, then give her custody to her father, instead of using your child as a money making product. I think it should be considered as a child abuse.
If the husband is not a good person, then file cases against his crime and get him punished but don't use your child to get money when you are earning very well.

If the wife is earning and well educated then why dowry demands still exist in our country and if a guy can demand dowry then a guy must pay maintenance right what is the problem in it. Whether they don't know that lady is very well educated and therefore he must not ask dowry.

Mother is keeping the child with her. That itself is a huge task. The child's upbringing itself is valuable, and the father should consider that. In today's day and age, keeping check on child's study, sports, overall development is a huge task. Father should be grateful for that.
Then give the custody to the father...or share the custody 1 year with mother and 1 year with father
