    The young lady PCSO, could teach her, colleagues how to communicate with members of the public how ever annoying they are. She was not vexed. She was polite and forthcoming with the information now I can respect her because when she goes to work she leaves her ego in the locker room.

    The Met don't seem to be able to do anything right now if you follow the news.
    I will never understand why they get involved with men with camera's, and yet the 6 times I have had to call them for supprort I got either no support or a PCSO 4 days after my son was shot with a paint gun in a drive by! who took a report then closed the case whilst still sat in my house, what an insult!!!!!!!!!!!!!!!

    Just because the gate is open it is still police property so unless you can prove that small stretch of land is a public right of way you was trespassing on police property and as such the officer has the right to remove you when you are requested to move. When neither of you did he has the right to forcibly remove you. If that open gate area is a public right of way only the local council can remove permission for you to be there but if it's police property then you are going to be out of luck. Calling him an idiot whilst he is carrying out his duty as a police officer can get you arrested for a public order offense. I have no doubt his superiors would have expected him to show restraint BUT the officer would have a legitimate claim in that he asked members of the public to move off police property and they refused to do so and whilst carrying out the duties of a police officer (as expected by his superiors) you called him stupid. One thing you fail to be aware of, calling someone stupid is an insult and the officer acted on you insulting him. As for the shouting, you can shout out what ever act/rules you want about public access but unless you know the rights of way of that open gated access at that precise time, what you said means nothing.
    You are the ones that are the problem, your 'Police Baiters', butt hurt chip on the shoulder social media wannabe's who go around baiting police to get them to respond negatively to you so you can then go on social media claiming you've 'scored' getting a bad cop on video.
    You prove your the one's causing the problem by antagonising the security guard, making rude and crude remarks about his professionalism (claiming he is masturbating). You think it's all just a joke but actually what you are doing can be construed as bullying/harassment because you are trying to enact a response from the security guard and the police by being obnoxious, rude and offensive
    You out into question the professionalism of the security by being rude, crude and insulating, then when a police officer arrives to carry out the required duties of a police officer, you insult that officer by calling him stupid.
    If the police officer loses this case against you then it shows how bad our justice system is when a few toe-rags can go around goading and baiting police officers and get away with it.

    If you’re in court about this, you need to ask the judge can you use self-defence in this instance, because the law states that you can but you just need to have video evidence if you don’t have the evidence the judge will side with the police

      The offence is in the reason he used the legislation. Section 26 refers to using constable powers for the benefit of ones self and/or other persons. In this case he's using the legislation to nurse his bruised ego

    The location is Catford Police Base at Aitken Road SE6. PC Woolston needs to be instantly dismissed without pay and while waiting for it to go to court and should be should be taken off public facing duty without pay. The police MUST hold a must higher threshold and can not feel insulted and can't use the Public Order Act as an arrest. You MUST not settle this out of court and get a personal claim against him for a minimum of £250,000 plus costs otherwise will take it to a higher court.

    The Met Solicitors will settle the claim b4 trial, they always threaten to defend, but 99.9% of the time they pay up, accepting no guilt or wrongdoing, just a way of saving legal expenses…but they drag these things out as long as possible, hoping the plaintiff will get tired of the whole experience

    Remember folks when they are recording you and asking questions it is an INTERVIEW WITHOUT CAUTION so be careful what you say. If it wasnt recorded they cant use it in court but because it is recorded they can even though you havent been informed of your lawful rights, putting you at a serious disadvantage.

      8.2 Collateral Intrusion.
      "Officers and staff are reminded that ALL BWV footage is subject to disclosure and may be relied upon or referred to at any stage during an investigation or prosecution of a case."
      The notion that the cameras are there to keep them honest is secondary to the evidence gathering capability.

      Merseyside police BWV (Body worn video) policy 2020.
      Section 8.2 Collateral Intrusion.
      "Officers and staff are reminded that ALL BWV footage is subject to disclosure and may be relied upon or referred to at any stage during an investigation or prosecution of a case."
      So it appears they use it and rely on it whenever they choose in both investigation and prosecution. If there is some finer detail in law that restricts it that is not reflected in the sections of policy i looked over and if there is a greater restriction i'm missing it would put the polices policy in direct conflict with the law.
      Again, i'm happy to be corrected if there is something i'm missing or not understanding

    Don’t forget to goto the ipc to make a claim for wrongful arrest that compensation is a separate claim from the court.
    This is the problem with the police these days the standards are so low, anyone can join and they all think they are the law, when they are not.

    Any constable who cannot control their emotions and ego like that should be immediately removed from duty.
    He obviously realised that no custody sergeant would authorise your detention for calling him an idiot so he backtracked with the FPN.
    It was a malicious arrest purely made on anger and ego.

      That's why every Fixed Penalty Notice issued by Plod should be challenged. This corrupt cop was attempting to enforce his own version of the law and hide that beneath a formal legal process by obfuscating the evidence and thereby denying due legal process. After all he's Met and we all know that most of them are corrupt.

    Never go to a 'voluntary interview' at a Police station, because it means that the Police don't have enough evidence of a crime, so they invite you to incriminate yourself. ( Basically, do their job for them. )

    Nothing wrong with going into a cell, it just increases the compensation you can get from them later. Also, going limp upon arrest is legal, makes their job more difficult as they have to get more officers to come and carry you into the police station.

    But I thought it was normal practice for any upset police constable to get to abuse the criminal justice system to resolve their own petty personal issues. I think we need the public to be involved in the police complaints procedure as it can’t otherwise be transparent and unbiased.

      Nothing has changed since the sixties then. Just finished work and popped in a shop for a drink. Came out to find a large sausage MET OINK standing by my bike. Demanded my licence but was disappointed to find all was legal. Then did the usual, create a crime search routine. Oooo! found a screwdriver and other tools in my tool bag. Invited me to the local for further investigation, declined. Then threatened to arrest me. On what charge i asked? Not going "equipped" surely? An embarrassed red faced IDIOT OINK walked away into the gathering gloom.😂

    Marti, don't accept an offer to settle. Take it all the way, even if it results in a much reduced payout. They want to drag it out and make you earn your compensation. So make sure it costs them AND goes to trial.
    At least afterwards there will be a court ruling that you can call a cop an "idiot" without fear of being charged or issued a fine.

      Thing is that it does not cost them anything, all court costs and compensation come out of the tax payers pocket not the cops pocket.

      It does not directly come out of the taxpayer's pocket. It comes out of that specific police force's yearly budget that they have already been allocated.
