    In a significant judgment, the Maharashtra Real Estate Regulatory Authority (MahaRERA) has ordered a developer to pay interest to homebuyers for the delayed possession of their flat, even though the occupancy certificate (OC) was obtained within the agreed timeframe. Lt. Col. Pratap Rajnish Singh and Mrs. Smita Joshi Singh filed a complaint against Pearlite Real Properties Private Limited, the developer of the "Godrej 24" project in Pune, through their advocate Gandhar Sonis. They had booked a flat in 2018 with a possession date of 30th September 2021. Although the OC was issued on 20th March 2020, the complainants did not receive possession until September 2022, and finally moved in on 10th January 2023. They amended their original complaint, seeking interest and compensation for the delay instead of a refund.
    The key legal issue was whether the complainants were entitled to claim interest under Section 18 of the RERA Act for the delayed possession, despite the OC being obtained on time. The developer argued there was no violation since the OC was received as agreed. However, the MahaRERA bench, led by Shri Mahesh Pathak, found that the developer failed to prove that possession was offered after obtaining the OC. Under Section 19(10) of the RERA Act, allottees must take possession within two months of the OC being issued, which the developer did not comply with. Therefore, the bench ruled that the complainants were entitled to interest from 1st October 2022 to 10th January 2023. The developer's claim that the delay was due to the COVID-19 pandemic was rejected. The MahaRERA's decision underscored that the developer had violated the provisions of Section 18 of the RERA Act.
    The MahaRERA partly allowed the complaint, rejecting the claim for compensation but directing the developer to pay interest from 1st October 2022 to 10th January 2023 at the prescribed rate on the amount paid by the complainants towards the flat's consideration. The complainants were represented by Advocate Gandhar Sonis, while the developer was represented by Ld. Adv. Prabhakar.

    I have observed one thing pcmc taken faster decision and execution when related to any development of roads or facility.
    PMC is very slow and lazy

    Good coverage of important topics in the interest of home buyers.
    Never invest in housing property within 100 metres of Riverfront, Railway Station, Highway, Airport, Bus Depot, Metro Depot and Terminus, etc... These properties are likely to face demolition in 15-20 years time.

      Demolition of big projects/societies with multiple towers is next to impossible especially if the PMC/PCMC has given permission for the same.

Maharashtra High Court has called for a survey of illegal tall structures in the periphery of the airport and Defence Establishments and their demolition. The residents in these buildings must be restive and spending worrisome days and nights. Powerful Delhi politicians couldn't save the demolition.

    Sir, Main West Bengal ka rehne bala hoon aur old Sangvi mein ek ghar kharidna chahta hoon. Keya yeh Sambhav hain. Main ek poor aadmi hoon. Idhar bengal mein state government employee hoon aur bengal state govt ka salary bhi bahut hi kam hain isliye main jyada rakam juta nehi paa rahan hoon. Mera service period bahut kam hain issliye jyada rakam bhi juta nehi paa rahan hoon. Mujhe after retirement uddhar permanently rehna hain.
    Keya mujhe koi help mill sakta hain aapka company ki taraf sei?

    Pune abhi bahut pichda city hai I must say .all cities are growing and expanding like anything.But in Pune little rain causes flood in main road ..no traffic police .. people are driving the way they want ..power cut issues .. not much Volvo buses plying in the route ..zero commute .. roads are even thinner ..no airport ..and real state markets are growing like anything here as it seems its Bangalore or Delhi ..Shame on Pune govt
