    Did you see the interview noting one of the "litigation attorneys" that was hired by Florida is one of the same attorneys who helped write the contract. He retired from his law firm and jump in with FSU and Clemson. He's from NC and made his money from one side now the other. Hell, the The architect is the easiest person to bring down the building.......

    Wonder if you’re willing To explore the thought; the more people in power (the conferences leaders in this case) say nothing to see here, the more likely there is something that everyone needs to see.
    Ex. How has the ACC operating budget gone from $12.5 million in 2012 to $40+ million in 2022? Seems like the full contract might one able to shed light on that.
    As a non-profit organization that ACC is, seems like there a lot of people getting rich off of it.

    The ACC is causing the pissing match because they are completely ignoring her.

    • @TheBigMountainPodcast

      Maybe.
      But their main argument is that she has no jurisdiction over them.
      Its like a bank in another state ordering you to give them your bank statements. They have to right to them so you just ignore the request.

    JY, from listening. you are slightly misstating why the AG says that no hearing is needed. It is not that she is saying that the ACC is wrong, but much more importantly the ACC failed to deny the allegations pled by the AG. If true (and we have no clue) that the ACC actually failed to deny allegations, that is a huge mess up. Perhaps under FL law it can be cured, but as a general matter any allegations in a pleading not denied are deemed to have been admitted, so her argument is that they admitted what we said. If that happened some lawyer for the ACC needs to be fired immediately. In the answer to any pleading, there are specific denials, then a catch all that denies everything that was not specifically admitted. I kind of doubt that mistake was actually made - or, if it was, there should be a cure.
    I do not know why the ACC would argue that they pled sufficient facts, but did not make specific denials. Really need specific denials.
    As to her approach to the GOR, it makes sense to me. Ask for it redacted and then argue about what can be redacted. Take one bite at a time. I do not buy ACC argument that trade secrets issue must be decided in advance, since clearly something can be produced without trade secret involvement.
    I did not see the Doug Rohan video on why he thinks that AG Moody should drop the case, so I have no comment on his argument. Off hand, I do not know why the FL AG should back off.
    As far as favorable venue, get used to it. That is how the law works. Called Forum Shopping.

    Who cares if she didn’t ask for a redacted version. Why didn’t they just give her one and say here you go now let’s fight?

    • @TheBigMountainPodcast
      @TheBigMountainPodcast  Місяць тому +1

      Two main reasons.
      1. They claim she doesn’t have jurisdiction, so they owe her nothing.
      2. They claim the Trade Secrets need to be defined prior to giving any version.

    • @noles9998
      @noles9998 Місяць тому +2

      @@TheBigMountainPodcast again they could have given her a fully redacted version, then tell her she no jurisdiction on any of the redactions. They know Florida public records laws so they know they have to provide something. Maybe this contract is so shitty that the shit that isn’t redacted sounds bad 😂😂😂

    • @MercerKnowsBall
      @MercerKnowsBall Місяць тому

      @@noles9998 If they GIVE her something AT ALL then they would be doing something that RECOGNIZES her Power to even ASK.
      They Say (correctly) She does not have ANY RIGHT to the Documents. So they IGNORE HER because she HAS NO POWER.
      If the ACC gives her ANYTHING they stand to lose their RIGHTS by GIVING Them Away to someone with No Power to ask them anything. .
      They DO know Florida Law. And they know Florida Law DOES NOT APPLY. So they IGNORE HER.
      Maybe this Contract is TOO IRON CLAD for the "LOLyers" that FSU has hired to try to F the ACC in a Favorable Court.
      Maybe FSU's HAS NO CASE (and in reality FSU has NO CASE).

    • @noles9998
      @noles9998 Місяць тому

      @@MercerKnowsBall it apparently does matter because the rebuttal is she didn’t ask for redaction, which indicated that they would have given her had she would had requested that. So there is merit to her request and the fact that Florida law has a certain, even if limited, sort of power to its request for a public record. If she or Florida had no power than why didn’t they say that in the rebuttal? Why not say that she or the state of Florida doesn’t even have power to review the redactions? If something is so Ironclad I would say bring it bitch come view this colossal MOFO. It obvious they are stalling and it’s obvious they don’t want this non ironclad contract viewed. 😂😂😂

  • @MercerKnowsBall

    Not saying the ACC didn't seek a Favorable Venue. Just that the ACC only needs a FAIR VENUE because FSU has NO CASE and could only WIN if it got a BIASED VENUE.

    Simple solution for obtaining the espn contract. Close Disney world. This is about money. Disney owns espn, shut down Disney until they make espn submit. How long do you think Disney will sit empty during peek summer? Time to play hardball and quit playing around.

    I’m a big fan of the show. You need a T shirt that says “No first downs, only touchdowns”. AG Moody responded with a solid pivot. Yes, she wanted to hit a home run, but it was a swing and miss. Now she’s aiming for getting on base. Plenty of ways to score.

    Neither FSU nor AG Moody really cares about the contract. This is all to put pressure on ESPN because 1) ESPN meddled in the football playoff selection more than we'll ever know and this is revenge, and 2) ESPN can force the ACC to negotiate with FSU.
    People say this is pandering, which is true, but FSU is not the biggest nor most popular school in Florida. FIU, UCF, USF, and UF all have more students. Only a small portion of her constituents care about this issue. More of her constituents would probably prefer FSU stay trapped in the ACC, and most are probably indifferent. What's best for the State of Florida though is for FSU to be in the Big Ten or SEC.

    • @dlksjax

      The size and populations of universities in the state of Florida matters not. As the AG of the state she is obligated to defend entities of the state to determine if wrongdoing is suspected, not pandering, just her job.

      FIU, UCF or USF have zero history and haven’t won s**t so the declaration of FSU being less popular is ludicrous.

      FSU gets more TV viewership than any of those other schools. They're also the best CFB program in the state. The others all wish they had as much success. Finally, this has nothing to do with revenge on ESPN. It's about money. If FSU could be in the SEC broadcast by ESPN for what SEC teams get without going through this legal drama, they'd do it.

    • @juddwilson
      @juddwilson Місяць тому +3

      FSU & UF are the two most important CFB programs here in Florida. Miami is 3rd. UCF and the rest are still new kids on the block. A knock on FSU is a knock on the whole state, ergo all the state political pushback against excluding FSU from the playoff despite a perfect record. It's about the viability of CFB in Florida schools, period. Florida's major programs deserve & must have access to the top level of CFB and the national championship playoff process.
