2021 Airspace infringement retraining debacle.

  • After months of mucking me around, not letting me book training, asking for paperwork before it was necessary, forcing me to apply for a "Foreign Carriers Permit" from the CAA, which took weeks, endless toing and froing, as well as the application fee, the permit finally arrived.
    The permit they had insisted on, which only authorised me to fly with Aviation Southwest.
    The same day, I got this email below.
    Dear Mr. Lamdin,
    I am writing to let you know that we have taken the decision to decline to support you with the remedial training that you require. I do hope that you are able to access a training provider that will be able to meet your needs.

    I'm realistic and fully accept all the nuances of aviation training, paperwork and authorisation, but this was the most unprofessional and discourteous treatment I have ever received from any training organisation anywhere in the 6 countries I have used training organisations. (Portugal, Canada, USA, Norway, UK).
    Knowingly wasting other people's time (let alone money) is something I would never do.

    Jeez guys! This video has triggered all the Health & Safety police. We were ON THE AIRFIELD, on a private, gated, single track road when Archie had his seatbelt off and the phone was in a cradle or being held by Archie when I was on the road. I may be stupid, but I'm not THAT stupid! Thank you all for your concern, but, notwithstanding my infringements, I'm really not that stupid.

      When the camera is in front of you it appears to move with your body movement and not the movement of the vehicle which would suggest the camera is being held by yourself. Personally I would class a child out of a seatbelt as a distraction as they move about in and out of the seat, a driver operating and talking to a camera is something else I would class as a distraction and driving on an airfield would be a distraction as the driver is mixing with vehicles, people and aircraft. Again, just my personal opinion.

    Glad I watched this. Had a licence for a year now and although I would not fly through or over a ATZ normally its worth remembering if you do you need to be talking to the tower. Silly little things like that can catch you out out with small airfields.

    Hi you seem to be a risk taker 3 air space infringements. And then record a blog whilst driving a car with you child sat with you. I think you could have done this sat at home without the risk of driving, and given full attention to the road ahead. Maybe a retest for your driving may be on the books in the near future. I would have respect you a lot more if you had applied your situational awareness to driving as well

      Your assessment method needs its own assessment. The first two infringements were nothing to do with risk appetite (I’ve done a video which explains them in full).
      The third one was on a flight that did have a higher element of risk given the low cloud base although the infringement itself was pure ignorance of rule 11, nothing to do with risk. You clearly have far more time on your hands than me for which congratulations! Everyone is a risk taker to some degree. So calling me a risk taker is moot. Please try harder with your constructive criticism! 😎

    Actually what am I thinking, these are UA-cam comments 🙈😂
    Another good video. As you say you’ve done wrong, but learnt from it and taken onboard the training.
    Can’t understand why the first ATO didn’t just say we don’t want to be recorded and crack on.

    Very useful video. It is a shame how you've been treated from the wankers at the first ATO. UA-camrs need thick skin with all the toxic negative people commenting but these videos help everyone. We all make mistakes and we all learn by sharing our mistakes. Well done Charlie! Keep up the good work :)

    All very interesting - from a number of angles. The key thing, as you say at the end, is avoid infringements, almost at any cost! I'm lucky to be based in an area with lots of Class G but it makes me doubly careful when going anywhere with other classes either laterally or vertically. The CAAs role in all this actually paints it in a much more positive light than might have been expected so well done to it on that score. The really interesting issue is the action / reaction of the ATOs to your "influencer" (?) status. Is there a fear of being given a poor review or some desire not to open up their methods to public scrutiny? They could have asked you not to record any of the retraining or at least discussed it with you but, presumably, to accept and then decide to change their mind seems to me to be something of an own goal. I have to say, in my experience, I've come across very few examples of outstanding customer service fro ATOs and plenty of poor service so perhaps that's what has been at play in your case. Another angle seems to be as soon as anyone puts their head above the parapet whether complaining about poor service or making UA-cam videos they cab be ostracized by those who do not want their particular boat rocked.
    Anyway, excuse my rant, but glad it's finally resolved for you and may you fly trouble-free in future.

    Hello Charlie, I wasn't sure whether you were just repeating my experience with re-training for airspace infringement. I fly My US registered AC50 and firstly they offered an instructor without a multi rating, then two instructors who bowed out and then a third who promptly went off to Spain. I have done the theory now but my aircraft's annual is extending due to back order of parts, so still no practical. By the way I have a US IR and also UK licence, with various ratings, about 5000hrs and been flying for more than 50 years. Regards, Martin

    That’s such a weird interaction with southwest aviation. If they were concerned about UA-cam why not just have a frank conversation and ask to keep the cameras off during training. Eg it could of been like in your blog something like anonymising them like you did with the gentleman who conducted your retraining.

    Love the video and how open you're with everything. However you have at 4:58 you have a child in the front seat of a car going at some fair speed with no seatbelt on... Your holding a camera / phone as a selfie and the kid isnt strapped in, even if on private land the kid should have a belt on just in case.

      I was on the airfield at that point. Private, gated road, no traffic, so no danger I assure you. And no, I grew up on a farm being driven around in tractors and land rovers and never once needed to wear a seatbelt. I assure you that on the airfield belts aren't necessary.

      Actually, that is not quite correct, in the UK seatbelts are mandatory on any private land which is publicly accessible that would include airfields 😊.

      @@CharlieLamdin Why does that matter? How can you confidently say there is no danger? You're operating a vehicle at speeds with one hand and a child with no seatbelt on. You yourself have a seatbelt on which means you have done some sort of involuntary risk assessment. A child doesn't hold the mental responsibility to know what is dangerous and what isn't. Your car doesn't know what land its on, there are countless reasons why an accident could happen these are increased dramatically when the driver is occupied doing something else other than driving as well. One tap to the front bumper and an airbag is going to get deployed with wrong timings.

      Jeez, I didn't know so many police watched my videos!! I was on the airfield at that point. Private, gated road, no traffic, so no danger I assure you. On the road, belts were worn and phone was in a cradle.

      @@CharlieLamdin I think at that speed, private road or not I would be wearing seatbelts. As pilots we are taught to plan for the worst and hope for the best, I don't think this video reflects that. If this was me looking back, I might think about putting the cameras away for a while, focus on flying and trying to stay ahead of the aircraft.

    Retraining with an examiner and being signed off? That's more like an unofficial test that has been contrived. Of course you are a huge danger, in those three infringements you were mere seconds away from causing mass devastation. No, of course you weren't. This whole minor infringement handling is OTT by an out of control CAA. For a start you're transponding so the CAT (which is all they actually care about safetywise) can see you. All that's necessary is a bit of a chat to understanding why it happened and how it can be avoided and if someone keeps infringing then perhaps a more in depth discussion. Of course somebody who wanders across the middle of a CTR (clueless as opposed to clipping or small error) is a real hazard and needs to be handled differently and most likely will need remedial training.

      Which is why he was offered retraining to ensure the next infringement isn’t over the middle of the CTR and not has his licence revoked and fined

      @@richtyler the reason for this infringement was a lack of understanding about air law and rules of an ATZ. So how does 3 hours of flight training best address this deficiency? Which was already learnt in fact in the conversation immediately following the infringement?

      @@gwynsea8162 this was his third recorded infringement, he would have received classroom training and then flown 3hrs to check understanding of said air law, flight planning, navigation, situational awareness, distractions, threat and error management, decision making, etc etc so yes it does in my opinion and clearly the regulators too.

    Did any of the retraining suggest that making videos while flying an aeroplane could be the factor contributing to the infringements? Perhaps it's too much yakking to the camera when instead you should be concentrating flying the aeroplane !

      @@CharlieLamdin What if an animal ran out from the bushes? Three possible outcomes: you don't see it, maybe because you're distracted, and so needlessly kill an animal, or you do see it but realise braking sharply would be dangerous with the front seat passenger not wearing a seatbelt and so needlessly kill an animal, OR you don't consider the consequences of braking and so throw Archie through the windscreen.
      It's just not a sensible thing to do regardless of circumstances. The car has seatbelts, use them.

      Zac. There’s a go kart track with a solid fence on one side of the track and an airport runway on the other. No animal has ever been hit on that road. I’m sorry if you’ve had a traumatic experience that’s led to your paranoia. Careful. UA-cam is a dangerous place. However.     In my mind, if a teacher is not willing to teach someone who has a following, they know they can’t teach well and don’t want to get caught. Of course there are exceptions, but that’s what this case feels like.

      It's an interesting one, I have had instructors who ask for no cameras, others seems to be up for it and want to be a star for a day. I've been asked not to publish, because 'people will complain'. I generally don't film training firstly as I want to concentrate on the training, and too many arm chair instructors love pulling things apart. I know of schools who don't understand how social media works and what opportunities it can give, but that is their choice, at the end of the day I respect their wishes, they after all are running their businesses their way. However people forget that even a negative can be turned into content and help to explain the real life experiences we are all having in our flying.

    The third infringement was typical of the crock of sh***te that is low level controlled airspace in the UK, in that the Bournemouth controller watched you steam into the Lee on Solent ATZ on his screen with no attempt to warn you. He was equally culpable but of course can shrug his shoulders and say something inane like 'Basic Service Guv, VFR, your responsibility...' This sort of thing would never happen on the Continent. In my opinion it is the CAA and NATS who should be brought to account, not private pilots such as yourself. As for children and seat belts, that's the 'Nanny State' in action, it's your responsibility as a parent to do what is best for your children and yours alone...
