If this is true, then that artist who got sued should go and sue the company who sold him the sampled pack, that claimed that the samples were royalty free. That will definitely remedy this issue. That strategy of uploading music to UA-cam and then letting it sit unlisted works!!! I have been doing that method for years and it has saved me so much money and so many heartaches! It's the easiest way to find out whether or not your music has a sample in it that is uncleared or if other producers have used that same sample in the same way. It also works to track loops as well

Artists are going to go the same route as dispensaries when they first became legal in NYC. You wasn’t able to sell a certain amount only “gifting” was available, sell a t shirt for $10 and “gift” the consumer the album to duck the record labels and samples
Giving music away doesn't protect you under copyright law. Copyright holders are less likely to go after you, but they still can (think of all those free game mods taken down by Nintendo and Disney).
From what it looked like is someone made a "sample pack" that the producer used assuming it was created strictly for royalty free sampling. Yet the distributer was being sleazy and used a pre-existing published song from the 80's. Not excusing the bad follow up when it comes to paperwork in business, it just seems this type of scam has gotten pretty prevalent recently. Ignorance and corporate bloodlust being at an all time high. The larger fear I have is that even people that do not sample at all have been getting hit with lawsuits over things such as song "vibes" being similar. Copywrite scanning has people slammed with waves of claims from the likes of UMG etc. Noodle on your guitar or playing some keys and hit a melody progression that songs have used before in any form? Nope! Claimed. You can keep the video up but we take all the revenue. If you want to complain and run a fade we will make sure you end up with a strike too. It's lunacy. There honestly has to be a better way. Copywriter needs to be easier and more streamline so EVERYONE can get their proper cut and make money. I like the concept of what Tracklib is doing on that end. I just hope it becomes more wide scale. I'd rather we all win then all lose to systems created by people not even involved in the music industry.
Some may not want to hear this but investing in learning how to play an instrument would help alot… i can make my own samples in different genres then chop those up or play as is if i want to … may take you some time but it will be well worth it
Facts, I currently pay session artists to replay or interpolate different songs I wanna sample and get them to modify it to the point where I can chop it up and arrange it and it won't trigger a copywrite infringement while still keeping the feel of the sample that inspired me to begin with. I'm working on my keyboard skills now, that one skill set can open up doors and save me money in the long run and allow me to express myself more fully as an artist 🎨 🙌
One of the reasons the major corporations bought out so many catalogs of songwriters and producers, is because sampling is the way forward for the masses as they don't actually play instruments. They have cornered the money in the numbers game. If 10,000 fools slip up and sample from any music owned by these corporations, they will make hundreds of millions without having to sign anyone. A few will strike gold over the years and they will collect on the back end. The market is oversaturated anyway. Maybe this isn't the worst thing. We will see over time.

It is the era of education and tutoring to be an official music entrepreneur. Because going to the library and getting hearsay was a dizzy experience back in the day.
Here’s the thing, did the sample pack company get rights to sell those samples? If not, then it’s on the sample pack company. the thing is, I see people online sampling stuff from commercial music that is copyrighted all of the time. the thing is, without the express written consent and contract with the Artist… It is copyright infringement. whoever owns the rights to that music, is the owner of every beat and every note played and word sung. Whether it be a five or 10 second sample or the entirety of the song… It is still copywritten. Now, in this situation… Where the sample came from a collection that I’m guessing he bought… Then the express written agreement may or may not include commercial replication of those samples. Unless the company who makes the samples has an agreement with the artist who originally wrote the song those samples came from. But again, it would have to allow for those who use the samples to be able to do so in a commercial fashion. Meaning, if their song goes to number one on the charts there would be nothing that Artist could do to sue anybody who uses them. Again, only if there was a clause in the contract that gave anybody who used the samples, the right to use them in a commercial fashion. That’s where it gets sticky. All of this falls on the company who released those samples, but also on the bi-laws that the artist who used those samples agreed to when they bought them. Meaning that there is always fine print that states how the samples can be used. That you agree to when you purchase them. Which is a situation for anybody who uses samples or makes them. Because if you do not have permission from the copyright holders to use the samples, they can sue you. Which they will probably not do unless your song rises up the charts or goes viral like this one did. you have to understand, that artists don’t make that much money from the music anymore. They make it from touring. so, if somebody uses a sample from their music that ends up making that person who used the sample money… then, the artist who wrote the music originally is entitled to a cut. Unless there was an agreement beforehand.

Morally, it should be on the sample company. Legally, it's not; it's on you because you made and released the music, and you can't point a finger at someone else. Maybe they get in trouble too, but it won't save you. Doesn't matter if there was a T & C supplied with the samples or not.

The boat that people repeatedly miss with the Truefuego story is that they reached out to him MULTIPLE times and he DID NOT respond. For those trying to clear samples, if you at least have a PRO search the database to see which publisher you have to contact to clear it. Send them an email. They will eventually respond, you will be given an amount of money it may cost or a range and have to share information about your song as well as an audio file. You will be given warnings about what you can and can't do with the song going forward. ALWAYS assume the beatmaker/producer didn't clear the sample first and search the PDF of your lease to see if anyone else is credited in the samples used area. Make sure your distributor is using soundscan technology to check for samples and to clear whatever you're releasing first. Ours will tell us every time a sample was used and if another artist or composer was involved and what licensing we need to provide them with to go further. Situations like this stem from a lack of due diligence, not dotting i's or crossing t's. If you want to be in the business then learn the business. Learn what you need to do to make money off it or release it legally. ~J. Bunny

That’s why you gotta chop samples into bits and change the pitch. Make it different than the original. A lot of people always loop samples in their beats and the samples can get recognized. I always stay away from looping.
People are too lazy and greedy like there is no reason to clear a sample with all the ways to get around it it may be slower but I can guarantee it you are gonna eat

Speaking from experience, it does slightly fall on an artist to clear samples they use, regardless if they used samples from royalty-free packs like Splice. As a Sound Designer, I always have to confirm clearance when I’m selling packs to clients it’s standard practice. This happens when people try to pass off other’s catalogs as their own and over saturate the market. I’m confused why this is Sonys problem? How did the sample align with a project of theirs? Where’s that thread?

The general rule is, is it’s up to the artist or artists label you sell/give your beat to to clear the sample for release. As a producer/beat maker you don’t need to clear anything really. Especially if you’re giving it away for free online.

I play piano and bass and still choose to sample because of how much i love the art form of sample manipulation. 9th Wonder and other sample based producers run university courses and have spoken at oxford union about sampling.

Consent is established If they lifted straight from copyrighted record w/o licensing and didnt clear it, thats when it can be issue. Most of the time, if the producer plays their cards right, will include in the contract that any samples that need to be cleared is the sole responsibility of the artist who buys the beat. However, when the producer don't even know that it needs to be cleared...that's when it gets f'd up fr..smh

I grew up in a small town with few other artists, I've created other artists and just changed my voice in the past, once ai came into the picture I started making music AS other artists like "Renlato'" and "Saint CNG" that sounded better doing different styles. recently checked out Udio and have been utilizing it in some very creative ways. its very powerful and I don't wanna get left behind so ima try to use it as much to my advantage as I can.
I mean this in the nicest way- and I mean no disrespect to any party here but the hip hop commmunity is pretty behind with getting behind sound design and getting familiar with the renaissance of sampling- resampling. You don’t need to be a sound design wizard, but especially now with ai and insane sample pack controversy, it’s a push to raise the standard and learn to mangle. Learn to mess around with a synth or fiddle with recordings and make your own stuff. You’ll be happier with coming up with new ideas you’d never imagine making in the first place. I’m not here to tell you how to make music but give you solution on how to avoid this problem.

I'm an early adopter to AI. Great servant but terrible Master. It's not about the magic wand it's magician who makes it happen. The novelty affect the average user may have fun with and make something they like. But the dope stuff will still come from those who put in the work to make it fly. Ai can only emulate swag it can't make it. It's those who are creative that can take these tools and create something next level. Mid Wil be mid and that fire stays lit when that work is put in. And when I say work I'm not excluding ones imagination. Someone may not have the ability to play but they have a lot of dope sh*t they hear in their minds ear. It's all about figuring out what recipe is best for what you gonna serve. Peace!

But keep in mind it already happened to traditional painting artist like my self, and I can still paint, maybe not as well as when I was young but I actually do have paintings on my easels. But I get the same feeling from mastering a well constructed prompt for A.I. to create what is in my imagination in seconds. And I can easily have that picture put on canvas and garments. So let's please do as you said and use A.I. to create some of the tunes that previously took us days to produce and use it as samples, I still have to add to it in my DAW anyway. I was reading "All you need to know about the music business" and, indeed, as you said, they dont go hard on producers or distributors. For example, producers sometimes take 3 points of the master, and, artists gotta make an initial payment for producing the song. Then, artists gotta recoup their 3 percent before earning something.

Lander does what you're talking about as far as checking the songs for samples. I get flagged every now and then, but that's also one of the reasons why I use Landers sample pack and distribution together to streamline that process and save time and energy

Sound is everywhere and it's free we cant be letting these record companies do us like this, I went to the park a while back and there was a guy genuinely sampling the metal gate because it sounded like a horn, everyone knows about the street drummers on pots and pans, All power to people using sample packs if they want to but literally EVERYTHING makes a sound, sound is everywhere like the air we breathe. I'm composing for a videogame, sampled a chef in a restaurant making a ghost noise, don't have to worry about other people using that from a sample pack, it's amazing what you can achieve just going out into the world with a microphone. If the industry is gonna try and move one way, we need to move another really.
I'm a up coming beat maker. Although I make my original made beats but every once in a while I do sample....Sampling is part of the hip hop culture ...I don't see it like stealing. I see it like we showing musical apprecriation to the greats before us ...I do Boom Bap heavy East Coast beats. Know that alone I like to chop sounds add my bass, add a little reverb....then add my scratches, my chopped samples...then take my EQ to clean out the sample & my drums. Last thing I do is master the whole project...put on a dat & whaalaah we got a beat done. I think the industry using artist for sampling is buggin'. If they trying to go after rap artist that sample....then what about when R&B uses samples? What about pop music uses sampling ? Even house , rock n roll, & gospel sample music. My advice to any up coming artist that want to use a sample sound....just make sure you clear it with the original artist or band. You don't want to be caught up in legal situation. That's crazy. That's why i sample myself from old songs that i did. Im from Texas so on my screwed and chopped hooks or bridges i just sample myself and screw and chop it for a new song if need be. People think it's samples from other Texas artist but it's all me. And i will always sample myself. Looks like i been a step ahead for a while now.
There are a ton of affordable sample clearance and leasing routes nowadays. No need to get sued and if you lease and do paperwork for the lease. Then the liability routes that way

This is a hard one! Mega Corp. going after an individual artist and an Indy artist at that is bullshit. On the other side, copyright exists for a reason. I really feel like artists should be acknowledged and compensated for extended sampling (I.e. large musical phrases). If your hook is the entire melody of another song that needs to be acknowledged. If people producing “sample packs“ are including those types of content, they need to give heads up to people buying those sample packs. The easy solution compose your own hooks and go back to old-school sampling!

If this is true, then that artist who got sued should go and sue the company who sold him the sampled pack, that claimed that the samples were royalty free. That will definitely remedy this issue. That strategy of uploading music to UA-cam and then letting it sit unlisted works!!! I have been doing that method for years and it has saved me so much money and so many heartaches! It's the easiest way to find out whether or not your music has a sample in it that is uncleared or if other producers have used that same sample in the same way. It also works to track loops as well

From what it looked like is someone made a "sample pack" that the producer used assuming it was created strictly for royalty free sampling. Yet the distributer was being sleazy and used a pre-existing published song from the 80's. Not excusing the bad follow up when it comes to paperwork in business, it just seems this type of scam has gotten pretty prevalent recently. Ignorance and corporate bloodlust being at an all time high.
The larger fear I have is that even people that do not sample at all have been getting hit with lawsuits over things such as song "vibes" being similar. Copywrite scanning has people slammed with waves of claims from the likes of UMG etc. Noodle on your guitar or playing some keys and hit a melody progression that songs have used before in any form? Nope! Claimed. You can keep the video up but we take all the revenue. If you want to complain and run a fade we will make sure you end up with a strike too. It's lunacy.
There honestly has to be a better way. Copywriter needs to be easier and more streamline so EVERYONE can get their proper cut and make money. I like the concept of what Tracklib is doing on that end. I just hope it becomes more wide scale. I'd rather we all win then all lose to systems created by people not even involved in the music industry.
Some may not want to hear this but investing in learning how to play an instrument would help alot… i can make my own samples in different genres then chop those up or play as is if i want to … may take you some time but it will be well worth it
Facts, I currently pay session artists to replay or interpolate different songs I wanna sample and get them to modify it to the point where I can chop it up and arrange it and it won't trigger a copywrite infringement while still keeping the feel of the sample that inspired me to begin with. I'm working on my keyboard skills now, that one skill set can open up doors and save me money in the long run and allow me to express myself more fully as an artist 🎨 🙌

One of the reasons the major corporations bought out so many catalogs of songwriters and producers, is because sampling is the way forward for the masses as they don't actually play instruments.
They have cornered the money in the numbers game. If 10,000 fools slip up and sample from any music owned by these corporations, they will make hundreds of millions without having to sign anyone. A few will strike gold over the years and they will collect on the back end.
The market is oversaturated anyway. Maybe this isn't the worst thing. We will see over time.
That's why I only use session musicians to play my melodies or pay them to play random stuff that I can chop and restructure into something dope.

Here’s the thing, did the sample pack company get rights to sell those samples? If not, then it’s on the sample pack company. the thing is, I see people online sampling stuff from commercial music that is copyrighted all of the time. the thing is, without the express written consent and contract with the Artist… It is copyright infringement. whoever owns the rights to that music, is the owner of every beat and every note played and word sung.
Whether it be a five or 10 second sample or the entirety of the song… It is still copywritten. Now, in this situation… Where the sample came from a collection that I’m guessing he bought… Then the express written agreement may or may not include commercial replication of those samples. Unless the company who makes the samples has an agreement with the artist who originally wrote the song those samples came from. But again, it would have to allow for those who use the samples to be able to do so in a commercial fashion.
Meaning, if their song goes to number one on the charts there would be nothing that Artist could do to sue anybody who uses them. Again, only if there was a clause in the contract that gave anybody who used the samples, the right to use them in a commercial fashion. That’s where it gets sticky. All of this falls on the company who released those samples, but also on the bi-laws that the artist who used those samples agreed to when they bought them. Meaning that there is always fine print that states how the samples can be used. That you agree to when you purchase them.
Which is a situation for anybody who uses samples or makes them. Because if you do not have permission from the copyright holders to use the samples, they can sue you. Which they will probably not do unless your song rises up the charts or goes viral like this one did. you have to understand, that artists don’t make that much money from the music anymore. They make it from touring. so, if somebody uses a sample from their music that ends up making that person who used the sample money… then, the artist who wrote the music originally is entitled to a cut. Unless there was an agreement beforehand.

Morally, it should be on the sample company. Legally, it's not; it's on you because you made and released the music, and you can't point a finger at someone else. Maybe they get in trouble too, but it won't save you. Doesn't matter if there was a T & C supplied with the samples or not.

The boat that people repeatedly miss with the Truefuego story is that they reached out to him MULTIPLE times and he DID NOT respond. For those trying to clear samples, if you at least have a PRO search the database to see which publisher you have to contact to clear it. Send them an email. They will eventually respond, you will be given an amount of money it may cost or a range and have to share information about your song as well as an audio file. You will be given warnings about what you can and can't do with the song going forward. ALWAYS assume the beatmaker/producer didn't clear the sample first and search the PDF of your lease to see if anyone else is credited in the samples used area. Make sure your distributor is using soundscan technology to check for samples and to clear whatever you're releasing first. Ours will tell us every time a sample was used and if another artist or composer was involved and what licensing we need to provide them with to go further. Situations like this stem from a lack of due diligence, not dotting i's or crossing t's. If you want to be in the business then learn the business. Learn what you need to do to make money off it or release it legally. ~J. Bunny

That’s why you gotta chop samples into bits and change the pitch. Make it different than the original. A lot of people always loop samples in their beats and the samples can get recognized. I always stay away from looping.

Speaking from experience, it does slightly fall on an artist to clear samples they use, regardless if they used samples from royalty-free packs like Splice. As a Sound Designer, I always have to confirm clearance when I’m selling packs to clients it’s standard practice. This happens when people try to pass off other’s catalogs as their own and over saturate the market. I’m confused why this is Sonys problem? How did the sample align with a project of theirs? Where’s that thread?

The general rule is, is it’s up to the artist or artists label you sell/give your beat to to clear the sample for release. As a producer/beat maker you don’t need to clear anything really. Especially if you’re giving it away for free online.

I play piano and bass and still choose to sample because of how much i love the art form of sample manipulation. 9th Wonder and other sample based producers run university courses and have spoken at oxford union about sampling.

Most of the time, if the producer plays their cards right, will include in the contract that any samples that need to be cleared is the sole responsibility of the artist who buys the beat. However, when the producer don't even know that it needs to be cleared...that's when it gets f'd up fr..smh

I grew up in a small town with few other artists, I've created other artists and just changed my voice in the past, once ai came into the picture I started making music AS other artists like "Renlato'" and "Saint CNG" that sounded better doing different styles. recently checked out Udio and have been utilizing it in some very creative ways. its very powerful and I don't wanna get left behind so ima try to use it as much to my advantage as I can.

I mean this in the nicest way- and I mean no disrespect to any party here but the hip hop commmunity is pretty behind with getting behind sound design and getting familiar with the renaissance of sampling- resampling.
You don’t need to be a sound design wizard, but especially now with ai and insane sample pack controversy, it’s a push to raise the standard and learn to mangle.
Learn to mess around with a synth or fiddle with recordings and make your own stuff. You’ll be happier with coming up with new ideas you’d never imagine making in the first place.
I’m not here to tell you how to make music but give you solution on how to avoid this problem.

I'm an early adopter to AI. Great servant but terrible Master. It's not about the magic wand it's magician who makes it happen. The novelty affect the average user may have fun with and make something they like. But the dope stuff will still come from those who put in the work to make it fly. Ai can only emulate swag it can't make it. It's those who are creative that can take these tools and create something next level. Mid Wil be mid and that fire stays lit when that work is put in. And when I say work I'm not excluding ones imagination. Someone may not have the ability to play but they have a lot of dope sh*t they hear in their minds ear. But keep in mind it already happened to traditional painting artist like my self, and I can still paint, maybe not as well as when I was young but I actually do have paintings on my easels. But I get the same feeling from mastering a well constructed prompt for A.I. to create what is in my imagination in seconds. And I can easily have that picture put on canvas and garments. So let's please do as you said and use A.I. to create some of the tunes that previously took us days to produce and use it as samples, I still have to add to it in my DAW anyway. I was reading "All you need to know about the music business" and, indeed, as you said, they dont go hard on producers or distributors. For example, producers sometimes take 3 points of the master, and, artists gotta make an initial payment for producing the song. Then, artists gotta recoup their 3 percent before earning something.

Lander does what you're talking about as far as checking the songs for samples. I get flagged every now and then, but that's also one of the reasons why I use Landers sample pack and distribution together to streamline that process and save time and energy

Sound is everywhere and it's free we cant be letting these record companies do us like this, I went to the park a while back and there was a guy genuinely sampling the metal gate because it sounded like a horn, everyone knows about the street drummers on pots and pans, All power to people using sample packs if they want to but literally EVERYTHING makes a sound, sound is everywhere like the air we breathe. I'm composing for a videogame, sampled a chef in a restaurant making a ghost noise, don't have to worry about other people using that from a sample pack, it's amazing what you can achieve just going out into the world with a microphone. If the industry is gonna try and move one way, we need to move another really.

I'm a up coming beat maker. Although I make my original made beats but every once in a while I do sample....Sampling is part of the hip hop culture ...I don't see it like stealing. I see it like we showing musical apprecriation to the greats before us ...I do Boom Bap heavy East Coast beats. Know that alone I like to chop sounds add my bass, add a little reverb....then add my scratches, my chopped samples...then take my EQ to clean out the sample & my drums. Last thing I do is master the whole project...put on a dat & whaalaah we got a beat done. I think the industry using artist for sampling is buggin'. If they trying to go after rap artist that sample....then what about when R&B uses samples? What about pop music uses sampling ? Even house , rock n roll, & gospel sample music. My advice to any up coming artist that want to use a sample sound....just make sure you clear it with the original artist or band. You don't want to be caught up in legal situation. Again, pay for your samples the right way & you'll be aight.....

That's crazy. That's why i sample myself from old songs that i did. Im from Texas so on my screwed and chopped hooks or bridges i just sample myself and screw and chop it for a new song if need be. People think it's samples from other Texas artist but it's all me. And i will always sample myself. Looks like i been a step ahead for a while now.
Sheesh. How are producers like Cookin’ Soul, Metro, Alchemist, etc. able to get their samples approved and uploaded on these types of platforms?
You should use software to check the sample yourself OR just ONLY use samples that have been vetted
There are a ton of affordable sample clearance and leasing routes nowadays. No need to get sued and if you lease and do paperwork for the lease. Then the liability routes that way
I think what’s interesting is when the label takes a project from the indie artist that’s not cleared or payed for but there it nobody to represent the artist when it’s time to sue the major labels

This is a hard one! Mega Corp. going after an individual artist and an Indy artist at that is bullshit. On the other side, copyright exists for a reason. I really feel like artists should be acknowledged and compensated for extended sampling (I.e. large musical phrases). If your hook is the entire melody of another song that needs to be acknowledged. If people producing “sample packs“ are including those types of content, they need to give heads up to people buying those sample packs. The easy solution compose your own hooks and go back to old-school sampling!

I've been warning about the inherent danger of huge Subscription Sample Libraries like Splyce.
I've had a supposedly Cleared Vocal NERF Licenced Sample flag CID, this alerted me to the fact Copyright ©️ Protection Systems, confusion over Sampling Legalities & predatory business practice would converge.
The net result being swathes of new Indie Artists putting their necks on a chopping block that they can't see.
I steer clear of bulk non exlusive sample packs, I tend to limit myself to hits & one shots like a Perc Hit for a Drum Pad. Melodic chord progressions should be avoided, & I would advise never use a vocal sample from a Library that's not chopped & glitched.

You are correct. Sampling as we know it, is dead. AI can make a "sample" that has never been created before.
