- Katherine Magbanua testifIed Thursday on her own behalf, taking the stand at about 1 p.m. to explain to jurors her innocence in the murder of Dan Markel. Magabanua flatly denied having anything to with the murder of Dan Markel. She first answered questions posed by her defense team. Prosecutors began their cross examination at about 2:45 p.m.
Magbanua walked jurors through her personal life with the father of her children, convicted killer Sigfredo Garcia, and Markel’s former brother-in-law who she dated, Charlie Adelson, who prosecutors say is the one behind the murder for hire plot. Except for just 2 more. Wendi and Harvey.

Let Katie be free once more and have Rivera charged for perjury for lying! His testimony is full of lies compared to Katherine Magbanua, she only said the whole truth here that she had nothing to do with Dan Markel's murder.

Why is Katherine there in a retrial if she doesn’t have any memory and refuses to answer anything? She’s clearly guilty of all charges.
Potential freedom, but everyone else besides her knew that she was going to prison. I would have thought about it and contemplated on what evidence they have on Sigfredo and realized that he is going down anyway. I would have just given a little help on getting to his destination.

Now that I am viewing it after the guilty verdict, I COMMEND THE ASSISTANT STATE ATTORNEY FOR EXCELLENTLY INTERROGATING DEFENDANT MAGBANUA ON THE DOLCE VITA RECORDINGS. If I were on the Jury, I would be highly suspicious that Ms Magbabua was guilty of enabling murder, based on this cross-examination. GREAT WORK TO EXPOSE A MURDERER.

Rewatching this because I have nothing else better to do and I noticed a response that is particularly odd... Dugan asks Katherine if the fact that her phone pinged on the same towers as Sigfredo's for the rental car purchase was a coincidence. Katherine takes a slight pause and realizes she can't deny it, and makes the mistake of answering "if that is your opinion". Most people speaking from their experience wouldn't say it was anyone's "opinion" on a coincidence. If she was innocent, shed probably say... "yeah what an unfortunate coincidence""
She's a totally different person than the last trial, she's been harden, charisma is totally gone, she can't play the part like she did in the first trial

For instance, the highest amount ever was a waitress at Tundra who got a NEW YEAR'S EVE tip from movie producer Oliver Stone for $500. These worker's lived in regular inexpensive housing like me! To suggest these servers make anywhere near $300,000 a year is ABSOLUTELY BLATANT PERJURY.

I don't know about South Beach, but the bottle servers in Vegas make that kind of money. I would have thought the same type of clientele frequented clubs in both cities.
This is by far the dumbest defense I have ever heard! If you are telling the truth, you don't have to refer back to any transcript or try to see if the prosecutor has the evidence; the truth never changes!

No way anyone would sit there and listen to someone they know well go on and on about something you can't understand. You'd think she and lawyer would do an autopsy after the first trial to be prepared with a believable story.

@@aprilbrooks709 I don't know but putting the defendant on the stand and expecting the jury to believe I don't recall and I don't remember and it was all a coincidence coming out of the defendants mouth surly doesn't help . If they had not put her on the stand, perhaps the jury would've had to speculate about a lot of the stuff and perhaps at least one juror may not have felt comfortable putting someone away for life on speculation. Her testimony definitely did not help at all.

I’m so CONFUSED as to why Katie was the way she was on the stand. It’s like she was so brainwashed into believing she would not be found guilty. Because her testimony is just so terrible. The jurors must have thought it was so ridiculous how she can’t recall anything and how she said I can’t even remember what I did yesterday. It’s just strange. And her defense attorneys seemed to just let it happen.

Her entire argument is that she met up with her ex at the Dolce Vita to discuss a potential blackmail letter - a letter which Charlie already stated in an earlier telephone conversation that he believes she is implicated in - and when there for nearly an hour discussing how the police couldn't prove their guilt, she either can't remember or claims to know nothing about what he was talking about. This is the worst defence strategy ever. The crazy thing is how she can sit there with total confidence while lying about everything abs she doesn't even blink an eye.

I was stunned to see TK break down and cry (as you said, like she was going away herself); It really was like they either believed in her innocence, were not going to get paid for all their work, or their pipe dream of being in the same category as Jose Baez who pulled off those miraculous acquittals for Casey Anthony and then Aaron Hernandez, was done - over - dead.
I believe the attorneys were crying because it was their bright idea to put her on the stand with the "I don't remember" and "he was saying scenarios" defense; because before being taken away, she said "I DIDN'T WANT THIS!" so what did that mean?
I think she did not want to testify or act like she forgot everything that happened before today (relating to her stating in a snarky response, "I can't remember what I did yesterday!")... She got played like a fiddle!
