Is a Hindu marriage valid without saat phere? Here's what SC says

  • The Supreme Court has ruled that a Hindu marriage cannot be recognized in the absence of a valid ceremony like saptapadi, the seven steps taken by a couple around agni that represent seven promises or principles they make to one another, under the Hindu Marriage Act. In fact, the court has said that if you register your marriage without following the rituals under the Hindu Marriage Act, then the registration is of no legal consequence, or is invalid.

    In Karnataka excepting Brahmins and vaishyas does not folliw sapta padi.They folliw their own rituals.Judges are ignorant of vivid marriage practices in india.

      That's why the phrase relevant customs and usages, including where applicable saptapadi, has been used in the judgment and in the video if one pays attention to the video. Hindu marriages where the custom of either party follows rituals other than that of saptapadi were and continue to remain valid.

    This bollywood culture of flowy and flashy wedding destroyed the classic and simple indian weddings.
    Tamils and malayalis still marry in their own way and arent influenced by punjabi bollywood and their weddings are still one of the best in india

    She kept saying "7 steps" and I kept saying to myself "who the hell is capable of doing 1 phera in 1 step!" 😂

      In many maharashtrian wedding ceremonies (including in mine) it is usually saptapadi which means seven steps. Reading some comments below, I realize that this may be a Brahmin custom, and that other castes and communities may have other rituals. I frankly find this SC ruling quite confusing considering the diversity in customs of Hindu weddings

      Sapthapadi and agni hotram are the two things that should be there in Hindu marriages. We take marriage oath with agni sakshi.

      Saptapadi and Saat phere are two different rituals. Popular media has conflated these two.
      Marathi marriages have Saptapadi where the bride touches 7 mounds of rice with her toes and the husband holds her hand.
      Saat phere is predominant in Northern regions, AFAIK. They circumambulate holy fire 6 or less times (not 7, because mortals don't do that).

    Sapthapadi may be in marriage mantras even some people has different traditions. I believe.
    In telugu states we follow”kongu mudi - knotting saree and dhoti” and walking with little fingers locked to see Arundhathi nakshatram. That kind of equates sapthadadhi.

    Anything can be made legal or illegal depending upon human will, but rituals are a way to keep intelligence of people in a way that will support their well-being. But superstitious people will only disbelieve because science has told them to, although science itself comes out every two years with a new theory on the same subject scrapping the earlier one. Well, this is a very European thing that what you are incapable of, just de-humanise it, i.e they can perceive it because it takes a certain level of attention which needs to be cultivated. And, they are afraid of Indians for this because then they will change the whole unjust system created by their own power hunger. That is the power of human intelligence and the characteristic of bharat in particular.

    This is the reason why India needs uniform civil code, so that all Indians follow same rules for marriage and succession. In this particular supreme court case, the couple thought their marriage was registered under the Hindu Marriage Act, and the court said no because there was no Hindu ceremony involved. They could have got married under common law marriage, but then the rules of succession related to inheritance, etc may be different.
