One question: in law how can i check if a law or section of a law still stands or, has been superceeded by anither Act or case kaw please?
If both oblique and direct intent were plausible in a scenario would you get more marks for explaining and applying both of them to the scenario then if you were to explain and apply only one?
Yes, you would get more marks for explaining both possibilities because it shows that you understand the law, and the fact that there isn’t always a clear answer, it can be argued either way. It’s good to suggest which is the most likely on the facts.
Yes it is. Self-defence is available as a defence to murder. It’s a complete defence, so if successful, the defendant is not guilty. It’s not like the partial defences, which reduce murder to voluntary manslaughter. Remember that the key issue with self defence is whether the force is reasonable or not, which will be a question of fact in every case.
