This is an ridiculous and utterly baseless attack on a nominee by Hawley, unless you think no defense attorney should ever work in government. Our criminal justice system is adversarial, it's not just his job, but his constitutional duty to zealously advocate for his client. If we're going to punish defense attorneys for advocating for their clients we might as well just remove the 6th Amendment right to counsel from the Constitution entirely.

So what are you going to do to help in the fight against it? Our public schools have just become breeding grounds for pedophiles to indoctrinate and sexualize children. When caught, the monsters just claim being misgendered and then cops and lawyers won't touch the case. Parents fighting against this are slowly and steadily losing more and more of their rights (despite what the Daily Wire would have you believe).
We stood by for too long thinking it wasn't happening. Maybe some were ignorant, maybe some delusional. We thought it wouldn't affect our community, certainly not our school, right? It was a BS line of questioning, actually. I’m no fan of ANY Biden nominee, but this line of questioning is stupid. It’s a defense attorney’s DUTY to defend their client zealously. All the way to sentencing. I thought Hawley would know that, but apparently not. I wonder how many innocent ppl exonerated by DNA had lawyers that didn’t give their all because they thought their client was guilty. I’m pretty sure it’s more than zero. Not American but was abused from aged 8 to 16 in UK social services care the police and others who we reported it too did nothing apart from those who became abusers them selves leaving s/s care I joined the Royal Navy and after finishing basic training I went looking for the worst of them it took years to find him fortunately or unfortunately which ever way you look at it by the time I found them they were already dead otherwise GOD alone knows what I would have done. That was thirty years ago and I still have problems because of it. People like this lawyer make me sick to my stomac.

It's a defense attorney's responsibility to zealously advocating for his client at all stages of court proceedings, including the sentencing phase. To slack off during the sentencing phase is unethical and malpractice.

He was court-appointed, even though his bread and butter is prosecution? Seems like someone was trying to trip him up, expecting him to ruin his own client's case and then suggest a longer sentence. Instead, he under-corrected and now that has come back to bite him in the asss. He has integrity issues that become obvious during his testimony.
I disagree. A defense lawyer is required by "ethics" to do the very best job for his client. That's his job. That's the whole point of a our justice system - two sides arguing vigorously for their side. I believe Hawley is way off base here. There is still the sentencing phase. There are still appeals. A lawyer is supposed to zealously advocate for his client during all phases of the trial.

Punishment can have a deterrent effect on others, I recognize that, but proper prevention of re-offending can also carry that deterrent. Simple punishment for punishment sake serves no real purpose. Enjoying the suffering that punishment inflicts says something bad about the people who enjoy inflicting suffering.

It's a political show. An attorney represents a client. A prosecutor represents the state. A judge decides. It's an attorney's sworn duty to advocate for a client, period. Called the adversarial system. You have it in England, long tradition, Barristers in court. Hawley, Cruz, and these other political folks know this well, as they took the same oath when they were sworn in as lawyers. They don't operate in the legal system as attorneys, they are politicians putting on a show for the public.

Okay, I find this defendants actions to be just about as deplorable as they can be, but the guy did his job as a lawyer. In all fairness it was his job to defend his client to the very best of his ability. The fault lies in the judge so why are you holding that against him when he did an effective job?
WRONG! His job as a lawyer is an officer of the court and the ONLY obligation of a lawyer to their client SHOULD be to assure they receive a "FAIR TRIAL". America's most dishonest professionals have turned that concept on it's head to where lawyers feel free to use ANY tactic to get their client OFF.
No. Most reasonable people with a moral compass inherently know that it is indefensible defending this garbage and yet certain individuals willingly do so using underhand, dubious tactics. As the comment above states there is a huge difference between a fair trial and the shameful behaviour of certain defence lawyers.
He was a court appointed attorney, not a privately hired attorney - there is a huge difference! He should be on a side of justice and follow judicially recommended guidelines - private lawyer has no such constrains!

Don't get me wrong, I honestly think that his defendant should have gotten a much more Stern punishment because this is completely unacceptable behavior!! But if I was on trial for a crime of some sort, I don't think it's fair or just put anyone put restrictions on my lawyer so that he can't represent me to the best of his ability.

I didn’t think he was stupid like this. I wonder how many innocent ppl exonerated by DNA, or proven bungled cases, had lawyers that didn’t give their all because they thought their client was guilty. I’m pretty sure it’s more than zero considering the alarmingly high number of them. I generally agree with Sen. Hawley on many issues, however the defense lawyer has a responsibility to do the best for his client.
NO a lawyer's job, as an officer of the court must only be to assure their client gets a FAIR TRIAL. Now they do their best, using any means to get their client off no matter the damage to society.
@@mikewurlitzer5217 If by fair you also mean balanced, if the prosecution is able to spend almost unlimited funds on the prosecution and recommend a long term sentence, then recommending a short term sentence sems to balance out the game and is fair. The trial part was over...the lawyer wanted a shorter sentence, what do you want him to do agree with the prosecution?
@@mikewurlitzer5217 A lawyer's job is to zealously advocate for his client during all phases of trial including sentencing. A lawyer can't just slack off after the verdict is read. That's an ethics violation and malpractice.

Isn't the attorney's job to try and get the best deal, lowest amount of jail time possible? It's up to the prosecutors and finally the judge to make the determination, not the defence attorney. Unless I'm missing something, as disgusting as the case is, or the person doing the crime, our justice system needs to be equal and attorney's need to be able to do their job as best as they can, regardless of the defendant.

Federal circuit and district judges should never be "lifetime appointments". Our justice system or should I say "Just-Us System" has turned into and is a political playground for activists.
