Adjustment of Status Through a K 1 Fiance Visa Entry

- The K-1 visa is for the foreign fiancé of a U.S. citizen to enter the United States to marry his/her fiancé. Once you enter the U.S. on a K-1 visa, you have 90 days to marry the U.S. citizen. A K-1 visa does not allow the foreign national to stay in the United States for more than 90 days, and it can’t be extended. But once married, the foreign national may stay in the United States if he or she applies for adjustment of status through a K-1 visa entry.
Adjustment of status to permanent residence is an exclusive process to apply for a green card reserved for certain intending immigrants that are physically present in the United States. A K-1 visa holder who has married his or her U.S. citizen fiancé is generally eligible.

Hi! I find your videos very informative and helpful! My husband came to the US on a K1 fiancé visa on April 6, 2024, we got married May 6,2024 and filed his Adjustment of status on June 3rd and the lockbox got it on June 6th. But I got a email from my credit card on June 10 that the payment has been rejected and one was taken but then disappeared from my statements so I assuming they didn’t take any payment and will send my application back. I have been waiting and still no communication from them? Is it this long? How long more should I wait or expect anything?
We already got approved and married in the USA. I never received my NOA 2 and now the uscis wants us to pay them $570 for a copy of the NOA 2 ? Which we never received. Can I file my adjustment of status without a NOA 2 ?
Got to the US April 27,2024 . Applied for change of status by May 10th , I haven’t heard anything from the USCIS

Yes it was very educational and I knew if not all but most of what you said. After filling the adjustment states and during the process leaving USA and that cancels the process but how can we start the process when one of the spouse not in the USA?
When filing the adjustment of status, you can travel internationally once you have an approved advanced parole. If you travel internationally before receiving the advanced parole, you will have to continue the process via consular processing. You have to fill the form AOS right after you got your marriage certificate
Hello. Good Information. I have a couple of questions. My fiance was just approved the K1 Visa and we are waiting for it to be mailed to us. I live abroad with my fiance and I am wondering when does the 90 days start. Does the 90 days start once we arrive in the States or does the 90 days start on the day of approval?
Also after we get married in the States how long does it take for the marriage to be recognized and the 90 day timeline to be dropped. Is the marriage within 90 day requirement met right after the marriage is signed or is there some process time that we must be aware of.

Great video! I'm still a little confused by the timeline. It would be helpful if you could lay out the milestones in terms of what happens when and how long the wait times between each stage is. For example, I'm still confused how long it takes after you file for your change of status before you get your conditional green card and work permit (and do they arrive simultaneously?). Then is it conditional for 2 or 3 years? I didn't understand this.

It’s unlikely. At this time, normal processing times for the K-1 visa takes about 2 years to process, and the AOS takes at least a year to process.
