Actually it doesn't, you don't seem very well informed as in the NY case there is no mandatory prison sentence. Nor is the jury or any criminal case about 'justice' but about the law and evidence. Yours is a common misconception. If justice is served in sentencing that is just an extra because everything in a case is based on evidence. Some crimes cannot be considered as crimes in law because there is literally no law against them extant even if there should be. Some cases are not indicted not because the DOJ doesn't think an individual or individuals are not guilty but because there isn't enough evidence to convict in a court of law or it is considered that said evidence won't stick.
