I am 68 years old, and newly rated 100% P&T for PTSD, plus 3 additional conditions @ 10% each. I still have several other conditions that are easily directly Serviced Connected that I have not yet filed for, including a gastrointestinal condition that is worth at least 60% on its own. If I push this claim through, there will be two theories for SC - PTSD or TERA. If this is successful, I will also be filing for SMC-S1. My question: if I pursue this, what is the likelihood that my PTSD rating will be opened up for re-evaluation?
@@markwolfmanphotography737 Matthew Hill of Hill and Ponton VA Law Firm used to make a similar statement what you made. Carol Ponton disagreed with him and gave him reasons why. Matthew has changed his comments. Two of the reasons why veterans keep filing are: SMC-S and for severe conditions such as heart disease, hypertension, sleep apnea, and others. A married veteran may want to be service-connected for one or more of these conditions for the purpose of a DIC Claim, if needed. After receiving 100% P&T, I filed for presumptive hypertension (PACT Act, Thailand) and increase for migraines. Both C&P were ACE and granted. Every veteran claim is different.

Hello Dwayne, I gotta pick your brain for a second. When you became a rating specialist, What degree did you use if any to get your foot in the door to be hired as the rater. Today I just got approved to retrain through vr&e and I have an opportunity to get a social worker degree, or business management. If you see where this is going, I want to see if I have a better fit at being a vso, vsr
When I hired in, the VA required we have a masters (don't know why), as a high school diploma and common sense will work. If you want to get in, look at the verbs in the roles and responsibility in the job description, make sure you have them in your resume, and cross your fingers. if they are hiring outside of the VA, you have a better chance. Also, just don't look at your area. Let's say you are in Austin, TX, there could be a remote position in Columbia, SC. I don't know how they would do the initial training. Whewwwwwwww, that was a lot. Good luck. Do you want to be educated on the VA claims process, subscribe to our newsletter at www.kmd89.com "Don't Be Frustrated, Get Educated"
Hello @DewayneKimble, this isn't related to your video, but maybe you or someone else can weigh in. I filed a supplemental last week and called the 800 number because I did not get a text confirmation. I did get an email confirmation. The VA did not see the supplemental in my file, but someone suggested it was in the electronic mailbox. The problem is that the supporting documents were all over the place. It appears Quick Submit separates the VA forms from the supporting documents. This becomes a huge issue if the raters or other reviewers aren't looking at the complete claim. I learned today that a document I submitted weeks ago was showing received last week. That document had nothing to do with what I submitted last week. I have seen blogs where Veterans submit supporting evidence, and the decision letter doesn't list that evidence. I'm not sure if it's because the raters are not getting the evidence or they are not reading it before denying a claim. Both may be true. Please let me know if you have heard anything like this and what advice you have to prevent it. Thank you!
I've seen this as a VA rater. Make sure each document is uploaded separately. Also, name is document. Many veterans will just say, private evidence instead of saying Private DBQ for tinnitus signed [date]. Scan is document separate. Aren't they trying to reduce Sleep Apnea if its treatable with a CPAP? Mine was service connected since 6 years before I retired... Listed as severe... I get rated for it at 50%. But, I have talked to TWO different VAs, one in NYC and one in El Paso and they both told me that the VA does not even service CPAPs nor orders parts for them anymore. So thats what has me confused about the reduction rumor... If we are being treated with a CPAP yet the VA doesnt service them, how can the rating be reduced when we are not actually being treated once a machine breaks or otherwise no longer functions properly. Those machines are not cheap, neither is going to a sleep center and having them program them.
Just removing the 50 percent criteria. You order the parts out of Denver but it will depend on what type of CPAP you use. The new ones, the parts you will have to order from Denver. 303-273-6200 option 2, email DALC.CSS@VA.gov or you can call your local PAP Clinic. Hope that helps, you will have to start there. The 50 percent is on the VBA side, the CPAP in on the VHA side. As a former VA rater trained by the VA and adjudicated hundreds of claims. If you are 100 percent and file a new claim, they will not go back and review everything. Keep in mind, each claim is different but know what you are doing when you file that claim. I've rated claims where veterans had 100% and never went back and looked at everything. Since the effective date of my rating is March 2022, should I live with this a little while longer, or "go for it" now as a secondary? Any basic advice would be appreciated.
I would start the claim today. You don’t have to finish it, you have 1 year once you start an intent to file so once you have your decision, today will be your effective date

Be very careful dealing with the VA for medical issues, especially if you are 80 or more. Beware of the threat of having your drivers license taken from you and total control of your life via medication & psych departments. Also, beware they will use your insurance money from employment after service being used. I know that many vets have no choice but to use VA, but for me the worst decision I ever made in my life was using VA Health Benefits. What about Reynauds Syndrome? I noticed my Reynauds seems to get triggered and more severe when my anxiety and stress is high. I asked my PCP in myhealthe vet messenger and their response was yes, stress/anxiety can aggravate Reynauds. How do I get Nexus letter to link it to my PTSD as secondary?
I can't say as I'm not a medical professional. Reach out to Dr. Freeman for a DBQ and nexus. He would know. Need a medical DBQ and nexus statement? Do I need to tell the C&P Examiner when I want to claim something as primary or secondary? And where is best place to download the studies that can support your claim?

I had rating for gerd first. This year I got rated for ptsd- depression. I wonder if I could get an increase for gerd after being rated for ptsd. My gerd was only at 10% and that was almost 10 years ago.

Anything. Can be reviewed if you file a new claim.
Let sleeping dogs sleep, is my opinion

Matthew Hill of Hill and Ponton VA Law Firm used to make a similar statement what you made.
As a former VA rater, when a veteran was 100% P & T and filed a new claim. I didn't go back and look at everything. Each claim is different and just know what you are doing when you file that claim. What if you have been service-connected for everything you listed in this video, other than the skin condition, how do I know if they have been listed as secondaries?

I remember submitting a claim for sleep apnea and it being denied for it not being service connected. I am 70% PTSD rated and maybe i should submit as secondary to my PTSD?

What do you feel if you’re already 100% pt for mental health but want to file secondary migraines to get smc-s? Is there a lot of risk to the 100% p and t? I didn’t do any lying or fraud, do I have much to worry about
If you have the evidence go for it .Just don't go telling them you feel any better..They may or may not make you do another PTSD exam
Keep in mind anytime you reopen your file though they can review anything and everything that is in your file
As a VA rater, I never went back and looked at everything. Go for it but know what you are doing and maybe get your own DBQ and nexus. Why would they go back and look at everything, doesn't make sense. Keep in mind, every claim is different. Need a medical DBQ and nexus statement? I was told there is a program or something that pays out up to 10K on top of your 100% for TBI. I was diagnosed with post concussion syndrome. Is that true if so How do I apply. Thank you very much for your time and insight.
I have a video on "they said", can you share that link. Is it for an SMC like R1 or R2, I have a video on that as well.
If I'm already at 100% P&T, is there any benefit to adding more items to the file? Is there an opportunity for backpay?
If you open up your file, they can review anything in there and reschedule new CMP exam. Not a guarantee that it will happen, but that is the chance. Firstly, I would lay the sleeping dog lie

@lorenzotimmons2598 not scaring the vets. I'm just relaying what I have been told by my vso...

Back pay will be based on the effective date. If you obtain S/C and the effective falls during the time you had 100 percent, not back pay unless there is an SMC assigned. I'm rated for PTSD (Desert Storm, Army), but since receiving the award I have developed some significant stomach trouble (have to time meals and be very strategic about long drives). Since the effective date of my rating is March 2022, should I live with this a little while longer, or "go for it" now as a secondary? Any basic advice would be appreciated.
@ Thanks! I thought so…!
I would start the claim today. You don’t have to finish it, you have 1 year once you start an intent to file so once you have your decision, today will be your effective date

I thought i had a solid Sleep Apnea claim, solid nexus that even stated that it was directly related to Rhinitis with a statement about aggravated by PTSD, decision -deny, HLR - Deny. Reading the IMOs for the contractor's is extremely disheartening since they don't seem to actually review medical records, SMH. Any way keep on charging don't give up!!

Difference between PTSD chronic mental illness?
You would have to ask a mental health provider.
That came off funny to me 😂😂@@DewayneKimble
@@jsopranomusic No, I don't know as I'm not a mental health provider. I don't want to speak on that as a certified mental health provider would be equipped to answer that.
Sir, this is urgent, and I hope you can point me in the right direction. My friend is getting 50% ptsd. He has had a rough time since he lost his job during covid and hasn't been able to get a steady job since. He just got in touch with me and asked my for a loan to help him out. It pains me that I don't have the amount of money that he needs. He can pay his rent and pay other expenses. Is there any type of help he can get from the VA? Thanks.
They have reps who help out veterans at risk of being homeless at va offices.
Good question. other than compensation under VBA, have him to contact the patient advocate office or a social worker under VHA and they may be able to point him in the right direction. Every male in my family including WW1, has served, my brother is victim of Agent Orange 67, 68 Vietnam 199/lt inf div red catchers. God Bless you my brothers!

Examiners will fill out the DBQs in their computers as they ask questions and will not show you what they wrote. Some of them will even say they will “link your teeth clenching to tour ptsd” to find out from your VSO that it got denied when the VSO looked at the examiner’s notes on vbms.
